The properties are located at 985 and 995 Medina Road, east of Tamarack Drive (see location map below). The lots were created prior to the existing zoning ordinance, and a number of existing conditions are not in compliance with current regulations. The ordinance requires 2-acres of contiguous suitable soils for lots created prior to 1999 in the RR zoning district. The existing home is the only structure on the lot, and appears to have been constructed in 1951. The house does not meet current front setback requirements. The existing 985 Medina Road is approximately 39.5 acres in size, and contains 4.95-acres of contiguous suitable soils. The parcel extends over Medina Road and includes a small triangle on the north side of the street. There are large areas of wetlands throughout the lot. In addition to the home on this parcel, there are two accessory structures. One of these structures is closer to the road, and is 1660 square feet in size. The second building is approximately 180 feet further from the road and is approximately 1620 square feet. In addition to these buildings, there are also two small l 0x 10 sheds. One of these sheds is located directly on the new proposed lot line, and staff has recommended a condition that this shed be moved to a location which meets setback requirements. The other shed is closer to the home. Both homes share a driveway which accesses Medina Road and meanders through both properties. Staff recommends a condition that both owners execute an easement and maintenance agreement in order to protect access rights for both parcels. Both properties have older existing septic systems, which would not meet current setback requirements from potential wetland areas. However, both systems were pumped and assessed during the summer of 2008 and appear to be adequate. Ordinance Compliance The two parcels are zoned Rural Residential (RR). The following table summarizes the regulations of the RR district, and the standards of the lots as proposed on the preliminary plat. (plus exempt 100 S.F. shed) Criteria for Front Setback Variance The existing home at 995 Medina Road is as close as 41 feet from the front property line. The house was built in the 1950's, before this small parcel was separated from the remainder of the 40-acre parcel. The setback was likely measured from the road surface at that time, since Medina Road bisected the lot. According to Section 825.45 of the City Code: "a variance from the provisions of the zoning ordinance may be issued to provide relief to the landowner where the ordinance imposes undue hardship or unique conditions to the property owner in the use of the land...A variance may be granted only in the event that all of the following circumstances exist:" 1. Exceptional or extraordinary circumstances apply to the property which do not apply generally to other properties in the same zone or vicinity, and result from lot size or shape, Michael Anderson Page 3 of 8 December 9, 2008 Lot Line Rearrangement Planning Commission Meeting topography, or other circumstances over which the owners of' property since enactment aphis Ordinance, have had no control The house was built in the 1950's, and likely met setback requirements at that time because right-of-way had not been dedicated for Medina Road. Staff does not believe that homes close to undedicated roadways are generally common throughout the rural residential zoning district. 2. The literal interpretation of the provisions of this Ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this Ordinance. The house is non -conforming as it exists today. Staff believes that the City could approve of this plat without granting a variance for the front setback. This would cause the existing home to remain non -conforming. The applicant proposes to dedicate right-of-way for Medina Road on the plat, which prevents this property from being added to Lot 1. 3. That the special conditions or circumstances do not result from the actions of the applicant. The home was constructed prior to the applicant purchasing the property, so the location of the home did not result because of the actions of the applicant. Additionally, the location of Medina Road establishes where the front lot line will be located. 4. That granting of the variance requested will not confer on the applicant any special privileges that is denied by this Ordinance to the owners of other lands, structures, or buildings in the same district. The variance does not allow new construction or expansion which would be denied owners of other lands in the same district. 5. The variance requested is the minimum variance which would alleviate the hardship. The applicant is not proposing to change the front property line in a way which increases the variance which is requested. Staff recommends a condition that limits any future additional structure from being constructed in a way which does not meet setbacks. This condition minimizes the variance. 