AN ORDINANCE, vacating portions of sewer easements in
Lots 6 and 86 of Pendleton Place, in St. Louis County, Missouri.
WHEREAS, the owner of the subject property has
requested the District to vacate the portions of subject
easements, and has agreed to grant to the District suitable
alternate easements,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The portions of sewer easements described
below are hereby vacated, to wit:
Two parcels of land located in Pendleton Place as
recorded in Plat Book 267 Page 4 of the St. Louis County Records. Parcel 1 - Commencing at the Northeast corner of said Lot 6 of "Pendleton Place", thence Southwardly along the East line of said Lot 6 of "Pendleton Place" South 00 degrees 20 minutes 16 seconds West 31.71 feet to a point, on a South line of a 10 foot easement to M.S.D. by deed recorded in Book 3969 Page 435 of the St. Louis County Records; thence Westwardly along the said South line of 10 foot easement to M.S.D. South 79 degrees 54 minutes 33 seconds West 5.08 feet to the actual point of beginning, said point being also a point 5 feet perpendicularly distant West of the said East line of Lot 6 of "Pendleton Place"; thence Westwardly along the said South line of 10 foot easement to M.S.D. South 79 degrees 54 minutes 33 seconds West 111.85 feet to a point, said point being also a point 10 feet perpendicularly distant East of West line of said Lot 6 of "Pendleton Place"; thence North 00 degrees 20 minutes 16 seconds East 10.17 feet to a point on a North line of said 10 foot easement to M.S.D.; thence Eastwardly along the said North line of 10 foot easement to M.S.D. North 79 degrees 54 minutes 33 seconds East 111.85 feet to a point; thence South 00 degrees 20 minutes 16 seconds West 10.17 feet to a point of beginning. Parcel 2 - Commencing at the Southeast corner of Lot 86 of said "Pendleton Place"; said point also being the intersection of the South line of said Lot 86 of "Pendleton Place" and a West
line of Dunston Drive 50 feet wide; thence Northwardly along the said West line of Dunston Drive 50 feet wide North 00 degrees 20 minutes 16 seconds East 9.85 feet to a point on a South line of a 10 foot easement to M.S.D. by deed recorded in Book 3969, Page 435 of the St. Louis County Records; thence Westwardly along the said South line of 10 foot easement to M.S.D. South 79 degrees 54 minutes 33 seconds West 20.36 feet to the actual point of beginning, said point being also a point 20 feet perpendicularly distant West of the said West line of Dunston Drive 50 feet wide; thence Westwardly along the said South line of 10 foot easement to M.S.D. South 79 degrees 54 minutes 33 seconds West 6.48 feet to a point, said point being also a point 5 feet perpendicularly distant North of the said South line of Lot 86 of "Pendleton Place"; thence North 89 degrees 39 minutes 44 seconds West 55.24 feet to a point on a North line of said 10 foot easement to M.S.D.; thence Eastwardly along the said North line of 10 foot easement to M.S.D. North 79 degrees 54 minutes 33 seconds East 62.65 feet to a point; thence South 00 degrees 20 minutes 16 seconds West 10.17 feet to the point of beginning. The foregoing Ordinance was adopted April 27, 1988.
