AN ORDINANCE, authorizing and directing the Executive
Director and Secretary-Treasurer on behalf of The Metropolitan St.
Louis Sewer District to enter into a Utility Agreement with the
State of Missouri, acting by and through the Missouri Highway and
Transportation Commission (hereinafter referred to as
"Commission") whereby the District will perform construction to
correct a drainage condition at or about Route I-170, south of
Route 180 near Forest Avenue, in St. Louis County, Missouri.
WHEREAS, the Commission proposes to correct the
drainage condition at the above-cited location, and has designated
the project as Job No. 6-I-170-866, and
WHEREAS, the District proposes to construct and improve
the storm drainage system on Forest Avenue, in the area adjacent
to the Commission's proposed project, and
WHEREAS, the Commission has requested that the District
incorporate and perform the work required in the Commission's Job
No. 6-I-170-866 as part of the District's proposed Forest Avenue
project, and
WHEREAS, the Commission will reimburse the District for
all costs incurred by the District in the completion of said Job
No. 6-I-170-866,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-
Treasurer are hereby authorized and directed on behalf of The
Metropolitan St. Louis Sewer District to enter into a Utility
Agreement with the State of Missouri, acting by and through the
Missouri Highway and Transportation Commission whereby the
District will perform construction to correct a drainage condition
at or about Route I-170, south of Route 180 near Forest Avenue, in
St. Louis County, Missouri.
Section Two. The Utility Agreement authorized in
Section One of this Ordinance shall be comprised of such terms and
conditions as are approved by the Legal Department of the
District. The foregoing Ordinance was adopted February 11, 1987.
