HomeMy Public PortalAbout06872 O R D I N A N C E NO. 6872 AN ORDINANCE, declaring the necessity for the acquisition of certain real property and easements within certain existing property within The Metropolitan St. Louis Sewer District for the purpose of permitting construction of sanitary sewers in the project known as the Bonfils Interceptor Sewer (86056) to serve the needs of residents of the area and authorizing the acquisition of such easements by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of St. Louis County known as the Missouri River Watershed wherein live and work numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by providing for the construction of sanitary sewers for said area in order to relieve and alleviate these conditions: NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise certain real property and easements for the construction of sanitary sewers as hereinafter set forth, together with temporary easements for working room during the construction or reconstruction period and the right of ingress and egress over the premises sought to be condemned for access to such easements, said property and permanent and temporary easements being more particularly described as follows: 3 Bonfils Interceptor (86056) Community Federal Savings and Loan Association 12P - 42 - 0013 (Parcel #2) A permanent sewer easement, 10 foot in width, across a tract of land being part of Lots 15 and 16 of Louis C. Smith's Subdivision in U. S. Survey 2040, Township 46 North - Range 5 East, of the Fifth PRINCIPAL MERIDIAN, St. Louis County Missouri, and across property conveyed to Community Federal Savings & Loan Association as described in Parcel 2 of deed recorded in Book 6537, Page 180 of the St. Louis County Recorder's Office, the centerline of said 10 foot wide sewer easement being more particularly described as follows: Commencing at the Northwest corner of property conveyed to Louis Cohen, et al., by deed recorded in Book 3248, Page 449 of the St. Louis County Recorder's Office; thence Southwardly along the West line of said Cohen property, being also along the East line of property conveyed to the Metropolitan St. Louis Sewer District by deed recorded in Book 7021, Page 1099 of the St. Louis County Recorder's Office, South 23 degrees 45 minutes 24 seconds East 1375.99 feet to the actual point of beginning of said 10 foot wide permanent sewer easement; thence along the centerline of said permanent sewer easement North 64 degrees 18 minutes 50 seconds East 283.63 feet, along a curve to the left whose radius point bears North 25 degrees 41 minutes 10 seconds West 525.2 feet from the last mentioned point, a distance of 119.5 feet, and North 51 degrees 16 minutes 48 seconds East 642.97 feet to the point of ending of said 10 foot wide permanent sewer easement said point being distant Southwardly along the East line of aforesaid Community Federal Savings and Loan Association property South 23 degrees 52 minutes 15 seconds East 1163.28 feet from the Northeast corner thereof. Also temporary construction easements for use in the construction or reconstruction of any sewer in the above described sewer easement and being located on strips of land 25 foot in width along the Northwestwardly and the Southeastwardly sides of and contiguous with the above described 10 foot wide permanent sewer easement. 4 Bonfils Interceptor (86056) R & G Investment Company, Inc. 12P - 44 - 0024 (Parcel #3) A permanent sewer easement, 10 foot in width, across a tract of land being part of Lot 15 of Louis C. Smith's Subdivision in U. S. Survey 2040, Township 46 North - Range 5 East of the Fifth PRINCIPAL MERIDIAN, St. Louis County, Missouri, and across property conveyed to R & G Investment Company, Inc. by deed recorded in Book 6359, Page 476 of the St. Louis County Recorder's Office, the centerline of said 10 foot wide sewer easement being more particularly described as follows: Commencing at the Northwest corner of Parcel No. 1 of said property conveyed to R & G Investment Company, Inc. by deed recorded in Book 6359, Page 476 of the St. Louis County Recorder's Office; thence Southwardly along the West line of said Parcel No. 1 South 23 degrees 52 minutes 15 seconds East 1163.28 feet to the actual point of beginning of said 10 foot wide permanent sewer easement; thence along the centerline of said permanent sewer easement North 51 degrees 16 minutes 48 seconds East 721.77 feet to the point of ending of said 10 foot wide permanent sewer easement; said point being in the East line of aforesaid Parcel No. 1 of the R & G Investment Company, Inc. property and being distant South 23 degrees 44 minutes 35 seconds East 972.15 feet from the Northeast corner of said Parcel No. 1. Also temporary construction easements for use in the construction or reconstruction of any sewer in the above described sewer easement and being located on strips of land 25 foot in width along the Northwestwardly and Southeastwardly sides of and contiguous with the above described 10 foot wide permanent sewer easement. 