AN ORDINANCE, transferring One Million Forty-five
Thousand Seven Hundred Twenty-two Dollars ($1,045,722.00) from the
Mississippi River General Fund to the Mississippi River
Construction Fund in order to close said Mississippi River General
Fund; and appropriating Three Million Five Hundred Thousand
Dollars ($3,500,000.00) from the Mississippi River Construction
Fund for the acquisition of certain parcels of real property in
the City of St. Louis, Missouri for the construction of secondary
treatment additions to the Bissell Point Wastewater Treatment
Plant.
WHEREAS, the Mississippi River General Fund is no
longer necessary for the purposes under which it was formed, and
WHEREAS, Ordinance No. 6127, adopted July 10, 1985, and
Ordinance No. 6651, adopted July 9, 1986, authorized acquisition
of the aforesaid real property by the District by purchase or by
the institution of condemnation proceedings, and
WHEREAS, the Commissioners' Award in the condemnation
proceedings for the Burlington Northern Railroad Company property
is Three Million Three Hundred Thousand Dollars ($3,300,000.00);
and the purchase price for a portion of the Sligo, Inc. property
is Thirty-two Thousand Six Hundred Seventy Dollars ($32,670.00);
and contingencies for court costs and legal fees for the
acquisition of said real property is estimated to be One Hundred
Sixty-seven Thousand Three Hundred Thirty Dollars ($167,330.00),
and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the fund from which this
appropriation is made sufficient to pay the obligation incurred
herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of One Million Forty-five
Thousand Seven Hundred Twenty-two Dollars ($1,045,722.00) is
hereby transferred from the Mississippi River General Fund to the
Mississippi River Construction Fund in order to close said
Mississippi River General Fund.
Section Two. The sum of Three Million Five Hundred
Thousand Dollars ($3,500,000.00) is hereby appropriated from the
Mississippi River Construction Fund for the acquisition of certain
parcels of real property in the City of St. Louis, Missouri for
the construction of secondary treatment additions to the Bissell
Point Wastewater Treatment Plant.
Section Three. This Ordinance, being an appropriation
Ordinance, shall take effect immediately upon its enactment.
