HomeMy Public PortalAbout07265 O R D I N A N C E NO. 7265 AN ORDINANCE, vacating any right, title or interest of the District in an easement in Arlington Terrace Plat One at The Villages of Cherry Hills in part of Section 12, Township 44 North, Range 3 East, in St. Louis County, Missouri, WHEREAS, the owner of the subject property has granted to the District suitable alternate easements, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Any right, title or interest of the District in the following ten foot (10') wide easement is hereby vacated, to wit: Commencing at the intersection of the centerline of Village Hills Parkway (40 feet wide) and the Northerly line of the subdivision "Arlington Terrace" - Plat One at The Villages of Cherry Hills, which subdivision was created by the Plat; thence along the centerline of said Village Hills Parkway in a Southeasterly direction along a curve for which the radius point bears South 77 degrees 52 minutes 29 seconds West 2035.00 feet, an arc distance of 86.49 feet to the point of tangency; thence South 09 degrees 41 minutes 25 seconds East continuing along the centerline of said Village Hills Parkway a distance of 37.17 feet; thence South 80 degrees 18 minutes 35 seconds West 20.00 feet to the Westerly right-of-way of said Village Hills Parkway; thence North 50 degrees 03 minutes 18 seconds West 30.89 feet to the Point of Beginning of the centerline of the herein described ten foot (10') wide easement; thence North 50 degrees 03 minutes 18 seconds West 16.98 feet; thence North 21 degrees 20 minutes 10 seconds West 64.32 feet; thence North 69 degrees 29 minutes 43 seconds West 56.60 feet to the termination of the centerline of said ten foot (10') wide easement. Said ten foot (10') wide easement parallels and extends 5 feet (5') on each side of the above-described centerline and extends 5 feet (5') beyond the termination point of said centerline, excepting that portion within the existing fifteen foot (15') wide 2 easement depicted on the Plat as being located Westerly of and parallel to (i) the aforementioned Village Hills Parkway and (ii) the 5 foot (5') wide roadway maintenance, sidewalk and utility easement depicted on the Plat as being located contiguous to the Westerly right-of-way of the aforementioned Village Hills Parkway, as recorded in Plat Book 251, Pages 36 and 37 of the St. Louis County Records. The foregoing Ordinance was adopted September 9, 1987.
