HomeMy Public PortalAbout07692 O R D I N A N C E NO. 7692 AN ORDINANCE, vacating portions of sewer easements in Beau Jardin Townhomes, Sections 1 and 36 of Townships 45 and 46 North Range 5 East, in St. Louis County, Missouri, WHEREAS, the owner of the subject property has requested this District to vacate the portions of subject easements, and this District has no further use for said portions, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The following described portions of sewer easements are hereby vacated, to wit: Four parcels of land in Beau Jardin Townhomes. Parcel 1 - A strip of ground being all of that part of a certain easement created by instrument recorded in Plat Book 112, Page 9, as amended by instrument recorded in Deed Book 8345, Page 712, which underlies any part of Unit 1 of "BEAU JARDIN TOWNHOMES, A CONDOMINIUM" (Plat Book 277, Pages 89 through 95), and being part of Lot "D" of the "BOUNDARY ADJUSTMENT PLAT OF SEVERAL PARCELS OF LAND COMPRISING BEAU JARDIN" (Plat Book 277, Pages 81 and 82), and being in Section 1, Township 45 North, Range 5 East, St. Louis County, Missouri, and being more particularly described as: Commencing at the Northeast corner of the aforesaid Lot "D" of the "BOUNDARY ADJUSTMENT PLAT OF SEVERAL PARCELS OF LAND COMPRISING BEAU JARDIN"; thence along the East line of said Lot "D" South 00Ε15'00" West 16.99 feet; thence leaving said East line of Lot "D" North 89Ε24'2-" West 28.89 feet to a point in the East fact of a 2 story brick attached townhome known as Unit 1 of the aforesaid "BEAU JARDIN TOWNHOMES, A CONDOMINIUM," which point is the actual point of beginning; thence North 89Ε24'20" West 30.02 feet to a point in the West fact of said Unit 1; thence following the fact of said Unit 1 the following: North 00Ε51'39" East 1.39 feet; South 89Ε33'37" East 30.00 feet and South 00Ε03'44" West 1.47 feet to the actual point of beginning. Parcel 2 - A strip of ground being all of that part of a certain easement created by instrument recorded in Plat Book 112, Page 9, as amended by instrument recorded in Deed Book 7345, Page 712, which underlies any part of Unit 71 of "BEAU JARDIN TOWNHOMES, A CONDOMINIUM" (Plat Book 277, Pages 89 through 95), and being part of Lot "C" of the "BOUNDARY ADJUSTMENT PLAT OF SEVERAL PARCELS OF LAND COMPRISING BEAU JARDIN" (Plat Book 277, Pages 81 and 82), and being in Lot 3 of "GUSTAVE GUELBRETH'S SUBDIVISION OF SHARE "D" ALLOTTED TO HIM IN CASE OF LEGG, ET AL. V. GUELBRETH ET AL. LAND COURT OCTOBER TERM 1865", and being in Section 36, Township 46 North, Range 5 East, St. Louis County, Missouri, and being more particularly described as: Commencing at the intersection of the West line of the aforesaid Lot "C" of the "BOUNDARY ADJUSTMENT PLAT OF SEVERAL PARCELS OF LAND COMPRISING BEAU JARDIN" with the South line of Corbeil Drive, a 50 foot wide private drive established by Plat Book 118, Page 71; thence along said West line of Lot "C" South 31Ε27'56" East 12.57 feet; thence leaving said West line of Lot "C" South 89Ε24'10" East 30.65 feet to a point in the West face of a 2 story brick attached townhome known as Unit 71 of the aforesaid "BEAU JARDIN TOWNHOMES, A CONDOMINIUM," which point is the actual point of beginning; thence South 89Ε24'10" East 20.01 feet; thence South 00Ε13'40" West 16.55 feet to a point in the South face of the aforesaid Unit 71; thence along the South and West faces of said Unit 71 South 73Ε46'04" West 14.45 feet and North 16Ε15'51" West 21.66 feet to the actual point of beginning. Parcel 3 - A strip of ground being all of that part of a certain easement created by instrument recorded in Deed Book 5600, Page 26, as amended by instrument recorded in Deed Book 8345, Page 716, which underlies any part of Unit 78 of "BEAU JARDIN TOWNHOMES, A CONDOMINIUM" (Plat Book 277, Pages 89 through 95), and being part of Lot "C" of the "BOUNDARY ADJUSTMENT PLAT OF SEVERAL PARCELS OF LAND COMPRISING BEAU JARDIN" (Plat Book 277, Pages 81 and 82), and being in Section 36, Township 46 North, Range 5 East, St. