HomeMy Public PortalAbout1994-06 Approving and Adopting the VKB Master PlanORDINANCE NO. 94-6 AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, APPROVING AND ADOPTING THE VILLAGE OF KEY BISCAYNE MASTER PLAN; AUTHORIZING TRANSMITTAL; PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE WHEREAS, the Village of Key Biscayne, Florida was incorporated on June 19, 1991; and WHEREAS, the Village Council in its capacity as the Local Planning Agency ("LPA") has conducted exhaustive public hearings relating to the comprehensive planning and future growth of the Village which involved extensive public participation; and WHEREAS, pursuant to Florida Statute 163.3167(4) the Village has prepared a proposed Master Plan; and WHEREAS, on November 4, 1993, the LPA recommended to the Council that it adopt the proposed Master Plan; and WHEREAS, on January 11, 1994 at a duly held public hearing the Village Council passed and adopted Resolution No. 94-01 approving the transmittal of the Master Plan to the applicable state agencies; and WHEREAS, the Village Council after receiving the comments and recommendations of all applicable State agencies regarding the Master Plan has held the public hearings required under State law; and WHEREAS, the Village Council has determined that it is in the best interest of the Village and its residents to approve and adopt the Master Plan. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF KEY BISCAYNE AS FOLLOWS: Section 1. The Village of Key Biscayne Master Plan attached to this Ordinance as Exhibit "A" is hereby approved and adopted pursuant to Florida Statute 163.3184. Section 2. The Village Clerk is directed to make the appropriate transmittals as required by law. Section 3. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. This Ordinance shall become effective in accordance with Chapter 163 of the Florida Statutes. PASSED AND ADOPTED on first reading this 26th day of July , 1994. The following ordinance, on second reading, shall be considered: AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA; APPROVING AND ADOPTING THE VILLAGE OF KEY BISCAYNE MASTER PLAN; AUTHORIZING TRANSMITTAL; PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE. A public hearing on this ordinance will be held on Tuesday, August 16, 1994, 7:00 p.m, at the Council Chamber, 85 West McIntyre Street, Second Floor, Key Biscayne, Florida. Copies of the proposed ordinance may be obtained at Key Biscayne Village Hall, Office of the Village Clerk, 85 West McIntyre Street, Key Biscayne, Florida 33149. Should any person desire to appeal any decision of the Village Council with respect to any matter to be considered at this meeting, that person shall insure that a verbatim record of the proceedings is made including all testimony and evidence upon which any appeal may be based (F.S. 286.0105).