6. The variance would not be materially detrimental to the purposes of this Ordinance or to property in the same zone. Since the variance is limited and does not allow expansion of the already existing non- conformity, staff does not believe granting it would be materially detrimental to the zoning ordinance. It should also be noted that the applicant is dedicating right-of-way for Medina Road, which the City currently holds only over the maintained portion of the roadway because of statutory user rights. Criteria for Lot Size Variance The existing 995 Medina Road parcel is just over an acre in size, and became a separate parcel before the current zoning ordinance was enacted. Although Lot 1 on the proposed plat does not meet lot size requirements, the plat does decreases the level to which Lot 1 is non -conforming. According to Section 825.45 of the City Code: "a variance from the provisions of the zoning ordinance may be issued to provide relief to the landowner where the ordinance imposes undue Michael Anderson Page 4 of 8 December 9, 2008 Lot Line Rearrangement Planning Commission Meeting hardship or unique conditions to the property owner in the use of the land...A variance may be granted only in the event that all of the following circumstances exist:" 1. Exceptional or extraordinary circumstances apply to the property which do not apply generally to other properties in the same zone or vicinity, and result from lot size or shape, topography, or other circumstances over which the owners of property since enactment of this Ordinance, have had no control. The variance is required because of the size of the existing lot which was created prior to the existing zoning ordinance. 2. The literal interpretation of the provisions of this Ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this Ordinance. Without approval of the variance, the applicant could not transfer property to the small lot in order to decrease the non -conformity of the existing lot. 3. That the special conditions or circumstances do not result from the actions of the applicant. The fact that the existing lot is not conforming with current standards is not a result of actions by the applicant. 4. That granting of the variance requested will not confer on the applicant any special privileges that is denied by this Ordinance to the owners of other lands, structures, or buildings in the same district. The plat proposes to reduce the level of non -conformity for Lot 1, rather than confer additional special privileges to the applicant. 5. The variance requested is the minimum variance which would alleviate the hardship. The proposed plat reduces the non -conformity of Lot 1 in an effort to minimize the variance. 6. The variance would not be materially detrimental to the purposes of this Ordinance or to property in the same zone. The plat brings Lot 1 closer to conformance with lot size requirements, which actually supports the purposes of the zoning ordinance. Wetlands and Easements There are large areas of wetlands as well as areas that are potentially wetlands throughout both proposed lots. Because this application does not create a net increase in parcels, the buffer requirements of the wetland ordinance are not triggered. The applicant does not propose additional construction at this time, but staff did review the location of existing structures in relation to the wetlands on the property. The wetland ordinance requires structures to be set back a minimum of 20 feet. The lean-to off the east side of the barn on Lot 2 is within 10 feet of the potential wetland area, although the remainder of the barn is over 20 feet from the wetland. Rather than completing an all-inclusive wetland delineation, the applicant agreed to allow the City's wetland expert to estimate the potential wetland areas on the property. The wetland expert Michael Anderson Page 5 of 8 December 9, 2008 Lot Line Rearrangement Planning Commission Meeting was cautious to include areas which potentially could be wetlands, and was more likely to overestimate a wetland area than underestimate. If the Commission recommends approval of the variances and of the plat, staff recommends a condition which requires the applicant to grant drainage easements over all wetlands on the properties, as well as standard drainage and utility easements along the perimeter of each lot. This condition would be consistent with previous plats and lot line rearrangements. Right -of -Way and Access The applicant has proposed dedicating a full 66-foot wide right-of-way for Medina Road, as was recommended by the City Engineer. Dedication of the right-of-way causes a triangle of property to be disconnected from either Lot 1 or Lot 2 of the plat. The applicant has identified this area as Outlot A. This outlot can be included with the ownership of either Lot 1 or Lot 2. The outlot could also potentially be sold to an adjacent property owner to the north or west sometime in the future. If the City approves of the variances and the plat, staff recommends a condition which requires a covenant that identifies Outlot A as an unbuildable parcel standing on its own. As stated above, both parcels are accessed by a shared driveway off of Medina Road. Staff recommends a condition which requires a cross -easement and maintenance agreement for the shared driveway. City Discretion The City has a good deal of discretion in reviewing the two variance requests. A variance must meet the six criteria listed above in order for the City to grant approval. In terms of the Preliminary Plat, the Planning Commission shall give particular attention to the arrangement, location, and width of streets, their relation to the topography of the land, water supply, sewage disposal, drainage, lot sizes, arrangement and soils details with respect to rural areas, the future development of adjoining lands, the requirements of the Comprehensive Plan, and the Zoning Ordinance. The Planning Commission and City Council shall deny approval of a preliminary or final plat based on one or a combination of the following findings: (a) That the proposed subdivision is in conflict with the general and specific plans of the city. (b) That the physical characteristics of this site, including but not limited