5 Bonfils Interceptor (86056) R & G Investment Company, Inc. 11P - 12 - 0026 (Parcel #4) A permanent sewer easement, 10 foot in width, across a tract of land being part of Share 8 of the Subdivision in Partition of Mary L. Grier Tract in U. S. Survey 2040, Township 46 North - Range 5 East of the FIFTH PRINCIPAL Meridian, St. Louis County Missouri and across property conveyed to R & G Investment Company, Inc. by deed recorded in Book 6359, Page 476 of the St. Louis County Recorder's Office, the centerline of said 10 foot wide sewer easement being more particularly described as follows: Commencing at the Northwest corner of Parcel No. 2 of said property conveyed to R & G Investment Company, Inc. by deed recorded in Book 6359, Page 476 of the St. Louis County Recorder's Office; said point being also a point in the West line of said Share 8 of the Subdivision in Partition of Mary L. Grier Tract; thence Southwardly along said West line of Share 8, being also along the West line of said Parcel No. 2 South 23 degrees 44 minutes 35 seconds East 972.15 feet to the actual point of beginning of said 10 foot wide permanent sewer easement; thence along the centerline of said permanent sewer easement North 51 degrees 16 minutes 48 seconds East 862.34 feet and North 51 degrees 18 minutes 25 seconds East 20.65 feet to the point of ending of said 10 foot wide permanent sewer easement; said point being in the East line of aforesaid Parcel No. 2 of the R & G Investment Company, Inc. property and being distant South 23 degrees 44 minutes 35 seconds East 790.11 feet from the Northeast corner of said Parcel No. 2. Grier Tract, in U. S. Grier Subdivision, said subdivision being recorded in the St. Louis County Surveyor's Record Book 8, Pages 102 and 103, in U. S. Survey 2040, Township 46 North - Range 5 East of the FIFTH PRINCIPAL MERIDIAN, St. Louis County Missouri, and across property conveyed to Anita Bechtold by deed recorded in Book 6208, Page 289 of the St. Louis County Recorder's Office, the centerline of said 10 foot wide sewer easement being more particularly described as follows: Commencing at the common corner of Shares 5 and 6 of said Mary L. Greer Subdivision; said point being also a point in the East line of U. S. Survey 2040; thence Northwardly along said East line of U. S. E. Goldstein 090 - 33 - 0069 (Parcel #19) A permanent sewer easement, 10 foot in width, across a tract of land in U. S. Survey 47, Township 47 North - Range 5 East of the FIFTH PRINCIPAL MERIDIAN, St. Louis County, Missouri, and across property of the Estate of I. E. Goldstein, as described in deed recorded in Book 6468, Page 752 of the St. Louis County Recorder's Office, the centerline of said 10 foot wide sewer easement being more particularly described as: Commencing at the most Western corner of property conveyed to I. E. Goldstein and Mary Goldstein, his wife, by deed recorded in Book 6468, Page 752 of the St. Louis County Recorder's Office; said point being also a point in the North line of St. Charles Rock Road - State Highway 115; thence Eastwardly along said North line of St. Charles Rock Road - State Highway 115, being also along the South line of said Goldstein property South 69 degrees 53 minutes East 285.23 feet to the actual point of beginning; said point being distant Westwardly along said North line of St. Charles Rock Road North 69 degrees 53 minutes West 167.34 feet from the most Western corner of Northwest Industrial Park Subdivision, a subdivision according to the plat thereof recorded as Daily Number 704 on April 18, 1986 in the St. Louis County Recorder's Office; thence along the centerline of said permanent sewer easement the following courses and distances: North 53 degrees 40 minutes East 24.00 feet, South 69 degrees 53 minutes East 161.00 feet, and North 52 degrees 45 minutes East 570.93 feet to a point in the North line of aforesaid Goldstein property and being also the point of ending of said 10 foot wide permanent sewer easement. Also, two (2) temporary construction easements for use in the construction or reconstruction of any sewer in the above described permanent sewer easement and said temporary construction easements being more particularly described as follows: TEMPORARY CONSTRUCTION EASEMENT NO. 1 A 25 foot wide strip of land along the Northern and Northwestern sides of and contiguous with the above described 10 foot wide permanent sewer easement. TEMPORARY CONSTRUCTION EASEMENT NO. 2 Beginning at the most Western corner of Northwest Industrial Park Subdivision, a subdivision according to the plat thereof recorded as Daily Number 704 on April 18, 1986 in the St. Louis County Recorder's Office; said point being also a point in the North line of St. Charles Rock Road - State Highway 115; thence Westwardly 9 along said North line of St. Charles Rock Road - State Highway 115, being also along the South line of property conveyed to I. E.
