HomeMy Public PortalAbout2778-1973 - Zoning - 4791 East Main St - C-2 to C-4ORDINANCE NO. 2778-1973 AN ORDINANCE AMENDING ORDINANCE NO.. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 1. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325- 1968 designates and describes as C-2 Community Business District the follow- ing described property located at 4791 East Main Street, in the City of Rich- mond, Indiana, more particularly described as follows: Being a part of the Southeast: Quarter of Section Thirty-five (35), Township Fourteen (14) North, Range One (1) West in the City of Richmond, Wayne County, Indiana, and being more particularly des- cribed as follows: Beginning at a point in the centerline of Old Highway Number Forty (40) (Cumberland Road) at the northwest corner of a tract of land owned by the Quadrangle Corporation and described in Deed Record 355, Page 640, in the Office of the Wayne County Recorder's Office, Wayne County, Indiana, said point being located by running from the southeast corner of said southeast quarter, north forty-seven (47) minutes east, along the east line of said Quarter, eight hundred fifteen and forty-two hundredths (815.42) feet to the centerline of said Highway and thence north seventy-four (74) degrees and fourteen (14) minutes west, along said centerline, one hundred ten and fifty- five hundredths (110.55) feet to said beginning point, and running thence south fifty-seven (57) minutes west, along the west line of said Quadrangle Corporation land, five hundred nineteen and forty hundredths (519.40) feet; thence south eighty (80) degrees and twelve (12) minutes west three hundred fifteen and one hundredth (315.01) feet to the east line of a tract of land owned by Dailey Construct- ion company as described in Deed Record 348 Page 62; thence north fifty-one (51) minutes east, along the east line of said Dailey tract, five hundred seventy-nine and ten hundredths (579.10) feet to the northeast corner of said Dailey tract and the south right -of -oay of existing United States Highway Number Forty (40);-thence north seventy-nine (79) degrees and fifty-five (55) minutes east (cord measuremeat and distance) along said south right-of-way , one hundred four feet and fifteen hundredths (104.15) feet to a point in Old Highway Forty's (40) south right-of-way and one hundred twenty-five feet (125) right of station ninety-nine (99) plus fifty (50) on State Highway Plans of F.A. Project No. 112, Section A; thence north eighteen (18) degrees and forty-one (41) minutes west on a line radial to the centerline of said existing Highway, eighty-two and eight hundredths (82.08) feet to the original north right-of-way of Old Highway Number Forty(40); thence south seventy-four (74) degrees and fourteen (14) minutes east, along said north right-of-way, two hundred forty-three and sixty-seven hundredths (243.67) feet; thence south fifty-seven (57) minutes west thirty-six and twenty-two hundredths (36.22) feet to the place of beginning, containing a total area of four and twenty-six hundredths (4.26) acres, SUBJECT TO an one hundred forty-seven thousandths acre (.147) easement granted to Richmond Power and Light and described in Deed Record 347 Page 258 and also subject to the right-of-way of Old Highway Number Forty (40) as located across the northeastly end of said tract and containing thirty-six hundredths (0.36) acres and being that part of the righ-of-way of Old Highway Forty (40) not acquired by the State of Indiana for right-of-way of existing Highway Forty (40). And also subject to a fifty (50) foot easement across the entire east side of the above described tract for use as in- gress and Cgreos to land south of the above tract. SECTION 2. WHEREAS, it is the intent and purpose hereof to change the zoning classification of the above described area from C-2 to C-4 to allow the con- struction and operation of a T.S.C. retail outlet. SECTION 3. WHEREAS, a stu% of this Ordinance was conducted by the Richmond City Plan Commission on the day of _, 1973, at which time remon- strances were heard from all parties interes ed in or affected by this Ordinance. Ordinance No. 2778-1973 Continued Page 2 SEC'T.ION 4. WHEREAS, the vote of the Richmond City Plan Conanission was 6 to n in favor of/opposition to recommending the passage of Ordinance No. 2778-1973. NOW THEREFORE: SECTION 5. It is hereby ordained that the zonin,; classification of the above described property be, and the same is hereby changed to C--4 General Business District, and that said property be regulated in accordance with the Zoning Or- dinance of the City of Richmond, Indiana, and all amendments thereto. SECTION h. This Ordinance sh;.i3 be in full force and effect from and after its passage and publication as by la-w required. SECTION 7.