to topography, vegetation, soils, susceptibility to flooding, water storage, drainage and retention, are such that the site is not suitable for the type of development or use contemplated. (c) That the site is not physically suitable for the proposed density of development or does not meet minimum lot size standards. (d) That the design of the subdivision or the proposed improvements are likely to cause substantial environmental damage. (e) That the design of the subdivision or the type of improvements are likely to cause serious public health problems. (f) That the design of the subdivision or the type of improvements will conflict with public or private streets, easements or right-of-way. Michael Anderson Page 6 of 8 December 9, 2008 Lot Line Rearrangement Planning Commission Meeting Staff Recommendation Staff recommends approval of the requested variances as well as approval of the preliminary plat. The plat can only be approved if the lot size variance is also granted by the City. Granting this variance allows the existing one -acre lot to be improved and come closer to conformance with suitable soil requirements. The plat could be approved without granting the front setback variance, which would cause the existing house to remain in non-conformance Staff has described potential Findings of Fact within the analysis of each variance above. Staff suggests the following conditions if the Planning Commission is to recommend approval of both variances and the preliminary plat. 1. Preliminary approval is granted for a plat which rearranges the property lines between the two subject lots. The following variances are hereby approved: a) reduction of the required area of contiguous suitable soils of Lot 1 to 1.53 acres; and b) reduction of the required front yard setback for the house on Lot 1 to 41 feet; 2. The variance to the required front setback shall only be valid for the portion of the house currently located less than 50 feet from the front lot line, as represented on the preliminary plat received by the City on December 4, 2008. Any future construction or expansion shall abide by ordinance requirements, including front setback regulations; 3. Within six months after final plat approval, the existing shed located to the east of the sport court shall be moved to a location which meets setback requirements or shall be removed from the properties; 4. The owners of the subject properties shall execute and record easement and maintenance agreements as recommended by the City Attorney with regard to the shared driveway; 5. The owners recognize that the existing accessory structures on both proposed lots do not meet the required setback for animal structures within the zoning ordinance and that the structures shall not be used to house, exercise, or accommodate animals; 6. The applicant shall identify a suitable alternative septic site for Lot 2 which meets all ordinance requirements; 7. The final plat shall dedicate drainage and utility easements per the requirements of the City Engineer; 8. The Applicant shall meet the requirements of the City Attorney with regards to title documentation; 9. Approval of this preliminary plat does not include approval of construction or grading operations. The applicants shall abide by permitting procedures, and grading, erosion control, and construction plans shall be reviewed for compliance with relevant regulations and the conditions set forth herein; 10. The final plat shall abide by the requirements of the Elm Creek Watershed District and Hennepin County; Michael Anderson Page 7 of 8 December 9, 2008 Lot Line Rearrangement Planning Commission Meeting 11. The application for final plat must be submitted to the City within 180 days of preliminary plat approval or the preliminary plat shall be considered void, unless a written request for time extension is submitted by the applicant and approved by the City Council; and 12. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the preliminary plat and related documents. Attachments 1. Applicant Narrative 2. This parcel at 995 Medina Road met the 1 acre requirement at that time. All we are asking to do is enlarge the 995 Medina Road lot from 1 acre to 3.5 acres and reduce the 39.5 acre lot down to 37 acres. The amount of frontage on Medina Road will stay the same for each lot. There are also some advantages to the City of Medina because no new lots are being created but through the final plat we are dedicating Medina Road to the city and protecting the wetlands with drainage and utility easements. Both lots do not currently meet the current standards for 5 acres of contiguous acceptable soils which will stay the same after the lot line change. The 995 lot will gain an extra half acre of good soils while my fathers lot will lose a half acre of good soils in an area where he would never put a septic system as it is too far from his house. Recent septic tests found an alternate septic site near his house in an area that was not even listed as good soils on the soils maps. These maps are general in nature and there are many areas on a 37 acre parcel where septic systems can be placed. Also, both lots do not meet the current standards for frontage on Medina Road but we are not changing that lot line so the frontage for each lot will remain the same. The benefits of greatly improving the smaller lot, dedicating the road and wetland easements, no harm being done to the larger lot and no new variances being created justify approval of this small change to a unique situation. The plans are dated November 12, 2008. We have the following comments with