SUBJECT: Swanson Homes Concept Plan Review
1. DESCRIPTION OF REQUEST:
Swanson Homes has requested a Concept Plan for a future Single Family Sewered Development
on the Gorman Farm generally located south of Hackamore Road, north of Shawnee Woods
Road and immediately west of the Wild Meadows development. The property is zoned Rural
Residential Urban Reserve and is guided for the 2020-2040 MUSA.
2. SITE DESCRIPTION:
The site is 79.86 acres with the developer calculating buildable to be 54.14 acres. The developer
has noted that there is 13.79 acres of wetlands on the site. The property has been farmed for
quite some time and has some areas of rolling hills and a portion is an old -growth maple -
basswood forest. The city has reviewed the site details and notices that the developer doesn't
include the area for stormwater management (NURP Ponds) in the net density, which will
increase the net density number fairly significantly. The ponds are shown on the site map
however. Net density is derived from subtracting all of the areas that are dedicated right-of-way,
parks, open space and easement. The developer calculates the net site area as 66.07 acres and
unless the numbers are wrong, this number should reduce by the area of the stormwater
treatment. The developer believes the net density is 1.24 Units/Net Acre, staff believes it may be
up near 2 Units/Net Acre.
3. REVIEW:
Staff has had a chance to review the applicant's letter, concept site plan, example homes and has
the following comments:
A. The developer has stated that the request for the MUSA expansion is not immediate but
rather a part of the Comprehensive Plan update.
B. The units per acre calculation may be incorrect.
C. The Met Council requires an overall average of areas in the MUSA to be at least 3 units
per net acre and Medina is currently at 1.99 units per net acre. Areas that are lower than
3 units per net acre will have to be supplemented with areas guided for more than 3 units
per net acre elsewhere in the city.

D. The lack of tree removal for the site meets the city's intention for tree preservation with
the most amount of trees being removed to create roadway and entrance from Hackamore
Road.
E. The bordering neighborhoods to the east and west (north is the city of Corcoran,
anticipated sewered development by the year 2008) are of a similar residential land use
and the other adjacent properties are also in Urban Reserve.
F. The neighborhood park and trails connections to County Road 116 and Wild Meadows
are favorable to the city.
G. The good portion of the site outside of the wetland area (see staffs map) is in a 100-year
floodplain which is not identified on the developer's survey.
H. There are no overall apparent transportation issues for the site. The main entrance on Co.
Rd. 116 lines up with one of the entrances to Foxberry Farms and the other entrance
would be a new curb cut onto Hackamore.
I. The city of Medina's current Comprehensive Plan does show future city trails on both
County Road 116 and Hackamore Road.
4. RECOMMENDATION:
Staff recommends that the planning commission review this project strictly under the concept
plan rules, which is a non -binding review of the project. This will not be a public hearing, as
the City Council is still reviewing the ordinance amendment. The developer did submit
resident labels and the city therefore routed neighbors upon request within 350 feet of the
property. This review is to take up no longer than 30 minutes without a vote.

Claudia Kauma and Jeff Martin are requesting a variance from the 75' Iakeshore
setback for the proposed new home to be built at 2845 Lakeshore Avenue. The
new home would impose upon the lakeshore setback by two footings of the deck
only, an encroachment of 96 square feet. The owners propose to remove the
current non -conforming, structurally deficient house and replace it with a new
home that improves the conditions existing on the lot and enhances the character
of the neighborhood. In particular, the side yard setback on the west, currently at
approximately 3', would be improved to the required side yard setback, and the
lakeshore setback currently at 63', would be improved to 71.5'. Additionally, the
owners will be removing a significant amount of hardcover currently existing
inside the lakeshore setback.
Exceptional or extraordinary circumstances apply to the property and result from
lot size or shape topography or other circumstances over which the owners have
had no control: The Kauma/Martin lot is bisected by Lakeshore Avenue,
considerably reducing the buildable area of the lot. Losing the square footage of
the "back lot" diminishes the buildable area of this lot by 8% of the lot; a loss of
approximately 1,800 square feet of buildable area. Additionally, the curve of the
lakeshore at their lot makes the orientation of the building logically placed at a
slight angle so the view is out to the lake and not across the lawn of the neighbor
to the west.
The literal interpretation of the provisions of the Medina Zoning Ordinance would
deprive the applicant of rights commonly enjoyed by other properties in the same
district: The Kauma/Martin family is planning to remove a home that is non-
conforming by over 500 square feet and replace it with a modest home with one
corner of the deck over the lakeshore setback. Literal interpretation of the
ordinance would deprive the owner of the rights now enjoyed by the existing, but
structurally deficient home.
The special conditions or circumstances do not result from the actions of the
applicant: The conditions on this lot were in existence prior to the purchase of
this lot, and the current home was built prior to the adoption of the current
Medina Zoning Ordinance which makes it non -conforming.
Granting the variance will not confer on the applicant any special privileges: The
granting of this variance will not confer any special privileges as other homes in
the neighborhood, similar to the owner's existing home, encroach on the
lakeshore setback by more than a few square feet. Additionally, granting this
variance will reduce any privileges the owners currently have the benefit of by
reducing the non -conformities present on the lot.
The variance requested is the minimum variance which would alleviate the
hardship: The Kauma/Martin family is requesting only enough of the deck to be
over the setback so it can accommodate an average patio table and chairs. The
owner's are not requesting any other variances and are not requesting for
building mass to be over the setback.
The variance would not be materially detrimental to the purposes of the
Ordinance or to property in the same zone: The owners are choosing to remove
the inadequate, non -conforming building present and replace it with one that
reduces non -conformities, improves the character of the neighborhood beyond
the existing home, and utilizes more advanced stormwater runoff solutions. The
granting of this variance would be an improvement to the purposes of the
Ordinance and to property in the same zone.
The Kauma/Martins are committed to remaining good citizens of Medina and
appreciate your consideration of their request.

Dear Sarah,
We have reviewed the preliminary grading plan provided for the proposed improvements at 2845 Lakeshore Avenue. We
have the following comments with regards to engineering matters:
• The contour information for adjacent properties must be provided on the proposed grading plan. Currently, it is
shown only on the existing conditions plan.
• With the amount of proposed grading in close proximity to the lake, an erosion and sediment control plan
should be submitted for approval prior to grading activities.
• The proposed grading creates slopes greater than the maximum 3 horizontal to 1 vertical slope.
• If retaining walls are proposed in the future, walls over four feet in height or stepped walls that create an
effective slope greater than 2:1 require plans designed and signed by a structural engineer.
• The proposed grading does not match the east and west house elevation plans provided.
• The 985 contour near the proposed driveway does not tie into an existing 985 contour. There is currently not
enough information to determine if the proposed driveway will create a drainage problem.

