HomeMy Public PortalAbout07260 O R D I N A N C E NO. 7260 AN ORDINANCE, vacating portions of easements and vacating any right, title or interest of the District in Roads and Road easements in Township 47 North, Range 6 East in St. Louis County, Missouri, WHEREAS, the owner of the subject property has agreed to grant to the District suitable alternate easements, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District hereby vacates any right, title, or interest that it may have in the following described easements and Roads and Road easements. Four parcels of land located in Township 47 North, Range 6 East, St. Louis County, Missouri. Parcel 1 being a twenty foot (20') wide Public Road in part of Lot 2 of the Partition of the Stanton Home Estate, in U.S. Survey 405, Township 47 North, Range 6 East recorded in Book 7, Page 535 of the St. Louis County Records. Parcel 2 being a fifteen foot (15') wide easement being part of Lot 1 of the subdivision of the estate of Sarah Blackburn, Lot 3 of the John Hyatt Estate Partition, Lots 1 and 2 of the Partition of Stanton Hume Estate, in U.S. Survey 405 and 103, Township 47 North, Range 6 East as recorded in Plat Book 211, Page 36 of the St. Louis County Records. Parcel 3 being a perpetual Road Easement and Right-of-Way being part of Lot 3 of the John Hyatt Estate Partition, Lot 1 of the subdivision of the Estate of Sarah Blackburn, in U.S. Surveys 405 and 103, Township 47 North Range 6 East, as recorded in Book 6522, Page 388 of the St. Louis County Records. Parcel 4 being a twenty foot (20') wide Public 2 Road being part of Lot 1 of the Subdivision of the Estate of Sarah Blackburn, in U.S. Survey 103, Township 47 North, Range 6 East, as surveyed August 22, 1868. Parcel 1 - Beginning at the most Northern corner of property conveyed to B.P.O.E. United States of America by deed as recorded in Book 7600, Page 432 of the St. Louis County Records, said point being also in the Southwest line of U.S. Survey 405, thence Northeastwardly along the Northwest line of Lots 1 and 2 of John Hyatt Estate Partition North 37 degrees 52 minutes 00 seconds East 1250.90 feet to a point; thence North 53 degrees 11 minutes 28 seconds West 20.00 feet to a point; thence South 37 degrees 52 minutes 00 seconds West 1250.90 feet to the aforesaid Southwest line of U.S. Survey 405; thence Southeastwardly along said Southwest line of U.S. Survey 405 South 53 degrees 11 minutes 28 seconds East 20.00 feet to the point of beginning. Parcel 2 - Beginning at the intersection of the Northwest line of "Sacre Couer Estates Plat 1", a subdivision according to the plat thereof recorded as Daily No. 442 on March 21, 1986, being also the Southeast line of property conveyed to Webster College by deed as recorded in Book 7958, Page 2400 of the St. Louis County Records with the Southwest line of Old Halls Ferry Road, 40 feet wide; thence Southwestwardly along the said Northwest line of "Sacre Couer Estate Plat 1" South 36 degrees 37 minutes 54 seconds West 15.00 feet to a point; thence North 53 degrees 18 minutes 03 seconds West 879.66 feet to a point in the Southeast line of aforesaid Lot 1 of the Subdivision of the Estate of Sarah Blackburn; thence Southwestwardly along said Southeast line of Lot 1 of the Subdivision of the Estate of Sarah Blackburn South 36 degrees 37 minutes 59 seconds West 5.00 feet; thence leaving said Southeast line North 53 degrees 28 minutes 59 seconds West 1746.86 feet to the line dividing U.S. Surveys 103 and 405; thence leaving said dividing line North 53 degrees 00 minutes 44 seconds West 3860.36 feet to a point; thence South 37 degrees 51 minutes 47 seconds West 418.24 feet to a point; thence North 52 degrees 32 minutes 00 seconds West 882.32 feet to a point; thence South 38 degrees 14 minutes 00 seconds West 208.70 feet to a point; thence North 52 degrees 32 minutes 00 seconds West 223.70 feet to a point in the Southeast line of Shackelford Road, 40 feet wide; thence Northeastwardly along the said Southeast line of Shackelford Road, 40 feet wide, North 38 degrees 14 minutes 00 seconds East 15.00 feet to the most Western corner of property conveyed to John R. Grueninger by 3 deed as recorded in Book 5325, Page 204 of the St. Louis County Records; thence Southeastwardly and Northeastwardly along the Southwest and Southeast lines of said John R. Grueninger property South 52 degrees 32 minutes 00 seconds East 208.70 feet and North 38 degrees 14 minutes 00 seconds East 208.70 feet to a point in the Southwest line of "Plat One of Shepard Subdivision", a subdivision according to the plat thereof recorded as Daily No. 431 on June 27, 1977 in the St. Louis County Records; thence Southeastwardly along the said Southwest line of "Plat One of Shepard Subdivision" South 52 degrees 32 minutes 00 seconds East 