regards to engineering matters. • The plans show "low areas" indicating the applicant's engineer's estimation of the wetland boundaries. The timeframe in which wetlands can be officially delineated has lapsed for this growing season. Bonestroo staff has estimated the wetland boundaries for this site and the digital outline has been provided to the applicant's engineer. We are comfortable using our boundaries to determine the necessary wetland drainage easements for this application. We recommend that the applicant resubmit the plan showing the Bonestroo provided wetland information and adjusted easements. • The plans should clarify whether the property lying northwest of Medina Road is intended to be a drainage and utility easement. • If the two properties are going to continue sharing a common driveway, the city should consider requiring the applicant to provide easements addressing shared access. • The driveway for the 985 Medina Road crosses the 995 Medina Road property in several places. Easements should be provided that address this issue. • The plans need to show interior lot line drainage and utility easements. A) Commercial District Ordinances: planning staff was prepared to present the commercial zoning ordinance updates to the City Council at the Nov. 18th meeting; however due to the lateness of the meeting and request by Council; planning staff is preparing some illustrative examples or representations of how various sized commercial, office and/or retail developments would look on a proposed commercial parcel. Staff is in the process of completing these and will be making a follow-up report at the December 16th meeting. B) Private Recreation Zoning District. Upon discussion with staff and the representatives of the Medina Golf & Country Club, the Council tabled this item once again to allow staff to meet with the owners/developers of MGCC to determine what process of the new PREC ordinance works best for their plans, and ultimately the city's goal of maintaining the golf course as open space area. C) General Commercial and Industrial Ordinances — planning staff presenting the new General Commercial and Industrial Zone district regulations to the Planning Commission at the November 12 regular meeting. PC recommended a number of revisions and approval to the Council. Tentatively scheduled for review by the Council at the January 09 regular meetings. D) Woodridge Church —1500 County Road 24 — submitted a CUP request to add 20,446 sf. of addition to the existing church facilities. Scheduled for review under public hearing at the December 9 PC meeting. E) Michael Anderson (and Wallace Anderson) — 985 — 995 Medina Road: requesting Lot Line Rearrangement and variances to lot size standards. Scheduled for review under public hearing at the December 9 PC meeting. Project Description: Woodridge Church is seeking a Conditional Use Permit to add 20,446 square feet to their existing facility, 8,175 to the Main Level and 12,271 to the Lower Level. The Church is currently undersized in Fellowship, Christian Education and Administration space based on their current worship center seating capacity and goals for future growth. The majority of the addition will be on the "back" or North and East side of the existing building. The program for the new space includes a new state of the art Student Ministry meeting space, Administration space for staff, additional classroom space for babies, preschool and grade school children, gathering space for adults, a warming kitchen and improved circulation. The exterior building materials will use the same materials that were used on the existing facility so as to provide a seamless integration from old to new. See colored elevations A6.1 for material locations. Included as part of this project is a relocation and update of the existing septic system, sprinkling of the entire facility and an improved drop-off on the North side of the building. All of the mechanical units will be screened from County Road 24 either by existing topography, landscaping or roof top screening that integrates with the building materials. Grading will be required for the building of the addition, location of the sprinkler system tanks, new entry plaza on the North and for the relocated Mound system. New Woodridge Church Narrative 2 landscaping will be incorporated around the North entry plaza. The North entry plaza will be a graded impervious concrete patio that will drain onto grass. As an alternate we are proposing that the New North Entry Plaza to be paved with pervious concrete pavers over'/4" rock and drain tile outlet to the wetlands. New trees will be added to reflect the increase in building area. See the Landscape Plan LLI for locations and replacement calculations. The plans are dated December 1, 2008. We have the following comments with regards to engineering matters. • The proposed catch basin inverts are lower than the invert of the existing structure to the west. The proposed inverts should be adjusted so that the runoff will drain to the existing storm sewer system. • The spot elevations near the south corner of the parking lot and the retaining walls are not in agreement. The proposed parking lot grades in this area would indicate a top of curb grade of 994.5+/- in this area, while the bottom wall elevation is shown as 993.53. The proposed grading and wall elevations should be revised such that they are in agreement. • The previously submitted drainage calculations appear to show several different treatment options. Revised calculations for the proposed treatment cell and storm sewer should be provided