AN ORDINANCE, vacating a portion of an easement in U.
S. Survey 1911 in Township 45 North, Range 4 East, in St. Louis
County, Missouri,
WHEREAS, the owner of the subject property has granted
to the District suitable alternate easements,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The following portion of a ten foot
(10') wide easement is hereby vacated, to wit:
Two parcels of land in U. S. Survey 1911, Township 45
North, Range 4 East, as recorded in Book 5817, Page 353 of the St.
Louis County Records. Parcel 1 - Commencing at the Northwestern corner of property conveyed to Charles E. Malmros and wife by deed recorded in Book 6075, Page 98 of the St. Louis County Records, said point being also the Southwestern corner of property conveyed to Ernest W. Rosener and wife by deed as recorded in Book 6291, Page 1984 of the St. Louis County Records, said point being also a point on the East line of property conveyed to Harold C. Biebel and wife by deed as recorded in Book 7239, Page 599 of the St. Louis County Records; thence North 14 degrees 58 minutes 42 seconds West 89.12 feet along said East line of Biebel property, said line being also the West line of Rosener property, to the intersection of said East line of Biebel property with the Northeast line of said 10 foot easement to Fee Fee Trunk Sewer, Inc.; thence North 56 degrees 19 minutes 25 seconds West 144.99 feet along said Northeast line thereof to the intersection of said Northeast line thereof with the North line of said 10 foot easement to Fee Fee Trunk Sewer, Inc.; thence North 71 degrees 55 minutes 28 seconds West 206.97 feet along said North line thereof to the actual point of beginning; thence along a curve to the left whose radius point bears South 53 degrees 58 minutes 07 seconds East 79.00 feet from the last mentioned point, a distance of 7.16 feet to a point; thence North 67 degrees 53 minutes 57 seconds
West 98.34 feet to a point on said North line of 10 foot easement to Fee Fee Trunk Sewer, Inc.; thence South 71 degrees 55 minutes 28 seconds East 100.00 feet along said North line thereof to the point of beginning. Parcel 2 - Commencing at the Northwestern corner of property conveyed to Charles E. Malmros and wife by deed recorded in Book 6075, Page 98 of the St. Louis County Records, said point being also the Southwestern corner of property conveyed to Ernest W. Rosener and wife by deed as recorded in Book 6291, Page 1984 of the St. Louis County Records, said point being also a point on the East line of property conveyed to Harold C. Biebel and wife by deed as recorded in Book 7239, Page 599 of the St. Louis County Records; thence North 14 degrees 58 minutes 42 seconds West 89.12 feet along said East line of Biebel property, said line being also the West line of Rosener property, to the intersection of said East line of Biebel property with the Northeast line of said 10 foot easement to Fee Fee Trunk Sewer, Inc.; thence North 56 degrees 19 minutes 25 seconds West 15.14 feet along said Northeast line thereof to the actual point of beginning; thence South 14 degrees 58 minutes 42 seconds East 15.14 feet to a point on the Southwest line of said 10 foot easement to Fee Fee Trunk Sewer, Inc.; thence North 56 degrees 19 minutes 25 seconds West 139.84 feet along said Southwest line thereof to the intersection of said Southwest line thereof with the South line of said 10 foot easement to Fee Fee Trunk Sewer, Inc.; thence North 71 degrees 55 minutes 28 seconds West 52.02 feet along said South line thereof to a point; thence along a curve to the right whose radius point bears North 65 degrees 12 minutes 18 seconds East 5.00 feet from the last mentioned point, a distance of 2.68 feet to a point; thence along a curve to the left whose radius point bears North 84 degrees 07 minutes 40 seconds West 79.00 feet from the last mentioned point, a distance of 7.93 feet to a point on the North line of said 10 foot easement to Fee Fee Trunk Sewer, Inc.; thence South 71 degrees 55 minutes 28 seconds East 56.67 feet along said North line thereof to the intersection of said North line thereof with said Northeast line of 10 foot easement to Fee Fee Trunk Sewer, Inc.; thence South 56 degrees 19 minutes 25 seconds East 129.84 feet along said Northeast line thereof to the point of beginning. The foregoing Ordinance was adopted November 23, 1988.
