HomeMy Public PortalAbout07212 O R D I N A N C E NO. 7212 AN ORDINANCE, vacating portions of sewer easements in Davis Estates, Inc. in the City of Clayton, in St. Louis County, Missouri, WHEREAS, the owner of the subject property has granted to the District suitable alternate easements, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The following described portions of sewer easements are hereby vacated, to wit: Five parcels of land located in Davis Estates, Inc. as recorded in Plat Book 32 Page 27 of the St. Louis County Records. Parcel A - The Northern portion of a ten foot wide (10') easement one hundred fifty feet (150') West of and parallel to Brentwood Boulevard being one hundred forty feet (140') South of Maryland Avenue and continuing South one hundred sixty feet (160') and more particularly described as follows: Commencing at the intersection of the West line of Brentwood Boulevard with the South line of Maryland Avenue; thence South 6 degrees 32 minutes West, a distance of one hundred forty feet (140') to a point on the South line of a twenty foot (20') easement; thence North 76 degrees 22 minutes West, a distance of one hundred fifty feet (150') to the point of beginning; thence South 6 degrees 32 minutes West, a distance of one hundred sixty feet (160') to a point; thence North 83 degrees 28 minutes West, a distance of ten feet (10') to a point; thence North 6 degrees 32 minutes East, a distance of one hundred forty-eight feet (148') to a point; thence North 40 degrees 00 minutes West, a distance of twenty-three feet (23') to a point on the South line of an existing twenty foot (20') easement; thence South 76 degrees 22 minutes East, a distance of twenty-five feet (25') to the point of beginning. Parcel B - The Western portion of a sixty foot (60') wide sewer easement, commencing at the South right-of-way line of Maryland Avenue eighty feet (80') wide and continuing South one hundred forty feet (140') and more particularly described as follows: Commencing at the intersection of the West right-of-way line of Brentwood Boulevard with the South right-of-way line of Maryland Avenue eighty feet (80') wide; thence North 76 degrees 22 minutes West, a distance of two hundred forty-five 2 feet (245') along said South line of Maryland Avenue to the point of beginning; thence South 13 degrees 38 minutes West, a distance of one hundred forty-four feet (144') to a point; thence North 76 degrees 22 minutes West, a distance of twenty-seven feet (27') to a point on the West line of said sixty foot (60') wide easement; thence along said West line North 6 degrees 32 minutes East, a distance of one hundred forty-one feet (141') to a point on the South right-of-way of Maryland Avenue; thence along said South line of Maryland Avenue South 76 degrees 22 minutes East, a distance of forty-four and 50/100 feet (44.50') to the point of beginning. Parcel C - The Western two hundred seventy-five feet (275') of a twenty foot (20') wide sewer easement, being that portion of said twenty foot (20') wide easement one hundred twenty feet (120') South and paralleling Maryland Avenue from the East right-of-way line of Forsyth Boulevard to the West edge of a sixty foot (60') wide sewer easement and more particularly described as follows: Commencing at the intersection of the West right-of-way line of Brentwood Boulevard with the South line of Maryland Avenue eighty feet (80') wide; thence North 76 degrees 22 minutes West, a distance of two hundred forty-five feet (245') to a point; thence South 13 degrees 38 minutes West, a distance of one hundred forty feet (140') to a point; thence North 76 degrees 22 minutes West, a distance of twenty-seven feet (27') to a point on the West edge of a sixty foot (60') sewer easement (North-South) and the South edge of a twenty foot (20') sewer easement (East-West) said point being the point of beginning; thence North 76 degrees 22 minutes West, a distance of two hundred sixty-seven and 11/100 feet (267.11') to a point on the East right-of-way of Forsyth Boulevard; thence North 12 degrees 09 minutes West, a distance of twenty-two and 22/100 feet (22.22') along the said East line of Forsyth Boulevard; thence South 76 degrees 22 minutes East, a distance of two hundred seventy-five feet (275') along the North edge of said twenty foot (20') wide easement to the West edge of the sixty foot (60') wide sewer easement; thence South 6 degrees 32 minutes West a distance of twenty and 16/100 feet (20.16') to the point of beginning. Parcel D - A twenty foot (20') wide sewer easement, being that portion one hundred feet (100') East of and paralleling Forsyth Boulevard, also starting approximately one hundred forty feet (140') South of Maryland Avenue and continuing South approximately one hundred eighty feet (180') being more particularly described as follows: Commencing at the intersection of the West right-of-way line of Brentwood Boulevard with the South line of Maryland Avenue eighty feet (80') wide thence North 76 degrees 22 minutes West, a distance of two hundred forty-five feet (245') to a point; 3 thence South 13 degrees 38 minutes West, a distance of one hundred forty feet (140') to a point; thence North 76 degrees 22 minutes West, a distance of twenty-seven feet (27') to a point on the West edge of a sixty foot (60') sewer easement (North-South) and the South edge of a twenty foot (20') sewer easement (East-West); thence North 76 degrees 22 minutes West, a distance of one hundred thirty two and 85/100 feet (132.85') to the point of beginning; thence South 01 degrees 31 minutes East, a distance of one hundred twenty-five and 65/100 feet (125.65') to a point; thence South 28 degrees 00 minutes East, a distance of eighty-five feet (85') to a point on a curve; thence in a Northern direction along a curve to the right an arc distance of forty-three and 16/100 feet (43.16') to a point; thence South 60 degrees 57 minutes 34 seconds West, a distance of nine feet (9') to a point; thence North 28 degrees 00 minutes West, a distance of fifty-two feet (52') to a point; thence North 01 degrees 31 minutes West, a distance of one hundred thirty-three feet (133') to a point; thence South 76 degrees 22 minutes East, a distance of twenty and 72/100 feet (20.72') to the point of beginning. Parcel E - A ten foot (10') wide sewer easement, being that portion one hundred twenty feet (120') East of and paralleling Forsyth Boulevard, also starting approximately one hundred forty feet (140') South of Maryland Avenue and continuing South approximately one hundred eighty feet (180') being more particularly described as follows: Commencing at the intersection of the West right-of-way line of Brentwood Boulevard with the South line of Maryland Avenue eighty feet (80') wide; thence North 76 degrees 22 minutes West, a distance of two hundred forty-five feet (245') to a point; thence South 13 degrees 38 minutes West, a distance of one hundred forty feet (140') to a point; thence North 76 degrees 22 minutes West, a distance of twenty-seven feet (27') to a point on the West edge of a sixty foot (60') sewer easement (North-South) and the South edge of a twenty foot (20') sewer easement (East-West); thence North 76 degrees 22 minutes West, a distance of one hundred twenty-five feet (125') to a point on the East line of a ten foot (10') wide easement recorded in Book 3563, Page 321 of the St. Louis County Records; thence along the East side of said ten foot (10') easement South 01 degrees 31 minutes East, a distance of one hundred forty-three feet (143') to a point; thence North 28 degrees 00 minutes West, a distance of twenty-five feet (25') to a point; thence North 01 degrees 31 minutes West, a distance of one hundred twenty-nine and 21/100 feet (129.21') to a point; thence South 76 degrees 22 minutes East, a distance of ten and 36/100 feet (10.36') to the point of beginning. 4 The foregoing Ordinance was adopted July 16, 1987.
