AN ORDINANCE, vacating portions of sewer easements in
"Boundary Adjustment Plat in U. S. Survey 2993 Township 44 North,
Range 6 East, in St. Louis County, Missouri,
WHEREAS, the owner of the subject property has granted
to the District suitable alternate easements,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The following described portions of
sewer easements are hereby vacated, to wit:
Two parcels of land located in Cross Creek Apartments
Phase I Part of a Boundary Adjustment Plat in U. S. Survey 2993
Township 44 North, Range 6 East as recorded in Plat Book 257, Page
94 of the St. Louis County Records. Said two parcels being part
of ten foot (10'), twenty foot (20') and thirty foot (30') wide
easements. Parcel 1 - Commencing at the intersection of the Southern line of property conveyed to C. Coco by deed recorded in Book 5563, Page 430 of the St. Louis County Records, and the Western line of "North Rose Garden" according to the plat thereof recorded in Plat Book 71, Page 44 of the St. Louis County Records; thence along the Western line of "North Rose Garden" as aforementioned and the Western line of "Rose Garden Plat 3" according to the plat thereof recorded in Plat Book 51, Page 99 of the St. Louis County Records, South 9 degrees 11 minutes 13 seconds West, 287.08 feet to the true point of beginning; thence continuing along said Western line South 9 degrees 11 minutes 13 seconds West, 30.00 feet; thence leaving said Western line and running the following: North 80 degrees 48 minutes 47 seconds West, 166.64 feet to a point of curve; thence Northeastwardly along a curve to the right having a radius of 181.00 feet an arc distance of 23.56 feet (the chord of which bears North 0 degrees 21 minutes 46 seconds East 23.54 feet) to a point of tangency; thence North 4 degrees 05 minutes 30 seconds East, 121.05 feet
to a point of curve; thence Northeastwardly along a curve to the right having a radius of 281.00 feet an arc distance of 57.53 feet (the chord of which bears North 9 degrees 57 minutes 26 seconds East, 57.43 feet) to a point of tangency on the Eastern line of "Cross Creek Apartments Phase 1" according to the plat thereof recorded in Plat Book 257, Page 94 of the St. Louis County Records; thence leaving said Eastern line and running the following: South 74 degrees 10 minutes 38 seconds East, 20.00 feet to a point of curve; thence Southwestwardly along a curve to the left having a radius of 261.00 feet an arc distance of 53.44 feet (the chord of which bears South 9 degrees 57 minutes 26 seconds West, 53.35 feet) to a point of tangency; thence South 4 degrees 05 minutes 30 seconds West, 116.07 feet and South 80 degrees 48 minutes 47 seconds East, 150.78 feet to the point of beginning. Parcel 2 - Commencing at the intersection of the Southern line of property conveyed to C. Coco by deed recorded in Book 5563, Page 430 of the St. Louis County Records, and the Western line of "North Rose Garden" according to the plat thereof recorded in Plat Book 71, Page 44 of the St. Louis County Records; thence along the Southern line of C. Coco property as aforementioned North 80 degrees 51 minutes 07 seconds West, 94.28 feet to the true point of beginning; thence leaving said Southern line and running the following bearings and distances: South 15 degrees 49 minutes 22 seconds West, 115.28 feet; South 9 degrees 43 minutes 54 seconds West, 347.51 feet; North 80 degrees 48 minutes 20 seconds West, 111.89 feet; and North 82 degrees 21 minutes 43 seconds West, 154.38 feet to a point on the Eastern line of "Cross Creek Apartments Phase 1" according to the plat thereof recorded in Plat Book 257, Page 94 of the St. Louis County Records; said point being distant South 4 degrees 39 minutes 55 seconds East, 0.83 feet from the Southeastern corner thereof; thence along said Eastern line North 4 degrees 39 minutes 55 seconds West, 10.24 feet; thence leaving said Eastern line and running the following bearings and distances: South 82 degrees 21 minutes 43 seconds East, 151.89 feet; North 10 degrees 43 minutes 07 seconds East, 50.28 feet; North 6 degrees 23 minutes 13 seconds West, 164.28 feet; North 83 degrees 36 minutes 47 seconds East, 10.00 feet; South 6 degrees 23 minutes 13 seconds East, 165.78 feet; South 10 degrees 43 minutes 07 seconds West, 51.39 feet; South 80 degrees 48 minutes 20 seconds East, 96.91 feet; North 9 degrees 43 minutes 54 seconds East, 338.14 feet and North 15 degrees 49 minutes 22 seconds East, 114.64 feet to a point on the Southern line of C. Coco property as aforementioned; thence along said Southern line South 80 degrees 51 minutes 07 seconds East, 10.07 feet to

the point of beginning. The foregoing Ordinance was adopted December 28, 1988.