for review. • The high water level for the treatment cell should be at least V below the proposed FFE. These meeting concerns were building code requirements, fire code requirements, site concerns and accessibility. The meetings were very productive as shown by; the preliminary plans. This building will be fire sprinklered and accessibility will be maintained. At this point it would appear that the design proposed will meet all building and fire codes. The septic willl have to be reviewed and redesigned if needed by a licensed and certified designer before any building permit will be issued. This has also been discussed with the applicant. The applicant also requests an Interim Use Permit to allow the continued use of the existing single family home at 1432 County Road 24 that was purchased by the church in 1993 under a life estate. The subject property is zoned Rural Residential (RR) and is guided Rural Residential in the Comprehensive Plan. All surrounding properties are zoned RR. History - Resolutions The referenced resolutions below will be incorporated into one resolution under this CUP application. In 1995, a CUP was approved to construct Woodridge Church (Resolution 95-29). All conditions within the resolutions have either been satisfied or have been incorporated into the recommended conditions. In 1998, a CUP amendment was approved to expand the church and parking lot (Resolution 98- 41). All conditions within the resolutions have either been satisfied or have been incorporated into the recommended conditions. Project Summary The applicant has indicated that the church is currently undersized in Fellowship, Christian Education and Administration space based on their current worship center seating capacity and goals for future growth. The addition is proposed on the northeast side of the existing church and will have two levels. The main level is 8,175 square feet containing an adult lobby, inner lobby, check -in area, receiving area, restrooms, kitchen, coffee bar, prayer and gathering rooms, community rooms, and daycare rooms. The lower level is proposed to be 12,271 square feet containing offices, conference rooms, gathering rooms, classrooms, restrooms, game room, and a student center/meeting area. The project will also entail the relocation and update of the existing septic system, sprinkling of the entire building and an improved entry on the north side of the building. New landscaping will also be incorporated around the North entry plaza with a new impervious concrete patio that will drain onto the grass. The construction is proposed to start in May of 2009 with completion in December of 2009 or January 2010. Interim Use Permit Staff recommended the applicant submit for an Interim Use Permit (IUP) as part of this project. The IUP relates to the existing single family home at 1432 County Road 24 that was purchased by the church in 1993 under a life estate. The IUP will allow the continuation of the use of the home and would expire when the current resident no longer occupies the home. If the church in the future would like to utilize the home for anything other than the current resident, an amendment would be required. As part of the project, spaces will be removed at the front entrance for fire truck accessibility and near the north entrance. The total required parking stalls is 273 and the applicant proposes 285 to remain as part of the project. Wetlands As part of the application process the applicant has submitted a wetland delineation report and it has been reviewed by the City's wetland specialist. It was required of the applicant to install a 20 foot buffer area down gradient from any work, and the applicant has incorporated these requirements into their plan. Staff has placed a condition of approval that the applicant shall record an easement over the wetland buffer area. Woodridge Church CUP Amendment December 9, 2008 Planning Commission LID Practices The applicant proposes to install a patio area connecting to the north entrance of the addition that will be constructed with permeable pavement and will be sloped to allow for water run-off onto the adjoining grasses. The applicant also proposes a treatment cell on the east side of the parking lot to help stormwater run-off, which serves as a pretreatment system. Exterior Building Materials & Height The exterior of the addition is proposed to match the existing materials and colors. Staff is satisfied with the proposed materials. Materials include metal roof and flashing, two styles of brick, EIFS siding, and rock face block. The applicant has submitted a sample board that will be presented at the meeting. Colored elevations are attached. Landscaping Landscaping is primarily proposed to be located on the north side of the building, east of the proposed patio. The planting schedule includes a variety of perennial shrubs which will provide varying colors. Staff does not recommend additional landscaping. Tree Preservation The property has a total of 232 significant trees. The City Code allows removal of up to 5% of significant trees on -site for activities "other than initial site development". The applicant proposes to remove 10 significant trees, which is a 4.3% removal. No significant trees are proposed or required to be planted. Lighting The project proposes to relocate two light poles within their existing islands and installation of recessed lighting under the canopy, at the north entrance. Woodridge Church CUP Amendment 4 December 9, 2008 Planning Commission City Discretion The City has a relatively low level of discretion when it comes to