HomeMy Public PortalAbout06881 O R D I N A N C E NO. 6881 AN ORDINANCE, authorizing and directing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to lease certain real property of The Metropolitan St. Louis Sewer District, lying in St. Louis County, Missouri, to St. Louis County, Missouri, for use as a public park, and to execute and deliver a Lease Agreement upon the conditions hereinafter set out. WHEREAS, the District owns certain surplus unimproved real property in St. Louis County, and WHEREAS, St. Louis County, Missouri is desirous of leasing said real property for use as a public park, upon the terms and conditions as hereafter generally set forth, and WHEREAS, the District is willing to enter into such a lease, and believes it to be advantageous and in the public interest to do so, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District is hereby authorized to lease to St. Louis County, Missouri, upon the general terms and conditions hereinafter set forth, the following described real property: 2 M.S.D. PROPERTY ON CREVE COEUR MILL ROAD NEAR WATERWOODS ROAD (MASTER PUMP STATION NO. 2 - L52) (Revised 11/4/86) A tract of land being part of Lot 9 and Lot 10 of "MADDEN TRACT SUBDIVISION" according to the plat thereof recorded in Plat Book 33, Page 18 of the St. Louis County, Missouri, Records, and the accretions adjoining on the east, and part of U. S. Survey 3094, Township 46 North, Range 5 East, described as follows: Commencing at the northwest corner of said Lot 9 being in the centerline of Creve Coeur Mill Road (originally 30 feet wide); thence along the centerline of said Creve Coeur Mill Road, being the west line of said Lot 9, south 11 degrees 36 minutes 00 seconds west a distance of 875.84 feet to THE ACTUAL POINT OF BEGINNING of the tract herein described; thence continuing along said centerline of Creve Coeur Mill Road, being the west line of said Lots 9 and 10, south 11 degrees 36 minutes 00 seconds west a distance of 1,920.95 feet to the southwest corner of said Lot 10; thence along the south line of said Lot 10 and along its northeastward prolongation, north 79 degrees 09 minutes 00 seconds east a distance of 1,275.46 feet to a point; thence north 35 degrees 10 minutes 00 seconds east a distance of 1,240.88 feet to the northwest corner of Lot 1 of "JACOB STUDT, JR., HOMESTEAD SUBDIVISION"; thence north 35 degrees 22 minutes 00 seconds east a distance of 303.97 feet to a point; thence north 77 degrees 49 minutes 00 seconds west a distance of 1,797.52 feet to the point of beginning, and containing 54.3 acres, more or less; EXCEPTING THEREFROM the right-of-way of Creve Coeur Mill Road; ALSO EXCEPTING THEREFROM that property conveyed to St. Louis County, Missouri by deed recorded in Book 6423, Page 2036; ALSO EXCEPTING THEREFROM, the area where The Metropolitan St. Louis Sewer District (M.S.D.) Holding Basin and Pump Stations are located; said area of the M.S.D. Holding Basin and Pump Stations being more particularly described as follows: Beginning at the southwest corner of Lot 10 of the aforementioned "MADDEN TRACT SUBDIVISION"; thence along the west line of said Lot 10, being the centerline of Creve Coeur Mill Road, north 11 degrees 36 minutes 00 seconds east a distance of 782.00 feet to a point; thence along a line being 10 feet northwardly of and parallel to the north Toe of the north Earth Berm of the aforementioned M.S.D. Holding Basin, north 90 degrees 00 minutes 00 seconds east a distance of 551.85 feet to a point; thence along a line being 10 feet eastwardly of and parallel to the east Toe of the east Earth Berm of said M.S.D. Holding Basin, south 00 degrees 00 minutes 00 seconds east a distance of 620.12 feet to a point in the aforementioned south line of Lot 10; thence along said south line, south 79 degrees 09 minutes 00 seconds west a distance of 722.00 feet to the point of beginning, and containing 9.9810 acres, more or less. 3 Section Two. The lease shall be for an original term of one (1) year, and shall be automatically renewed from year to year, not to exceed twenty-four (24) renewable annual terms, at the rental of One Dollar ($1.00) per year. After five (5) years, either party may terminate the lease upon giving one hundred twenty (120) days notice. Section Three. The Executive Director and Secretary- Treasurer are hereby authorized and directed to execute and deliver on behalf of the District a Lease Agreement giving effect to Sections One and Two hereof, and embodying such other terms and conditions as approved by the Assistant General Counsel. The foregoing Ordinance was adopted December 5, 1986.
