HomeMy Public PortalAbout07541 O R D I N A N C E NO. 7541 AN ORDINANCE, vacating portions of sewer easements in Lot 2 of Belle Park Gardens, Plat 2, in U. S. Survey 209, Township 47 North, Range 7 East, in St. Louis County, Missouri. WHEREAS, the owner of the subject property has requested the District to vacate said portions of subject easements and the District has no further use for said portions, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The following described portions of sewer easements are hereby vacated, to wit: Three parcels of land located in Lot 2 of Belle Park Gardens, Plat 2. Parcel 1 being part of a ten foot (10') wide easement as recorded in Book 6691, Pages 1408 and 1409 of the St. Louis County Records. Parcel 2 being part of a ten foot (10') wide easement as recorded in Book 6691, Pages 1408 and 1409 of the St. Louis County Records. Parcel 3 being part of a variable width easement as recorded in Plat Book 114, Page 3 of the St. Louis County Records. Parcel 1 - Commencing at the intersection of the West line of Lot 2 of Belle Park Gardens, Plat 2, as recorded in Plat Book 156, Page 26 of the St. Louis County Records with the Southern right-of-way of Parker Road as widened; thence North 89 degrees 34 minutes 45 seconds East along said right-of-way a distance of 71.77 feet to a point; thence South 10 degrees 50 minutes 46 seconds West leaving said right-of-way a distance of 13.26 feet to the point of beginning; thence South 10 degrees 50 minutes 46 seconds West a distance of 109.10 feet to a point; thence North 89 degrees 34 minutes 45 seconds East a distance of 10.20 feet to a point; thence North 10 degrees 50 minutes 46 seconds East a distance of 109.10 feet to a point; thence South 89 degrees 34 minutes 45 seconds West a distance of 10.20 feet to the point of beginning. Parcel 2 - Commencing at the intersection of the West line of Lot 2 of Belle Park Gardens, Plat 2, as recorded in Plat Book 156, Page 26 of the St. Louis County records with the Southern right-of-way line of Parker Road as widened; thence South 00 degrees 25 minutes 15 seconds East along said West line of Belle Park Gardens, Plat 2 a distance of 130.00 feet to a point; thence North 89 degrees 34 minutes 45 seconds East leaving said West line of Belle Park Gardens, Plat 2 a distance of 45.87 feet to the point of beginning; thence South 10 degrees 50 minutes 46 seconds West a distance of 24.94 feet to a point; thence South 00 degrees 25 minutes 15 seconds East a distance of 395.49 feet to a point; thence North 89 degrees 34 minutes 45 seconds East a distance of 10.00 feet to a point; thence North 00 degrees 25 minutes 15 seconds West a distance of 394.51 feet to a point; thence North 10 degrees 50 minutes 46 seconds East a distance of 25.95 feet to a point; thence South 89 degrees 34 minutes 45 seconds West a distance of 10.20 feet to the point of beginning. (Existing easement recorded in Book 6691, Pages 1408 and 1409). Parcel 3 - Commencing at a point being the centerline of Parker Road; thence South 00 degrees 25 minutes 15 seconds East a distance of 35.00 feet to a point being the intersection of Southern right-of-way line of Parker Road with the Western line of Lot 2 of Belle Park Gardens, Plat 2, as recorded in Plat Book 156, Page 26 of the St. Louis County Records; thence South 00 degrees 25 minutes 15 seconds East continuing along Western line of said Lot 2 of Belle Park Gardens, Plat 2 a distance of 710.00 feet to a point; thence South 89 degrees 34 minutes 45 seconds West leaving said Western line a distance of 73.04 feet to the point of beginning; thence North 00 degrees 25 minutes 15 seconds West a distance of 110.00 feet to a point; thence North 89 degrees 34 minutes 45 seconds East a distance of 87.81 feet to a point on a curve, said point being the Western line of a 5 foot wide roadway maintenance and utility easement; thence in a Southerly direction along said Western line along a curve to the left having a radius of 308.26 feet, an arc distance of 86.41 feet to a point of tangency; thence South 0 degrees 42 minutes East continuing along said easement line a distance of 24.68 feet to a point; thence South 89 degrees 34 minutes 45 seconds West, leaving said easement line a distance of 76.31 feet to the point of beginning. The foregoing Ordinance was adopted September 14, 1988.