reviewing Conditional Use Permits. If the application meets City ordinances, the CUP should be approved. However, the City may impose conditions on the approval that protect the best interests of the surrounding community and the city as a whole. With the recent updates of the city Comprehensive Plan, the advisory panel and city council publicly voiced and indicated their concerns of churches and other institutional type uses becoming "too commercialized" or providing a full range of activities or services that may be deemed a bit intensive or beyond the scope of the intended use. Some comments even broached the idea of having semi-public or similar institutional uses provide a payment in lieu of taxes (PILOT) fund back to the city, in order to help support some of the essential city services that are normally paid for by the taxable properties throughout a community. Communities are beginning to notice and experiencing a higher level of services inside church properties, beyond the typical daily/weekend prayer services; including large day-care operations or after -school care centers; community meeting spaces for support groups such Alcoholics or Gamblers Anonymous, MADD, or meeting and play centers for groups such as the Boys/Girls Scouts, Big Brothers/Big Sisters Program; and even religious book/gift stores; cafeteria or dining centers; and transient/temporary or homeless housing facilities. Some churches even take on the role of a parochial school once the membership increases to a level that can adequately fund and serve the school. This increased level of activities or services eventually leads to increased traffic, or spurs a higher number and/or level of special events and gatherings, which may in effect disrupt the rural character of Medina. These are just a few of the reasons which may cause or already caused concern among members of the community. Although the Applicant has not indicated this large expansion is needed to facilitate these types of activities inside their own church building, it appears this new addition and expanded facility would easily accommodate or provide an ideal opportunity for many services beyond the intermittent or weekend worship services. The local control work plan (regarding the new zoning districts and ordinances) prepared earlier by the city planning staff indicated we would be presenting the Public/Semi-Public land controls after the commercial and residential district reviews. Due to the delays of other ordinances, staff does not believe we would begin the research, analysis and preparation of any ordinance related to the Public/Semi-Public uses until the spring of 2009. Updating the City's official controls pertaining to churches and conditional uses was targeted as an objective and will likely be reviewed in spring of 2009. The Planning Commission should discuss if the local controls and regulations that some Advisory Panel/City Council members advocated for or wished to see enacted and held to similar institutional uses (not just churches), must be addressed prior to any consideration given to this specific land use application. If so, this may be cause for the enactment of a temporary moratorium. The idea of a moratorium is a very delicate issue and should be considered very carefully; but it remains a viable option or mechanism for delaying a land use decision until further land use controls or regulations have been established. Staff is not advocating or providing any recommendation on this issue, but it should be discussed and any recommendation forwarded to the City Council for final consideration. Staff will be Woodridge Church CUP Amendment 5 December 9, 2008 Planning Commission prepared to answer any general questions related to the PILOT, moratorium or land use controls at the Tuesday night meeting. Conditional Use Permit Ordinance Compliance While reviewing Conditional Use Permits, City ordinances (Section 825.39) state that the City should consider the following: Subd.1. That the conditional use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the immediate vicinity. Staff believes that the facility is set back in such a way that it has little impact on neighboring properties. Subd. 2. That the establishment of the conditional use will not impede the normal and orderly development of surrounding vacant property for uses predominant in the area. The surrounding area is rural residential in character and the addition does not impede the surrounding properties. Subd. 3. That adequate utilities, access roads, drainage and other necessary facilities have been or are being provided. The Building Official/Fire Marshal has reviewed the plans and does not bring forward any major issues. The property is served offa County Road and has an individual sewage treatment system and a sprinklered building. Subd. 4. That adequate measures have been or will be taken to provide sufficient off-street parking and loading space to serve the proposed use. Staff believes that the project provides sufficient parking even though they are reducing the number of stalls. Subd. 5. That adequate measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise and vibration, so that none of these will constitute a nuisance, and to control lighted signs and other lights in such a manner that no disturbance to neighboring properties will result. The City will require any lighting to comply with Section 829.04, where all lighting must be downcast in order to maintain a dark sky rural area. Subd. 6. The use, in the opinion of the City Council, is reasonably related to the overall needs of the City and