1. Application Request
Jeff Martin and Claudia Kauma have requested a variance from the required 75-foot structure
setback from the ordinary high water level to allow construction of a new home and an attached
deck. The new construction would require a setback variance of 4 feet. The property is located
at 2845 Lakeshore Avenue.
2. Context
Level of Discretion in Decision Making
The City has a high level of discretion with a variance because the burden of proof is on the
applicant to show that they meet the standards in the ordinance.
Zoning and Land Use
The property is zoned UR (Urban Residential) and Guided UR (Urban Residential). The
surrounding properties are also all zoned and guided UR.
3. Analysis of Request
The property is adjacent to Lake Independence which is classified as a Recreation Development
Lake. The structure setback from Recreation Development Lakes in the Urban Residential
Zoning District is 75 feet from the ordinary high water level of the lake. The applicant is
proposing to tear down the existing home on the property and bring the existing non -
conformities into compliance with the setback requirements and also reduce the impervious
surface coverage within the setback area via construction of the new home. The overall
impervious surface coverage would increase with the proposed home construction by less than
1%. While the proposed new construction will improve a number of non -conformities it will
encroach into the 75-foot structure setback from the Lake Independence ordinary high water
level approximately 4 feet.

The Planning Commission must review the variance request with the standards outlined in
Section 825.45 of the Zoning Ordinance as follows:
1) Exceptional or extraordinary circumstances apply to the property which do not apply
generally to other properties in the same zone or vicinity, and result from lot size shape,
topography, or other circumstances over which the owner of property since enactment of the
Ordinance, have had no control.
The property is an existing lot of record and is bisected by Lakeshore Avenue. While the
roadway right-of-way and shoreland setbacks reduce the buildable area on the property, the
property is 22,000 square feet in size. The majority of the properties in this same vicinity are
much smaller, and many are less than the 9,000 square foot minimum lot size requirement.
2) The literal interpretation of the provisions of this Ordinance would deprive the applicant of
rights commonly enjoyed by other properties in the same district under the terms of this
Ordinance.
Literal interpretation of the Ordinance would not deprive the applicant from reasonable use of
the property.
3) That the special conditions or circumstances do not result from the actions of the applicant.
The conditions are self-created. It is the owner's desire for the size of the home and attached
deck that creates the hardship. The owner could reduce the size of the home or deck by 4 feet
and meet all ordinance requirements.
4) That granting of the variance requested will not confer on the applicant any special privilege
that is denied by this Ordinance to the owners of other lands, structures, or buildings in the
same district.
There have been many applicants who have received variances in the Lake Independence area in
recent years. However, these lots have typically been non -conforming in size in that they do not
meet the minimum lot size requirement and therefore the buildable area of the lot is much
smaller

S) The variance requested is the minimum variance which would alleviate the hardship.
The applicant is requesting a variance for 4 feet. As mentioned earlier, staff finds that there is no
hardship present. However, if the Planning Commission finds that a hardship exists, they must
review whether the proposed request is the minimum action necessary to alleviate the hardship.
Staff finds that a smaller deck could certainly be constructed.
6) The variance requested would not be materially detrimental to the purpose of this Ordinance
or to property in the same zone.
Staff finds that the proposed variance would not be detrimental to surrounding properties and
would be an improvement from the current conditions.
The applicants have supplied a hardship letter that has been attached for your review. City staff
reviewed the hardship letter along with the plans that were submitted but did not find that the
applicant met all of the criteria for granting variances. The City of Medina variance ordinance
specifically requires that all criteria be met in order for a variance to be granted.
4. Summary
Staff recommends denial of the variance from the required 75-foot structure setback from the
ordinary high water level for the property located at 2845 Lakeshore Avenue, based on staff s
finding that not all of the criteria for granting variances were met. However, after reviewing the
application the Planning Commission could find otherwise. In the event that the Planning
Commission recommends approval of the variance, staff recommends the Planning Commission
provide the findings of fact. Additionally, staff recommends that if the variance is approved, the
applicant shall work with City staff on a landscape plan and grading plan to implement shoreland
restoration and best management practices on the site. Also, staff recommends that the property
located in the shore impact zone, the 37.5 feet closest to the lake, must be kept in a natural state.
5. Recommendation
Staff recommends denial of the variance, based on the following findings:
1. Literal interpretation of the Ordinance would not deprive the applicant from reasonable use
of the property.
2. The conditions are self-created. It is the owner's desire for the size of the home and attached
deck that creates the hardship.
3. Exceptional or extraordinary circumstances do not apply to the property which do not apply
generally to other properties in the same zone or vicinity,
4. Approval of the variance requested will confer on the applicant a special privilege that is

Sec. 20-251. Scope.
In addition to all other standards required by section 20-232, the standards in this division shall
apply to conditional uses if they are to be located in agricultural or residential districts.

Sec. 20-252. Bed and breakfast establishments.
The following applies to bed and breakfast establishments:
(1) Two off-street parking spaces plus one additional space per rental room must be
provided.
(2) There shall be no more than one employee in addition to the residents.
(3) Establishment must be owner occupied.
(4) Not more than five rooms may be rented. All rooms must be located in the principal
dwelling except that one room may be located in a detached accessory structure.

Sec. 20-253. Cemetery.
The minimum lot size for a cemetery shall not be less than one acre.
(1) Headstone and markers shall be of natural stone.
(2) Maximum height of a headstone shall not exceed three feet in height above ground
level, two feet six inches in width and six inches in thickness. An apron of at least four
inches in width shall be placed around said marker or monument at a depth so as to
assure no settling or movement of the marker or monument, which shall be made of
concrete, which apron shall also be level with the surface of the ground, and which shall
be affixed to the marker so as to prevent grass, weeds, or other vegetation from growing
between the marker and apron.
(3) Installation of markers and monuments shall be provided adequate planking to
protect turf and shall remove materials, equipment and refuse immediately upon
completion of work.
(4) Ground water testing shall be done to determine high water table and springs

located on the site.
(5) Sufficient maintenance and perpetual care funds shall be in place.
(6) Cemetery hours shall be from sunrise to sunset.
(7) The site shall contain a minimum of ten parking spaces.
(8) Access to the cemetery shall be by means of a collector or arterial roadway.
(9) Mausoleums: maximum size/height 20 feet must maintain district setbacks.

