AN ORDINANCE PROHIBITING THE PARKING OF VEHICLES ON STREETS BEING
CLEANED, REPAIRED OR OTHERWISE MAINTAINED PURSUANT TO ORDER OF THE
BOARD OF PUBLIC WORKS AND SAFETY.
WHEREAS, the Common Council of the City of Richmond, Indiana, has the
power to enact ordinances relative to keeping the streets and alleys
clean and free from obstructions to public travel and to enact
ordinances regulating vehicles on the public streets, and
WHEREAS, the Board of Public Works and Safety has the power to repair,
clean, light and sprinkle any street within the City, and
WHEREAS, it has been recommended by the Street Commissioner of the
City of Richmond, Indiana, that parking on public streets in the
City be prohibited during specified intervals of time to facilitate
the cleaning, repair or other maintenance of the streets;
NOW THEREFORE, Be it Ordained by the Common Council of the City of
Richmond, Indiana, that:
Section 1. The Board of Public Works and Safety is hereby authorized
to delineate a specific area in the City to be cleaned, repaired
or otherwise maintained during a specific period of time.
Section 2. No resident vehicle owner or any other vehicle owner
who should have been reasonably put on notice shall park his or her vehi-
cle or shall allow his or her vehicle to be parked within an area
to be cleaned, repaired or otherwise maintained pursuant to order
of the Board of Public Works and Safety during a time designated by
the Board of Public Works and Safety.
Section 3. Deliniation of an area to be cleaned, repaired or other
wise maintained pursuant to this ordinance and the designation of
the time of such cleaning, repairing or of such other maintenance shall
be by an order of the Board of Public Works and Safety in a regular
public meeting.
Section 4. Notice ;hall be deemed sufficient to resident vehicle
owners if a statement of the order of the Board of Public Works
and Safety specifying time and areais published one time at least
24 hours in advance of such cleaning, repairing or otherwise maintaining
of such streets.
Section 5. Notice to any vehicle owner not a resident hereunder, shall
be deemed sufficient if the presence of signs in the area designated
should have reasonably put said vehicle owner on notice or for any other
reason(s) the said vehicle owner should in fact have been put on notice
of the cleaning, repairing, or other maintenance ordered hereunder.
Section 6. A resident vehicle owner shall be defined as any owner
of a vehicle whose certificate of registration with the Bureau of Motor
Vehicles of the State of Indiana shows an address within the corporate
limits of the City of Richmond, Indiana. The certificate of registration
shall be the certificate of registration for the current year.
Section 7. It shall not be a defense hereunder that a resident vehicle
owner was outside the corporate limits of the City of Richmond, Indiana,
on the date of the publication of notice nor shall it be a defense that
the resident or nonresident vehicle owner did not permit or in fact know
that his or her car was being parked in violation of this ordinance.
The term "allow" shall be so construed so as to place an absolute duty
upon any vehicle owner to see that his or her vehicle is not parked in
the designated area.
Section 8. Any vehicle owner violating this ordinance shall be subject
to a fine not in excess of $50.00 and/or his or her vehicle may be temoved
by the Richmond Police Department pursuant to Ordinance No. 2678-1972
(Municipal Code Section 41.99) and impounded.
Section 9. 111.is.ord-_hyance shall be in full force and effect from and
after its passage, approval by the Mayor and publication as by law
required.
