AN ORDINANCE CREATING THE POSITION OF DIRECTOR OF TRANSPORTATION
AND AUTHORIZING THE APPOINTMENT OF THE SAID DIRECTOR BY THE BOARD
OF PUBLIC WORKS AND SAFETY.
WHEREAS, the City of Richmond, Indiana, has the "power to establish,
construct, maintain and control public ways which shall
include but not be limited to streets, thoroughfares,
walkways, roads, bridges, tunnels, sidewalks and alleys", and
WHEREAS, the Board of Public Works and Safety has the power to
maintain or improve any streets, alleys or other public
places �rithin the City, and
WHEREAS, the Board of Public Works and Safety has the power to
manage and control any public transportation system
in the City, and
WHEREAS, the Board of Public Works and Safety has the charge.of
all property, real and personal, belonging to the City
of Richmond, Indiana, and the care of same, and further
the authority to repair any property, real or personal,
belonging to or used by the City, and
WHEREAS, the Board of Public Works and Safety has the power to
direct the removal of any or all structures in the
streets, alleys or public places of said city and remove
the same, at the expense of the person maintaining the same,
on their failure to make such removal, and
WHEREAS, every city and town shall have the exclusive power, by
ordinance, to control and care for its streets, alleys
and other public places, and to prevent the obstruction
or encumbrance of any street, alley or other public place,
so as not to impede the free use of the same for its proper
purposes, and to prevent any person from going upon any
sidewalk with any vehicle or animal, except in the necessary
act of crossing, and
WHEREAS, cities have the authority to regulate, license and prohibit
the use of public ways by any vehicle, device or machine that
transports persons, animals or property, and
WHEREAS, cities have any poi�er or may perform any function necessary
in the public interest in the conduct of its municipal
or internal affairs, which is not prohibited by the Constitu-
tion of this state or the Constitution of the United States,
and which is not specifically denied or pre-empted by law
(Acts 1971, P.L. 250, Section 1, p. 955),
NOW THEREFORE, Be it Ordained by the Common Council of the City of
Richmond, Indiana, that:
Section 1. There is hereby created the position of Director
of Transportation, said Director to be appointed by and serve
at the pleasure of the Board of Public Works and Safety.
Section 2. The powers of the Director of Transportation shall
be to plan, make policy, and advise the Board of Public Works
and Safety upon the following matters:
A. Maintenance and rerai.r of the public ways
B. Operation and maintenance of the City bus fleet
C. Maintenance and operation of all public parking facilities
D. Maintenance and repair of all vehicles assigned to the
street division, bus lines and other city departments
E. The control over all vehicles impounded under state laws
and ordinances of the City of Richmond, Indiana, and the
disposition of same in accordance with state and local law.
And to perform day to day to functions in the aforementioned
five areas not requiring action of the Board of Public Works
a. Safety.
Section 3. Nothing herein shall be deemed to limit any of the
powers of the Board of Public Works and Safety as conferred by law.
Section 4. This ordinance shall be in full force and effect
from and after the day of its passage and approval by the Mayor
PASSED AND ADOPTED by the Common Council of the City of Richmond,
Indiana, this j% day of 1973.