Sec. 20-254. Churches.
(a) The following applies to churches located inside the Metropolitan Urban Services Area
(MUSA):
(1) The site shall be located on a collector or arterial roadway as identified in the
comprehensive plan or located so that access can be provided without conducting traffic
through residential concentration.
(2) The structure must be set back 50 feet from all property lines.
(3) Parking areas shall be set back 25 feet from streets and nonresidential property.
(4) No more than 70 percent of the site is to be covered with impervious surface and
the remainder is to be suitably landscaped in conformance with article XXV.
(b) In addition to the criteria in subsection (a), the following applies to churches located outside
the Metropolitan Urban Services Area:
The following must be provided for review:
a. Location of two drainfield sites.
b. Two soil borings on each drainfield site for a total of four soil borings.
c. No percolation tests for drainfield sites where the land slope is between zero
and 12 percent.
d. One percolation test per drainfield site where the land slope is between 13
and 25 percent.
e. Areas where the land slope exceeds 25 percent shall not be considered as a
potential soil treatment site.
f. The sewage treatment system must be in conformance with chapter 19,
article IV.
g. School and day care uses accessory to the church use are not permitted
unless approved by the city council.

Sec. 20-255. Commercial kennels, stables and riding academies.
The following applies to commercial kennels, stables and riding academies:
(1) The structure must be in compliance with chapter 5, article III.
(2) The site must be located on a collector street.

Sec. 8-16. Establishment; description.
The Chanhassen Pioneer Cemetery (also sometimes referred to as Chanhassen Cemetery), as
acquired by the city, by deed dated September 13, 1984, is established as a city cemetery and shall be
controlled, managed and operated as set forth in this article. The cemetery shall consist of the following
described tract of land in Carver County, Minnesota:
Commencing at a point on the quarter section line 239.25 feet east of the southwest
comer of the northwest quarter of section 15, township 116, range 23; thence north 330 feet to a
point; thence east 165 feet to a point; thence south 330 feet to a point on the quarter section
line; thence west 165 feet to the place of beginning.

Sec. 8-17. Rights reserved to city.
The city reserves the right to remove all monuments and all markers, flowers, plants, trees,
decorations or other similar things without liability to the owner whenever any of these objects becomes
unsafe or unsightly, or fails to meet the standards, rules or regulations of the cemetery as provided for
herein.

Sec. 8-18. Records and reports.
The city clerk shall be the actuary of the cemetery and shall, in addition to other records and
duties, keep a register of all interments and disinterments.

Sec. 8-19. Maintenance funds.
All income received by the city for grave or lot purchase price shall be receipted to the general
fund for the purpose of defraying the cost of caring for, maintaining and improving the cemetery lots;
expansion; or other cemetery purposes as determined by the city council.

Sec. 8-20. Transfer of lots.
No cemetery graves or lots may be sold, assigned, conveyed or otherwise disposed of, except
by will or operation of law, without the approval of the city. The city retains the first option to repurchase
a cemetery grave or lot at the price paid or then current price, whichever is lower. The city may use any
of its funds or any cemetery funds for such repurchase and may hold such grave or lot, or again sell
and convey the same.

(a) In addition to those standards provided herein, the city manager may from time to time
adopt regulations establishing standards and requirements regulating the type, location, size,
material, number, the manner of placement and installation, and removal of monument markers,
and plantings permitted with the city cemetery to the extent not established by this article, and
may prohibit the placement of new monuments.
(b) Every monument and marker shall be placed in the space as shown on the cemetery plat
or as directed by the city. No monument or marker shall be placed unless its location has been
approved by the city and the full purchase price of the grave has been paid.
(c) No monument or marker may be constructed of limestone, sandstone, wood, or other
materials which will not assure relative permanency.
(d) All markers or monuments shall be placed upon a suitable foundation and must be
structurally sound and properly secured to avoid endangering public safety, health and other
property. An apron of at least four inches in width shall be placed around said marker or
monument, which shall be made of concrete, which apron shall also be level with the surface of
the ground, and which shall be affixed to the marker so as to prevent grass, weeds, or other
vegetation from growing between the marker and apron.
(e) This section and regulations that may be established by the city council shall not affect
monuments or markers of plantings in existence as of April 15, 1985, except in those instances
where such monuments or markers or plantings have become unsafe.
(f) Only one monument or marker shall be allowed per grave.

Sec. 8-22. Foundations.
All monuments and markers shall be placed on foundations of solid masonry at a depth and size
so as to assure no settling or movement of the marker or monument.

Sec. 8-23. Installation of monuments or markers.
Persons engaging in placing monuments and markers shall provide adequate planking to
protect turf and shall remove materials, equipment and refuse immediately upon completion of work.
The lot owner, his heirs, successors or assigns are responsible for any failure to abide by this section
and shall pay for any and all charges or damages resulting. The lot owner, his heirs, successors or
assigns are also responsible for any and all damage resulting from injury or damage to the cemetery or
other lots during the excavation of the grave site or recovering thereof. Contractors and others engaged
in such work must notify the city before beginning the same. All work in the cemetery, of whatever kind,
must be carried on subject to the direction and control of the city. No monument or marker shall be
placed in the cemetery until authorization has been issued by the city.

Sec. 8-24. Vaults and mausoleums.
Above ground vaults and mausoleums are not permitted.

Sec. 8-25. Improvements.
Natural plants, shrubs and flowers in containers only may be placed on the cemetery lots. No

trees, vines, flowers, plants or shrubs may be planted, no fences erected, nor shall unnatural
flowers, shrubs or plants be placed on the cemetery lot. The city reserves the right to remove any tree,
shrub, vine, plant or flower which may become unsightly dangerous or not in keeping with the
landscaping design of the cemetery or this section. The foregoing prohibition shall not apply to the city.

Sec. 8-26. Hours open to public.
The cemetery will be open to visitors during the hours of sunrise to sunset. Permission to enter
at other times shall be secured from the city.

Sec. 8-27. Graves.
Each grave in the cemetery may contain the remains of up to two people, either one casket and
one cremation urn, or two cremation urns. However, only one monument or marker will be allowed per
grave.

