HomeMy Public PortalAbout2770-1973 - Zoning - Special Use - S. 13th StORDINANCE NO. 2770-1973 AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN R-4 MULTI-FArIlLY RESIDENCE DISTRICTS OF ORDINANCE NO. 2325-196&•COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, APPROVED JUNE 3, 1968. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. As provided in Article 31, Section .02 and more specifically as provided for in Article 30, Section .015 of Ordinance No. 2325-1968 commonly known as the Zoning Ordinance of the City of Richmond, Indiana, the following described real estate is allowed as a Special Use, to -wit: Mobile Home Park, more particularly described as follows: Beginning at a point twenty-six and twenty-two hundredths (26.22) rods south and three hundred thirty-six (336.00) feet east of the northwest corner of the said southwest quarter of Section 9, Township 13, Range 1 West; thence eastwardly two hundred forty-nine and nine hundredths (249.09) feet to the south right-of-way line of the C. & 0. Railroad; thence eastwardly along the said south line railroad right-of-way, to the west line of Washington Street (now South 13th Street); thence south along the west line of said South 13th Street, to a point three hundred seventy-four and one tenth (374.1) feet north of the south line of the north half of the southwest quarter of Section 9, said point being Rankins' northeast corner; thence southwest- wardly along said Rankin ' north line two hundred eighty-one (281.0) feet; thence westwardly, nine hundred seven and fifty-five hundredths (907.55) feet to a point three hundred thirty-six feet east of the west line of the south- west quarter of Section 9; thence north, parallel with said west line of quarter section, sip; hundred ten and one half (610.5) feet to the place of beginning. Containing 13.95acres, more or less. EXCEPTING THEREFROM: Being a part of the Southwest Quarter of Section *line (9), Township Thirteen (13), Range One (1) Nest more particularly described as follows: Beginning at a point on the west side of South Thirteenth (13th) Street, fifty (50) feet south of the south right-of-way line of the C. & 0. Rail- road: thence west one hundred fifty (150) feet; thence south one hundred (100) feet; thence east one hundred fifty (150) feet; thence north along the west line of South Thirteenth (13th) Street, one hundred (100) feet to the place of beginning, containing 0.34 acres, more or less, and contain- ing net acreage of 13.61 acres after deduction of the above exception. SECTION 2. As a condition of the aforesaid Special Use and as an additional restric- tion on said use, the following requirements shall hereafter and at all times be met by the owner, leasee or any person, firm or corporation using such real estate. (Conditions to be made following Plan Commission recommendations). 1. The proposed drainage plan that was submitted shall be a part of the plan and shall be carried out. (Drainage plan to lower high water table entitled "Sub - Surface Drainage: and filed in the P.C. File No. 73-2.) 2. The lots shall be shaped so that the water will run off and not stand. 3. It shall be prohibitive to park overnight or camping -type trailers at this park as differentiated in the Municipal Code of Richmond. SECTION 3. The Zoning Administrator of the City of Richmond, Indiana, is hereby authorized and directed upon enactment and publication of this Ordinance, to record and approve the issuance of a permit for the establishment of the use herein allowed. SECTION 4. This Ordinance shall be in full force and effect from and after its pass- age and approval by the Mayor, and publication as by law required. page 2 PASSED AND ADOPTED by the Common Council of the City of Richmond, Indiana, this day of 1973.