to the existing land use. Staff believes that the current and proposed activities at the church are being provided as a service to the City. Woodridge Church CUP Amendment 6 December 9, 2008 Planning Commission Subd. 7. The use is consistent with the purposes of the zoning code and the purposes of the zoning district in which the applicant intends to locate the proposed use. Staff believes that the expansion of the building continues to provide the kind of activities necessary for a church. The site is on a larger parcel which assists in buffering by distance from Rural Residential properties. Subd. 8. The use is not in conflict with the policies plan of the City. Staff believes the use is consistent with the "Rural Residential " guiding. Subd. 9. The use will not cause traffic hazard or congestion. Staff believes that this addition is intended to be used by its current members. If the applicant would be increasing the number of seats it would trigger the need for additional parking. County Road 24 is a minor arterial roadway which connects to the urban service area to cities and towns inside and outside the region and generally service medium to short trips. Subd.10. Existing businesses nearby will not be adversely affected by intrusion of noise, glare or general unsightliness. Staff believes that the large distance that the facility is set back largely mitigates these concerns. Subd.11. The developer shall submit a time schedule for completion of the project. The applicant has stated that construction would begin in May of 2009 and completion is planned for December of 2009 or January 2010. Subd.12. The developer shall provide proof of ownership of the property to the Zoning Officer. The property is owned by the Woodridge Church. Engineering Considerations Bonestroo has reviewed and approves of the proposed addition, subject to four conditions as referenced in their letter dated December 4, 2008. Planning Considerations Planning staff has reviewed and recommends approval of the addition and its interior activities. Building Official/Fire Considerations The applicant has been working with the Building Official for several months discussing building codes, fire codes, site concerns, and accessibility. The application includes the building being fire sprinklered and accessibility to be maintained. The Building Official is satisfied with the proposed application. Woodridge Church CUP Amendment 7 December 9, 2008 Planning Commission Public Works Considerations The Public Works Superintendant recommends that if in the future another addition is proposed for additional seats in the auditorium a new entrance off of County Road 24 would need to be installed. The entrance should be positioned so that it is more visible to other drivers on County Road 24. Minnehaha Creek Watershed District Considerations The applicant is meeting with Minnehaha Creek Watershed on December 10, 2008 to complete a preliminary review of their project. A Watershed permit will be required prior to the issuance of a building permit by the City. Recommendation If the Planning Commission is inclined to forgo or defer any discussion or recommendation on a moratorium, PILOT or other issues, then Planning staff would support a recommendation of approval for the IUP Amendment to allow the continued use of the single family home on -site and an Amendment to the Conditional Use Permit to allow for construction of the 20,446 sq. ft. addition, subject to the following terms and conditions: 1. The new addition shall match the appearance in both materials and colors as the existing building; 2. Any new outdoor lighting must be designed and installed so that the light is downcast only with all sides enclosed except the bottom, the lens is recessed and the light source is not visible; 3. Any roof top mechanical equipment shall be completely screened; 4. If the entrance driveway to County Road 24 becomes a problem in the future, the Applicant shall take corrective action. The City will determine if there is a problem and evaluate the appropriateness of the Applicant's proposed corrective action or if in the future an additional expansion is proposed the entrance shall be required to be relocated; 5. The church shall not operate a full-time daycare or school as part of the CUP; 6. The applicant shall comply with the conditions outlined in the City Engineer's review letter dated December 4, 2008; 7. Erosion control shall be in place prior to any grading activity on the site and shall be maintained throughout the period of construction; 8. All septic sites shall be fenced and protected prior to beginning of grading or construction; 9. The applicant shall execute and record an easement over the required wetland buffer area; 10. No parking shall be allowed on either side of the driveway from County Road 24 to the parking lot; 11. All landscaping shall be maintained and replaced if it dies; 12. The applicant shall execute a development agreement with the City to insure completion of the site improvements; 13. The applicant shall obtain all necessary permits before construction; and 14. The Applicant agrees to pay to the City all fees associated with the review and processing of these applications, including all those costs incurred by city staff and city consultants for the preparation and filing of all permits and documents. If the Planning Commission wishes to forward any recommendation of a moratorium or other conditions not listed, you should provide a justification or reasons for doing so, and we will present those before the City Council at a subsequent council meeting.