A cemetery known as Hazelwood Cemetery has been established and is continued upon land
owned by the city as described as follows:
Parcel 1: Block 5, Secrest and Perm's Addition to Bayport, Washington County,
Minnesota, according to the plat thereof on file and of record in the Office of the County
Recorder of said Washington County, Minnesota.
Parcel 2: (Quit Claim Deed rec. in Book 169 of Deeds, pg. 2, Washington County
Recorders Office, Washington County, Minnesota)
All that part of the Southwest Quarter of the Southeast Quarter (SW 1/4 of SE 1/4) of
Section three (3), Township Twenty-nine (29) North, Range Twenty (20) West, described
as follows, to -wit: Beginning at a point on the south line thereof, said point being 103.95
feet west of the southeast corner thereof, and running thence north on a line parallel to
and 103.95 feet west of the east line thereof 340.00 feet; thence west on a line parallel
to the south line thereof 125 feet; thence south on a line parallelto the east line thereof
340 feet to the south line thereof; thence east along said south line 125 feet to the point
of beginning; containing .98 acre, more or less; the same to be used by said village for
cemetery purposes as an addition to its municipality owned cemetery.
A plat of the cemetery, as prepared by Barrett M. Stack, Surveyor, and placed on file in the office of the
city administrator, is hereby adopted as the official plat of the cemetery which shall be called the
Hazelwood Cemetery.

Sec. 24-2. Sale of lots.
The price of the cemetery lots and other services, as determined by council resolution, shall be
filed with the city administrator. Any person paying the price thus fixed for any lot shall be entitled to a
deed conveying the same executed by the mayor and the city administrator. The purchaser shall
expressly agree in the deed that the purchaser's rights are subject to such reasonable rules and
regulations as the council may adopt relative to the use of the cemetery.

Sec. 24-3. Handling of funds.
All money received from the sale of lots in the Hazelwood Cemetery shall be paid to the city
administrator, who shall give a receipt therefor. No deed to any cemetery lot shall be issued, nor shall
any services be performed until a receipt showing payment to the city administrator of the cost thereof
shall be exhibited to the person whose duty it is to give the deed or perform the services. All money
received from the sale of lots and for the performance of services shall be placed in the city's general
fund.

Sec. 24-4. Burial permits.
Before any interment shall be made in any cemetery in this city, a burial permit shall be obtained
from the local or state registrar or vital statistics. Within 36 hours after the death of any person in the
city, the undertaker or person having charge of the interment shall apply for the permit. This application
shall be accompanied by a death certificate as prescribed by the state board of health. No burial permit
shall be issued until the application and death certificate shall have been properly completed and
presented. The body of a deceased person shall not be brought in the city for burial unless
accompanied by a death certificate and permit for removal issued by the registrar of the registration
district wherein the death occurred.

Sec. 24-5. Superintendent of cemetery (city sexton) --Duties.
The city council shall appoint a superintendent who shall have control and management of the
cemetery and be responsible for its maintenance and improvement. The superintendent shall have
such powers and duties as are prescribed by law or by the city council.

Sec. 24-6. General regulations.
(a) No person may discharge any firearm or have possession of any firearm within the
cemetery grounds without the permission of the superintendent.
(b) No person may remove any object from any place in the cemetery or make any excavation
without the consent of the superintendent.
(c) No person may obstruct any drive or path in the cemetery or in any way injure, deface or
destroy any structure, grave, flower, tree or other thing in the cemetery.
(d) No person may drive any vehicle faster than a walk within the cemetery, nor drive over any
path or roadway not authorized by the superintendent.
(e) No person may disturb the quiet of the cemetery by noise or improper conduct of any kind.
(f) No person may enter or leave the cemetery except at the gates provided.
(g) No person may use the cemetery grounds or any road therein as a public thoroughfare, nor
drive any vehicle through the cemetery grounds except for purposes related to the cemetery.
(h) No child may be permitted within the cemetery unless in the control of an adult.
(i) No person may allow any animal to run at large in the cemetery.
(j) No person may loiter at any time, nor be in the cemetery without permission of the cemetery
superintendent at any time.
(k) The cemetery shall be open to visitors from:
April 1st through October 31st--8:00 a.m. to 9:00 p.m.
November 1st through March 31st-8:00 a.m. to 5:00 p.m.
(I) The city reserves the right to, refuse admission to the cemetery and to refuse the use of any
of the cemetery's facilities at any time to any person or persons.
(m) Caskets.
(1) All caskets must be encased in a permanent -type burial vault. Fiberglass vaults are
prohibited. Concrete vaults are required for cremains.

(2) Casket burials shall be positioned with the head of the casket lying on the west end
of the grave.
(n) Gravesite.
(1) A gravesite shall contain one casket burial.
(2) A gravesite may contain one casket burial and up to three cremations.
(3) A gravesite which does not have a casket burial may have up to four cremations.
(4) No more than four cremain urns shall be buried on one gravesite.
(5) All gravesites must have a headstone identifying the interred remains.
(6) Prior to commencing grave digging operations, a family member or family
representative must meet with the city staff at Hazelwood Cemetery to ensure the
location of the burial site for a family member is correct.
(7) All flower urns must be above ground "pole" type.
(8) All grass mowing, fertilizing and watering shall be done exclusively by the city's
designated personnel.
(9) No gravesite ground planting of trees, shrubs or flowers will be permitted. The city
reserves the right to remove any tree, shrub, vine, plant or flower which may become
unsightly, dangerous, or not in keeping with the landscape design of the cemetery. This
also includes the placing of vases or other containers for flowers at ground level.
(10) No artificial flowers shall be placed on the graves between April 1 and November
1.
(11) No person, other than the person regularly contracted by the city, shall open
graves unless requested to do so by a proper city authority.
(12) In addition to the regulations set forth above, a gravesite may contain one infant
casket vault combination burial no larger than 12 feet by 24 feet.
(o) Headstones.
(1) Headstones shall lie flat and be installed at the west (head) end of the gravesite at
ground level. Headstones shall not be encased in concrete. Headstones shall conform to
the following dimensions:
a. Double headstone --One foot by three feet.
b. Single headstone --One foot by two feet.
c. Baby headstone --Ten inches by 20 inches.
(2) The number of names permitted on headstones shall conform to the following:
a. Double headstone --Two names for casket burials and up to four names for
cremain burials.
b. Single headstone --One name for casket burials and up to two names for
cremain burials.
c. Baby headstone —One name for casket burials and up to two names for
cremain burials.
d. All names identified on the headstone must correspond to the individuals
buried in the gravesite on which the headstone is located.
(3) Headstones shall be read from the east. Gravesites with three or four cremains
shall have one additional headstone approximately in the middle of the gravesite listing
the identity of the cremains.
(4) The city requires a deposit for headstones. If a headstone is not properly installed
within 18 months after burial, the city may use the deposit to purchase and install a

headstone to identify the occupant of the gravesite. The city shall, from time to time,
establish the headstone deposit amount by resolution. The city will refund the deposit
upon proper installation of the headstone by the party who made the deposit.
(5) The city staff shall be responsible for marking the location of all headstones. In the
event a headstone is installed improperly, the lot owner shall be required to remove the
headstone and have it reinstalled to the city's specifications at the lot owner's expense.
(6) The city shall not be responsible for any damage to headstones.

