HomeMy Public PortalAbout07691 O R D I N A N C E NO. 7691 An Ordinance providing the method whereby the Metropolitan St. Louis Sewer District shall, effective April 1, 1989 undertake the operation and maintenance of stormwater and drainage facilities within the boundaries of the entire District. WHEREAS, the Plan of the Metropolitan St. Louis Sewer District empowers the District to approve, revise or reject the plans and designs of all stormwater and drainage facilities proposed to be constructed, altered or reconstructed in the District, and empowers the District to take title to and accept by dedication any and all public or privately owned stormwater and drainage facilities necessary for the purposes of the Plan to assure a comprehensive stormwater and drainage system within the boundaries of the entire District; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Effective April 1, 1989, all plans and designs for all stormwater and drainage facilities within the boundaries of the District shall be submitted for approval, revision or rejection by the District pursuant to the Plan, Ordinances and the District Standards. The District shall provide all stormwater plan and design review, permit control and construction inspection. The District will provide operation and maintenance of all stormwater and drainage facilities accepted for dedication by the District to the extent funds are or become available for such purposes. 2 Section Two. All plans, designs and construction shall comply with the "RULES AND REGULATIONS AND ENGINEERING DESIGN REQUIREMENTS FOR SANITARY SEWERAGE AND STORMWATER DRAINAGE FACILITIES" and "STANDARD CONSTRUCTION SPECIFICATIONS FOR SEWERS AND DRAINAGE FACILITIES" as presently published and attached to this Ordinance which are hereby ratified and approved, or as hereafter amended and approved by the Board of Trustees, herein collectively referred to as the "District Standards." Section Three. An existing stormwater and drainage facility may be dedicated to the District. The Executive Director shall accept the dedication of such facility to the District's stormwater and drainage system, provided that the District's final inspection report made prior to the acceptance of dedication confirms that the facility meets the District Standards. Section Four. Upon completion of new stormwater and drainage facilities for which plans are approved by the District after April 1, 1989, the facilities shall be dedicated to the District and the Executive Director shall accept the dedication of such facilities to the District's stormwater and drainage system, provided that the facilities have been constructed in accordance with the approved plans and the District's final inspection reports made prior to the acceptance of dedication confirm that the facilities meet the District Standards. Section Five. Notwithstanding any other provision of this Ordinance, stormwater detention facilities shall be operated 3 and maintained by the owners of the properties served and shall not be accepted for operation and maintenance by the District. Before the dedication of any stormwater and drainage facility that discharges into a detention facility shall be accepted by the District, the District shall approve a maintenance plan of the detention facility with (1) assessment provisions as a part of an indenture containing covenants by the owners that run with their land to assure continual operation and maintenance of the detention facility, or (2) the District will accept an agreement with a governmental entity that the entity will assure continual operation and maintenance of the detention facility. 4 The foregoing Ordinance was adopted February 22, 1989.
