HomeMy Public PortalAbout07375 O R D I N A N C E NO. 7375 AN ORDINANCE, declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District for the purpose of permitting construction of sanitary sewers in the project known as Westglen Interceptor (Kiefer Creek) 85246 to serve the needs of residents of the area, and authorizing the acquisition of such easements by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of St. Louis County within the Kiefer Creek Watershed wherein live and work numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by constructing sanitary sewers over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD .OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or 2 otherwise permanent and temporary easements for the construction, reconstruction, maintenance or repair of sewer lines as hereinafter set forth, and the right of ingress and egress over the premises sought to be condemned for access to such easements, said permanent and temporary easements being more particularly described as follows: 3 WESTGLEN INTERCEPTOR 85246 Eugene E. Ganz Property 24S-13-0020 Parcel #1 A permanent sewer easement, ten (10) foot in width, across a tract of land in Section 9, Township 44 North, Range 4 East of the FIFTH PRINCIPAL MERIDIAN, St. Louis County, Missouri, and across property conveyed to Eugene E. Ganz by deed recorded in Book 3883, Page 546 of the St. Louis County Recorder's Office, the centerline of said 10 foot wide permanent sewer easement being more particularly described as follows, Commencing at the Northwest corner of Section 10, Township 44 North, Range 4 East, said Northwest corner also being the Northeast corner of the aforementioned Section 9; thence along the Eastern line of said Section 9, South 00 degrees 34 minutes 31 seconds West a distance of 1384.30 feet to the Northeast corner of the Southeast quarter of the Northeast quarter of said Section 9; thence along the quarter section line, North 89 degrees 25 minutes 30 seconds West a distance of 516.00 feet to THE ACTUAL POINT OF BEGINNING of said 10 foot wide permanent sewer easement; thence along the centerline of said 10 foot wide permanent sewer easement the following courses and distances: South 26 degrees 24 minutes 23 seconds West a distance of 164.00 feet to a point; thence South 15 degrees 51 minutes 50 seconds West a distance of 800.00 feet to a point; thence South 6 degrees 20 minutes 24 seconds West a distance of 157.85 feet to a point in the Northeastern line of Kiefer Creek Road, 60 foot wide, as traveled, said point being THE POINT OF ENDING of said 10 foot wide permanent sewer easement said point also being 330.13 feet Northwestwardly, along said Northeastern line of Kiefer Creek Road, 60 foot wide, as traveled, from the East and West center section line of said Section 9; thence South 6 degrees 20 minutes 24 seconds West a distance of 89.04 feet to a point; thence South 89 degrees 25 minutes 29 seconds East a distance of 823.20 feet to a point in the Eastern line of said Section 9; thence along said Eastern line of Section 9, North 00 degrees 34 minutes 31 seconds East a distance of 1164.94 feet to a point, said point being the aforementioned Northeast corner of the Southeast quarter of the Northeast quarter of said Section 9. Also, two (2) temporary construction easements for use in the construction, reconstruction, maintenance, or repair of any sewer in the above described 10 foot wide permanent sewer easement and being located on strips of land, 25 foot in width along the Northwestwardly side and 25 foot in width along the Southeastwardly side and contiguous with the above described 10 foot wide permanent sewer easement. 4 Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. 5 The foregoing Ordinance was adopted January 27, 1988.