Sec. 24-7. Penalty.
Any person violating any provision of this chapter is guilty of a misdemeanor and shall be
punished by a fine of not to exceed $700.00, and by imprisonment for a period not to exceed 90 days.

Section 240 — MUNICIPAL CEMETERY
240.01 Establishment of Cemete . A public cemetery has been established and is
continued upon land owned by the[City <<off., Mound' in the County of Hennepin, State of
Minnesota, and described as follows:
Commencing at the intersection of the West line of Government Lot No. 5, Section
22, Township 117, Range 24 with the North line of County Road 110; thence North
545 feet; thence East 468 feet; thence South to the North line of said County Road;
thence Westerly along the North line of said County Road to the beginning.
A plat of the cemetery has been placed on file in the office of the City Clerk and is hereby
adopted as the official plat of the cemetery that shall be designated the "Mound Cemetery". No
persons shall lay out or establish any cemetery or use any lot or land within the City for the
burial of the dead except in the Mound Union Cemetery or other tract of land duly designated
by Ordinance of the City as a cemetery.
240.05 Definitions.
Subd. 1. The terms "Lot" "Plot" or 'Burial Place" shall be used
interchangeably and shall apply with like effect to one or more than one adjoining
grave.
Subd. 2. The term "Interment" shall mean the permanent disposition of the
remains of the deceased person by entombment or burial.
Subd. 3. The term "Memorial" shall include a monument, tombstone, marker,
tablet or headstone for family or individual use.
Subd. 4. The terms "Approved Outside Container shall mean a burial vault of
material, construction and design approved by the City Manager.
240.10 Useof Lots. No lots shall be used for any purpose other than the burial of human
remains and the placing of appropriate memorials.
240.15 Purchase Payments Options. Upon payment in full of the purchase price of the lot,
the cemetery will issue a deed conveying the lot executed by the Mayor and the Manager, and
the deed shall be recorded in the records of the City. An interim receipt may be issued at that
time which may be exchanged for the completed deed that will be ready for delivery within 30
days. Lots may be purchased on a deferred payment contract. Such contract shall be signed
by the Purchaser and approved by the City Manager. This contract shall stipulate the amount
paid and the terms for payment of the balance. Deferred payments shall bear interest at the
rate of 6% per annum from the date of execution of the contract. Before a burial is permitted,
an amount equal to the actual space used plus the interment and disinterment charges must
be paid. No memorial may be installed on the lots purchased on deferred payments until the
full purchase price has been paid.
240.20 Sole Ownershp, No lots will be sold in joint ownership or common ownership. The title

Superintendent of the cemetery and he/she shall have control and management of the
cemetery and duties as are prescribed by State Law and by the City Council. He/She shall be
the Actuary of the cemetery, and shall keep a register of all interments and disinterments,
including the name, age, place of birth, residence, marital status, name and address of next
relative, cause of death and time of interment, disinterment and reinterment.
240.55 Cemetery Funds. A Cemetery Fund has heretofore been established and is continued.
All money received from the sale of lots and other services shall be paid to the City Manager,
who shall give a proper receipt therefor. No deed to any cemetery lot shall be issued nor shall
any services be performed until payment to the City Manager of the cost thereof shall be
made. All money received from the sale of lots and for the performance of services shall be
placed in the Cemetery Fund. Such Fund shall be used for maintenance and improvements
and for no other purpose. The City Treasurer shall keep an account of all receipts and
disbursements of money belonging to the Cemetery Fund and shall pay money out of the Fund
only on orders signed by the City Manager. Such order shall specify that the money shall be
paid from the Cemetery Fund.
240.60 Establishment of Rules and Regulations. The City Council shall from time to time
adopt by resolution, appropriate rules and regulations governing the rights and duties of
visitors, lot owners, and of cemetery personnel. The City personnel shall effect compliance
with said rules, but violations of any such rules adopted by resolution shall not constitute a
misdemeanor.
240.65 Burial Permits. Prior to any interment in the Mound Cemetery, a burial permit shall be
obtained from the Manager or his/her designee. This application for burial permit shall be
accompanied by a death certificate and statement showing the name, age, and last residence
of the deceased, the date, place, and cause of death, the intended place of burial and such
other information as required by the State Board of Health. No permit for burial shall be issued
until the application and death certificate have been properly completed and presented. The
interment permit shall be obtained from the City Manager after the burial permit has been
obtained. The body of a deceased person shall not be brought into the City of Mound for burial
unless accompanied by a death certificate and permit for removal issued by the City Health
Officer in the district wherein the death occurred.
240.70 Regulation of Interments.
Subd. 1. No Interment other than that of an immediate relative or heir of the lot
owner may be made in any lot without the written consent of the lot owner.
Subd. 2. All orders for interments in lots must be signed by the owner of the lot or
his/her legal representative. However, when this is impossible because such
person is absent from the immediate area, permission may be communicated to the
City by telephone or other electronic media.
Subd. 3. Lot owners shall not allow interments in their lots in return for a
remuneration of any kind.
Subd. 4. No interment of two or more bodies shall be made in one grave except in
the case of mother and child or two infants buried in one casket, and except that
where cremation has taken place, the ashes of either the husband or wife or a child

