HomeMy Public PortalAbout07129 O R D I N A N C E NO. 7129 AN ORDINANCE, vacating a portion of a sewer easement in Lot 1 of Johnathan Benjamin Subdivision in St. Louis County, Missouri. WHEREAS, the owner of the subject property has agreed to grant to the District a suitable alternate easement, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The portion of the 10 foot (10') wide sewer easement described below is hereby vacated, to wit: Beginning at a Chisled Cross, said cross being the Northwest corner of Lot 1 of Johnathan Benjamin Subdivision as recorded in Plat Book 241, Page 82 of the St. Louis County Records; thence South 14o43'22" West a distance of 90.61 feet along the West line of Lot 1 and said West line of Lot 1 also being the Eastern Right-of-Way line of Lindbergh Boulevard a.k.a. U.S. Highway Route 67 (100 feet wide), to a point; said point being the intersection of the West line of said Lot 1 with the Northern line of a 10 foot wide sewer easement granted to The Metropolitan St. Louis Sewer District, as recorded in Book 7843, Page 2347 of the St. Louis County Records, and the True Point of Beginning; thence Southeastwardly along the Northern line of said 10 foot wide easement South 36o42'41" East a distance of 71.79 feet to a point; thence Eastwardly continuing along the Northern line of said 10 foot wide easement South 84o09'58" East a distance of 100.26 feet to a point, said point being the intersection of the Northern line of said 10 foot wide easement with the Northeastern line of said Lot 1 of Johnathan Benjamin Subdivision; thence Southwardly along said Northeastern lot line South 32o01'05" East a distance of 12.66 feet to a point, said point being the intersection of said Northeastern line of Lot 1 of Johnathan Benjamin Subdivision with the Southern line of said 10 foot wide easement; thence Westwardly along the Southern line of said 10 foot wide easement North 84o09'58" West a distance of 108.28 feet to a point; thence Southwestwardly continuing along the Southern line of said 10 foot wide easement South 53o17'20" West a distance of 41.05 feet to a point; thence Northwestwardly continuing along the Southern line of said 10 foot wide easement North 36o42'40" West a distance of 10.00 feet to a point; thence Northeastwardly continuing along the Southern line of said 10 foot wide easement North 53o17'20" East a distance of 38.00 feet to a point; thence Northwestwardly continuing along the Southern line of said 10 foot wide easement North 36o42'41" West a distance of 61.01 feet to a point, said point being the intersection of the Southern line of said 10 foot wide easement with the West line of said Lot 1; thence Northwardly along said West line of said Lot 1 also being the Eastern right-of-way line of said Lindbergh Boulevard a.k.a. U.S. Highway Route 67 (100 feet wide) North 14o43'22" East a distance of 12.79 feet to the true point of beginning of a portion of said 10 foot wide sewer easement as recorded in Book 7843, Page 2347 of the St. Louis County Records. The foregoing Ordinance was adopted May 13, 1987. -2-