882.22 feet to the most Southern corner thereof; thence Northeastwardly along the Southeast line of said "Plat One of Shepard Subdivision" and the Southeast line of "Shepard Subdivision Plat Two", a subdivision according to the plat thereof recorded as Daily No. 165 on April 14, 1986 in the St. Louis County Records North 37 degrees 51 minutes 47 seconds East 418.12 feet to a point; thence South 53 degrees 00 minutes 44 seconds East 3875.07 feet to a point in the line dividing U.S. Surveys 405 and 103; thence leaving said dividing line South 53 degrees 28 minutes 59 seconds East 1746.83 feet to a point in the aforesaid Southeast line of Lot 1 of the Subdivision of the Estate of Sarah Blackburn; thence Northeastwardly along said Southeast line North 36 degrees 37 minutes 59 seconds East 5.00 feet to a point in the aforesaid Southwest line of Old Halls Ferry Road, 40 feet wide; thence Southeastwardly along the said Southwest line of Old Halls Ferry Road, 40 feet wide, South 53 degrees 18 minutes 03 seconds East 879.66 feet to the point of beginning. Parcel 3 - Commencing at the most Western corner of property conveyed to Laclede Gas Company by deed recorded in book 6365, Page 1499 of the St. Louis County Records; thence in a Northwestwardly direction in a direct prolongation of the Southwest line of said Laclede Gas Company tract North 53 degrees 00 minutes 59 seconds West 50.00 feet to the actual point of beginning; thence South 36 degrees 59 minutes 01 second West 160.99 feet to a point; thence along a curve to the left whose radius point bears South 53 degrees 00 minutes 59 seconds East 25.00 feet from the last mentioned point, a distance of 39.26 feet to a point; thence South 52 degrees 59 minutes 39 seconds East 260.64 feet to a point in the line dividing U.S. Surveys 405 and 103; thence leaving said dividing line South 53 degrees 28 minutes 59 seconds East 1711.69 feet to a point in the Northwest line of property conveyed to Laclede Gas Company by deed recorded in Book 6289, Page 2021 of the St. Louis County Records; thence Southwestwardly and Southeastwardly along the Northwest and Southwest lines of said Laclede Gas 4 Company property South 36 degrees 37 minutes 59 seconds West 44.89 feet and South 53 degrees 18 minutes 03 seconds East 15.00 feet to a point; thence Northeastwardly along the Southeast line of said Laclede Gas Company property North 36 degrees 37 minutes 59 seconds East 44.94 feet to a point; thence South 53 degrees 28 minutes 59 seconds East 20.00 feet to a point in the Southeast line of aforesaid Lot 1 of the Subdivision of the Estate of Sarah Blackburn, said point being also in the Northwest line of property conveyed to Alfred L. Keevan and wife by deed as recorded in Book 6303, Page 1400 of the St. Louis County Records; thence Southwestwardly along said Southeast line of said Lot 1 of the Subdivision of the Estate of Sarah Blackburn South 36 degrees 37 minutes 59 seconds West 50.00 feet to a point; thence leaving said Southeast line North 53 degrees 28 minutes 59 seconds West 1746.83 feet to a point in the aforesaid line dividing U.S. Surveys 405 and 103; thence leaving said dividing line North 52 degrees 59 minutes 39 seconds West 335.80 feet to a point; thence North 36 degrees 59 minutes 01 seconds East 235.96 feet to a point; thence South 53 degrees 00 minutes 59 seconds East 50.00 feet to the point of beginning and containing 2.591 acres according to calculations by Volz Engineering & Surveying, Inc. on March 25, 1987. Parcel 4 - Beginning at the intersection of a Northeast line of a perpetual easement granted to St. Louis County, Missouri by deed as recorded in Book 6522, Page 388 of the St. Louis County Records with the Southeast line of said Lot 1 of the Subdivision of the Estate of Sarah Blackburn, said point being also in the Northwest line of property conveyed to Alfred L. Keevan and wife by deed as recorded in Book 6303, Page 1400 of the St. Louis County Records; thence Southwestwardly along the said Southeast line of Lot 1 of the Subdivision of the Estate of Sarah Blackburn South 36 degrees 37 minutes 59 seconds West 1209.88 feet to a point in the Northeast line of "Fox Lake Plat 5", a subdivision according to the plat thereof recorded as Daily No. 405 on March 10, 1986 in the St. Louis County Records; thence Northwestwardly along the said Northeast line of "Fox Lake Plat 5" North 53 degrees 40 minutes 28 seconds West 20.00 feet to a point; thence North 36 degrees 37 minutes 59 seconds East 1209.94 feet to a point in the aforesaid Northeast line of a perpetual easement granted to St. Louis County, Missouri; thence Southeastwardly along said Northeast line South 53 degrees 28 minutes 59 seconds East 20.00 feet to the point of beginning. 5 The foregoing Ordinance was adopted September 9, 1987.