Subd. 1. Written permission of the lot owner and the next of kin of the decedent
shall be filed with the cemetery office, a permit from the City Manager or his/her
designee shall be secured and submitted, and the required fees paid before a
grave may be opened. These actions shall be completed two days in advance of
disinterment.
Subd. 2. Disinterments may be made in order to place the body in a larger or better
lot in the cemetery after there has been an exchange or purchase of lots for that
purpose. However, the body may not be removed from the cemetery without the
permission of the City Health Officer. A removal contrary to the expressed or
implied wish of the original lot owner is forbidden.
Subd. 3. All removals must be made by the Superintendent, his/her employees, or
his/her designees after the proper permits have been filed and the required fees
paid and a receipt issued.
Subd. 4. When the Coroner directs the disinterment for the purpose of holding an
inquest and has filed with the cemetery his/her signed authorization to release the
body to himself/herself and his/her lawful agents, the disinterment may be made. In
such cases, the disinterment must be made by the Coroner or his/her lawful
agents. No cemetery personnel will assist the Coroner or his/her agents in such
disinterment.
Subd. 5. The cemetery assumes no liability for damage to any casket or outside
container in making a removal. When, in the opinion of the Superintendent, a new
outside container is needed at the time of removal, it must be provided for by the
person arranging for the removal.
240.80 Maintenance and Care.
Subd. 1. The general care of the cemetery includes the cutting and sprinkling of the
grass at reasonable intervals, the raking and cleaning of the grounds, and the
pruning of shrubs and trees that may be placed by the cemetery, meaning and
intending the general preservation of the lots and grounds, walks, roadways,
boundaries and structures, to the end that said grounds shall remain and be
reasonably cared for as cemetery grounds forever. The general care shall in no
case mean the maintenance, repair or replacement of any memorial, structure
placed or erected upon lots; nor the doing of any special or unusual work in the
cemetery, including work caused by poor soil; nor does it mean the reconstruction
of any marble, granite, bronze or concrete work on any lot, or any portion or
portions thereof in the cemetery, caused by the elements, an act of God, common
enemy, thieves, vandals, strikers, malicious mischief makers, explosions,
unavoidable accidents, invasions, insurrections, riots, or by the order of any military
or civil authority, whether the damage be direct or collateral, other than as herein
provided.
Subd. 2. Lot owners desiring additional care of their lots may arrange for such care
with the cemetery office, which shall give an estimate of the cost of the work
desired. This may be provided for by annual payments made by the lot owner.

distance from said lot, the Council will, by resolution, designate the lot end for
marker placement.
Subd. 7. Markers conforming hereto may be used throughout the cemetery.
Monuments, tombstones, tablets or headstones shall not be used except in that
part of the cemetery described as lying within the limits of the City of Minnetrista.
240.90 Prohibited Acts. The following acts are prohibited within the cemetery, and the
commitment of such acts within the cemetery shall constitute a misdemeanor:
Subd. 1. Discharge of firearms or possession of firearms within the cemetery
grounds except a military escort accompanying a veteran's funeral or attending
memorial service.
Subd. 2. Picking of flowers, wild or cultivated, breaking or injuring of any tree,
shrub or plat, or writing upon, defacing or injuring any memorial, fence or other
structure within the cemetery grounds.
Subd. 3. Making of any excavation without the consent of the Superintendent.
Subd. 4. The obstruction of avenues, roads, walks, or alleys.
Subd. 5. Walking upon or across lots or lawns unless it is necessary to do so to
gain access to one's own lot or grave.
Subd. 6. Motor cars and vehicles travelling in excess of 15 miles per hour.
Subd. 7. Failure of a vehicle meeting a funeral procession to stop until the
procession passes.
Subd. 8. Passing by a vehicle of a funeral procession going in the same direction.
Subd. 9. Parking of a vehicle with the engine running.
Subd. 10. Failure to set the emergency brake of a parked vehicle.
Subd. 11. Driving of the motor vehicle or bicycle off the established roadway.
Subd. 12. Disturbing the quiet of the cemetery by noise or improper conduct of any
kind.
Subd. 13. Allowing any animal within the cemetery.
Subd. 14. Loitering or idling within or upon the cemetery grounds at any time, and
being in or upon the cemetery grounds without written permission of the cemetery
superintendent during the hours when the cemetery is closed.
Subd. 15. Depositing of rubbish or trash upon the drives, paths, or any part of the
grounds except the deposit of such into receptacles provided and designated for

further deliberation, the Council voted 4-1 to deny the conditional use permit, and
directed the City Attorney to prepare findings and this resolution as a contemporaneous
record of the'Council's decision,
NOW THEREFORE BE IT RESOLVED by the City Council of the City of
Roseville, Minnesota, that it adopts and memorializes the following findings regarding
the subject application for a conditional use permit:
Findings:
I Section 1004:02C10 of the Roseville Zoning code allows cemeteries as a
conditional use within the R-1, Single Family Residence District. Ordinance
1072 specifies that no cemetery, place of burial, or crematorium of the dead
human person shall be established or set apart, nor shall any existing
cemeteries or crematoriums be enlarged without a permit issued by the City
Council (City Code Section 401.01).
2. The issuance of a conditional use permit under Section 1013 of the Code
requires the consideration of the following matters;
Compatibility with adjoining properties
Impacts on traffic and public facilities
Impacts on property value
Impacts on general health, safety, and public welfare
Compatibility with the, Roseville Comprehensive Plan.
The proposed use will emit "criteria" pollutants and "toxic" pollutants
(Source: Materials submitted by applicant, All Crematory, Anne Jackson et
al.).
Emission of these toxic materials is not practically avoidable or controllable
under current cremation processes (Source: Environmental information from
Industrial Equipment and Engineering Co., 6/21/2001).
5. The emission of mercury, hydrogen chloride,, and other pollutants from the
proposed, crematory adds to the risk of exposure to these public health dangers
for the residents, businesses and users of public facilities in the vicinity of the
proposed crematory.
6. Currently, the cremation rate in the United States is approximately 24%.
Within the next 10 years it is anticipated that the demand for cremation
services will increase nearly 70% (Source: Letter of Erny Czirok dated June
29, 2001).
7. In Minnesota cremations have increased from 1,622 in 1969 to 10,950 in
1999, and Ramsey County statistics parallel the increased use of cremation
(Source: MN Department of Health, City Community Development Staff
Research, 6/14/01).
&. For 2000, the statewide cremation percentage was 30.30% or about 32 per day
(Source: fax from Timothy J. Koch dated 7/23/01).
9. Updated Federal and state standards regarding crematory emissions; location,
and operating procedures have not yet been promulgated to adequately
address the growing use of cremation, nor developments in medical science
such as brachytherapy that could introduce an additional environmental
health threat, in spite of the 1990 Federal Clean Air Act amendments that
require the Environmental Protection Agency to develop new source
performance standards and emission guidelines for crematories:
10. The required emission limits for acid gases (sulfur dioxide and hydrogen
chloride), particulate matter, opacity, metals (including cadmium, lead and
mercury), organics (dioxins and furans), carbon monoxide and nitrogen oxides
from crematories have not been established in part due to the limited
information available to environmental protection agencies (Source IEE
Co./All Crematory).
11. As submitted by the applicant, the proposed use would negatively affect the
character of the neighborhood due to the :nature of the proposed use, the
intensity of the proposed use, the proximity of residential properties, natural
resources, and public facilities abutting or in close, proximity to the subject
parcel; and the inability to fashion practical terms and conditions for the
proposed use to protect the general health, safetyand public welfare of the
neighborhood and community.
NOW IT THEREFORE BE IT FURTHER RESOLVED by the City Council of
the City of Roseville, Minnesota, that the application to issue a conditional use permit
to Roselawn Cemetery to allow the construction of crematory facility on property
located at 803 Larpenteur Avenue is: hereby denied.
The motion for the adoption of the foregoing resolution was duly seconded by
Council Member Maschka, and upon vote being taken thereon the following voted in
favor thereof: Mastel, Goedeke, Maschka, Kysylyczyn
and the following voted against the same: Klausing.
WHEREUPON said resolution was declared duly passed and adopted on the 27th
day of August, 2001.

