AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN A R-2 ONE -FAMILY RESIDENTIAL
DISTRICT OF ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE
OF THE CITY OF RICHMOND, INDIANA, APPROVED JUNE 3, 1968.
BE IT ORDAINED by the Common Council of the City of Richmond, Indiana,
as follows:
SECTION 1. As provided in Article 20, Section 20.021 and more specifically
described in Article 45, and Article 48, of Ordinance No. 2325-1968, com-
monly known as the Zoning Ordinance of the City of Richmond, Indiana, the
following described use of the following described real estate is allowed
as a Special Use for a Residential Development Unit located at 938 South
23rd Street, in the City of Richmond, Indiana, more particularly described;
to -wit:
Being a part of the Southeast Quarter of Section 4, Township 13
North, Range 1 West in the City of Richmond, Indiana, and being
more particularly described as follows:
Beginning at an iron rod on the east line of the Southeast Quar-
ter of said Section 4, said point being 500.00 feet north of an
iron rod at the southeast Corner of said Southeast Quarter, and
running thence, from said beginning point, south 89 degrees and
13 minutes west, (assuming that the east line of said Southeast
Quarter runs north and south), parallel to the South line of
said Southeast Quarter, 780.29 feet to an iron pipe on the east
line of Morningside Third Subdivision to said City of Richmond,
Indiana; thence north, along said east line, and parallel to the
east line of said Southeast Quarter, 347.00 feet to an iron pipe
on an established fence line; thence north 89 degrees and 47
minutes east, along said fence line, 780.22 feet to an iron rod
on the east line of said Southeast Quarter; thence South, along
said east line, 339.20 feet to the place of beginning, contain-
ing an area of 6.145 acres.
SUBJECT TO: The right-of-way of South Twenty -Third Street, being
30 feet in equal width off the entire east side of the above
described tract, and subject to any easements of record.
SECTION 2. As a condition of the aforesaid Special Use and as an additional
restriction on said use, the following requirements shall hereafter and at
all times be met by the owner, leasee or any person, firm or corporation
using such real estate.
1. The Final Plan submitted and labled "Exhibit B" and filed
in the subject Plan Commission File shall be considered the
plan for development.
2. The west property line shall be effectively screened by
dense, non -seasonal foilage with a minimum planting height
of three (3) feet.
3. The east property area facing South 23rd Street shall be
effectively landscaped.
4. All utilities shall be placed underground.
5. The triangular piece of land on the property in the north-
west corner, which would be a straight extension of South
"J" Street, shall be dedicated by the property owner to the
City as a right-of-way.

6. Sanitary Sewers shall be approved by the Sanitary Board.
7. Storm drainage plan shall be approved by the Board of
Public Works and Safety.
8. Fire Hydrants shall be located in accordance with the
Board of Public Works & Safety; and, if the subject
Board requires the same, the owner shall bear cost of
installation.
9. Lighting of the property shall be done in such a manner
that it will not shine upon adjoining properties.
SECTION 3. The Zoning Administrator of the City of Richmond, Indiana, is
hereby authorized and directed, upon enactment and publication of this
Ordinance, to record and approve the issuance of a permit for the establish-
ment of the use herein allowed.
SECTION 4. This Ordinance shall be in full force and effect from and after
its passage and approval by the Mayor, and publication as by law required.