An Ordinance Related to Home Occupations and Cemeteries;
Amending Section 826.98, Subdivision 2 (c) and (d).
The city council of the city of Medina ordains as follows:
SECTION I. Medina Code Section 826.98, subdivision 2 (c) and (d) is amended by
deleting the stricken material and adding the underlined material as follows:
Section 826.98. Conditional Use Permit Standards for Agricultural Preservation and
Residential Districts.
(c) home occupation (N.B. These standards are already contained in section

(i)
not more than one person not residing in the dwelling may be
employed on -site in the home occupation, regardless of the number
of hours worked by the individual;
(ii) no sales may occur which involve delivery of goods at the site no
over-the-counter retail sales;
(iii) only such signs as are permitted under section 815.09 of this
ordinance;
(iv) no outside storage;
(v) the home occupation must be conducted solely within the principal
structure;
(vi) limited customer, client, patient or student visits to the site in
connection with the home occupation limited by conditional use
permit;
(vii) there must be adequate off-street parking for the anticipated
number of persons on the site at any one time and the parking area
must be screened from view from adjacent properties or rights -of -
way;
(viii) limited deliveries associated with the home occupation in
commercial vehicles over one ton capacity limited by conditional
use permit;
(ix) no equipment or devices not customarily used in residential
dwellings may be used in connection with the home occupation;
(x) entrance to the space used for the home occupation must be within
the dwelling;
(xi) no interior or exterior alterations may be made to the dwelling to
accommodate the home occupation except as may be customarily
found in a dwelling;
(xii) any vehicle displaying the name of the home occupation must be
parked in an enclosed garage or in an area screened from view
from adjacent properties or rights -of -way;
(xiii) the home occupation may not produce any light, glare, noise or
vibration perceptible beyond the boundaries of the property which
is not customarily associated with residential use;
(xiv) no exterior bells or loudspeakers;
(-x-v}(xiv) hours of business activity may be limited by the city
council to protect the public health, safety and welfare;
OM) (xv) the home occupation must be operated in compliance with
all other applicable federal, state and local statutes,
ordinances, codes and regulations; and
(xvi) the city council may require compliance with any other
conditions, restrictions or limitations it deems to be
reasonably necessary to protect the residential character of
the neighborhood.
Subd. 2. Specific Standards.
(d) cemeteries:
(i) minimum lot area of ten acres;
(ii) located with direct access to a collector or arterial roadway as
identified in the comprehensive plan;
(iii) all roadways within the cemetery must be at least twenty-four feet
wide.
(iv) direct views from all adjoining residential parcels must be screened
by appropriate means;
(v) buildings, parking areas and upright grave markers set back a
minimum of 50 feet from all property lines;
(vi) established and operated in compliance with the requirements of
Minnesota Statutes, Chapters 306 or 307, as amended; and
(vii) a site plan acceptable to the city council must be submitted and
reviewed under the citv's site plan ordinance;
(viii) a master plan for the build -out of the property must be submitted
and approved by the city council which includes: the number and
location of all burial lots; the phasing of selling/filling the burial
lots; the assigned numbers for the burial lots; descriptions and
locations of any other improvements to be located on the property;
and a description of the cemetery's records retention system;
(ix) the city council may require a transportation plan that includes
traffic management for burials, funerals and burial site visit;
a) the city council may require an environmental assessment of the
proposed use; and
(xi) the city council may require compliance with any other conditions,
restrictions or limitations it deems to be reasonably necessary to
protect the residential character of the neighborhood.
SECTION II. This ordinance shall become effective upon its adoption and publication.

Cemeteries
Introduction
All cemeteries are public cemeteries and governed by Minnesota Statutes Chapter 306
unless they are established by religious corporations. If a cemetery is established by a religious
corporation, it is considered to be a private cemetery and is governed by Minnesota Statutes
Chapter 307.
Public Cemeteries, Minnesota Statutes Chapter 306
The following are the provisions in Minnesota Statutes Chapter 306 that the city should
be aware of with respect to public cemeteries:
1. Section 306.025. A public cemetery association may transfer a cemetery to a city
in which the cemetery is wholly or partially located together with the funds and
property of the cemetery association. The city is not required to accept this
transfer. If it accepts the transfer, the city is required continue to operate,
maintain and manage the cemetery. It may continue to sell lots and provide for
the burial of the dead.
2. Section 306.03. A public cemetery is required to annually appoint an actuary
who keeps a register of burials in the cemetery (the register must have the date of
the burial, entombment or cremation and the name, age, sex, nativity and cause of
death of every person interred or cremated). This record must be open to public
inspection.

3. Section 306.05. A public cemetery corporation may own a maximum of 300
acres of land to be used and occupied exclusively for the burial or cremation of
the dead and for other purposes necessary for these purposes. The land must be
surveyed and divided into lots of a size determined by the trustees of the cemetery
with the avenues, alleys and walks that they consider proper. A map of the survey
must be filed with the County Recorder.
4. Section 306.09. After a map of the survey is filed with the County Recorder, the
trustees of the cemetery may sell and convey the lots that were designated on the
map upon terms and conditions that they determine Every conveyance of a lot
must be expressly for burial purposes.
5. Section 306.14. The lands and property of a cemetery association are exempt
from all public taxes and assessments. The owners of the cemetery lots may hold
the lots exempt from taxation so long as the lots are used for a cemetery.
Cemetery property is not exempt from special assessments, however. If the
cemetery association was formed for the purpose of pecuniary gain to its members
and it pays dividends or other remuneration to these members, it may be specially
assessed. No road or street can be laid through the cemetery without the consent
of the cemetery trustees.
6. Section 306.18. The cemetery association must leave sufficient passage to and
from any grave in the cemetery either by dedicated streets or alleys in the
cemetery or by leaving unused a part of the cemetery sufficient for that purpose.
7. Section 306.246. A city may disburse funds for the general maintenance of
abandoned or neglected cemeteries.
8. Section 306.29. Every cemetery association (including private cemeteries) must
keep a record of all deeds, conveyances, judgments, decrees or other documents
affecting the title to the lots in the cemetery.
9. Section 306.41. A city may establish a care and improvement fund for a
cemetery that it is maintaining.
10. Section 306.65. A cemetery that maintains a cemetery of more than 80 acres in a
city that has a population of more than 50,000 is required to file a plat showing
the area and location of the cemetery with the county recorder.
11. Section 306.76. Every cemetery association that maintains or is adjacent to a city
with a population of more than 50,000 must provide for the establishment of a
permanent care, maintenance and improvement fund for the cemetery.
12. Section 306.99. A city must allow the cemetery to perform burials during all
times of the year, including winter.

Private Cemeteries, Minnesota Statutes Chapter 307
The following are the provisions in Minnesota Statutes Chapter 307 that the city should
be aware of with respect to private cemeteries:
1. Section 307.01. A private cemetery must be surveyed and a plat made of it. A
stone or other monument must be established to mark one corner of the cemetery
and the monument's location must be designated on the plat. The plat must be
certified by the surveyor and filed with the county recorder. The cemetery may
subdivide or rearrange the lots as needed but no plat can interfere with the rights
and privileges of the existing lot owners without their consent. The new plat does
not need to be filed with the county recorder, but a copy of it must be kept for
public inspection at the cemetery. Markers must be placed at the corner of each
lot of the subdivision or rearrangement.
2. Section 307.02. Every conveyance of lots by a private cemetery must be for
burial purposes and the lands designated on the plat as streets, alleys, ways,
commons or other public uses shall be held by the owner of the cemetery in trust
for those uses.
3. Section 307.08. All human burials and human skeletal remains must be accorded
equal treatment and respect for human dignity without reference to their ethnic
origins, cultural backgrounds or religious affiliations. This provision applies to
all human burials or human skeletal remains found in all public or private lands or
waters in Minnesota. A person who intentionally destroys, mutilates, disturbs or
removes human skeletal remains is guilty of a felony. A person who removes any
monument or structure placed in any private or public cemetery or discharges any
firearms over the grounds of any public or private cemetery is guilty of a gross
misdemeanor.
4. Section 307.09. The lands and property of a cemetery association are exempt
from all public taxes and assessments. The owners of the cemetery lots may hold
the lots exempt from taxation so long as the lots are used for a cemetery.

Planning staff has researched several city's ordinances with respect to cemeteries and
has attached this information for your review. Please also see the attachments with
pictures of the types of burial options, pictures of an example cemetery flat and raised
monuments as well as the memo from legal about the State Statutes 306 and 307
regarding cemeteries.
ADDITIONAL ORDINANCE CONSIDERATIONS
In reading several city codes with respect to cemeteries, planning staff has the following
information to offer:
1. All markers placed shall be of bronze or natural stone
2. Maximum height of any structure shall be 30 feet
3. Perimeter shall be fenced and boundaries marked
4. Perimeter adjacent to any residentially -zoned property shall be adequately
screened with natural vegetation
5. No grave site shall be within 20 feet of any residentially -zoned property and not
within 10 fee of any other zoned property
6. Areas for each type of burial shall be depicted on the site plan or plat
7. Consider adding a "Prohibited Acts" section
8. Consider conditions for an on -site cremation facility
COMMON TERMS
Entombment is above ground burial. The casket is placed in a crypt behind a marble
facia.
A Crypt is a vault in which caskets are placed.
There are four types of crypts offered at the Salt Lake Mausoleum: indoor single, indoor
couch, indoor companion, indoor cradle (baby) and garden single.
A Family Room consists of a room enclosed by a gate in which are located five crypts.

A Niche is a vault where the urn is placed.
An Urn is a receptacle for cremated remains.
Cremation is a process in which heat (1700° celsius) is used to reduce a human body
to a basic mineral composition.
RECOMMENDATION
Staff recommends further discussion and a recommendation to the city council, as the
application must go before the planning commission in September to meet the land use
deadlines of the project.

307.01 Plat and record.
Any private person and any religious corporation may
establish a cemetery on the per.,on s or corporation's own land
n the following manner: The land shall be surveyed and a plat
thereof made. A stone or other monument shall be established to
mark one corner of such cemetery, and its location shall be
designated on the plat. The plat and the correctness thereof
shall be certified by the surveyor, whose certificate shall be
endorsed thereon, and with such endorsement shall be filed for
record with the county recorder in the county where the cemetery
is located, showing the area and location of the cemetery. Any
person or association owning such private cemetery may subdivide
or rearrange the from time to time, as may be necessary in
the conduct of the business, but no plat of such subdivision or
rearrangement shall interfere with the rights and privileges of
the several lot owners of such cemetery without their consent,
nor need same be filed in the office of the county recorder;
provided, that a plat of the same shall be kept for public
inspection at such cemetery; and, provided, further, that there
shall be placed at the corner of each lot of such subdivision or
rearrangement cement or other nondestructible markers three
inches or more in diameter and eight inches or more in length,
one of such markers showing the number of the lot.

307.02 affect of recorded plat.
When such plat has been recorded, every donation or grant
of lands therein to the public, to any religious corporation, or
to any individual, shall be deemed a conveyance of such lands,
subject to the conditions and restrictions, if any, contained
therein. Every conveyance of such lots shall be expressly for
burial purposes, and the lands designated on the plat as
streets, alleys, ways, commons, or other public uses shall be
held by the owner of the cemetery in trust for the uses and
purposes thereon indicated.
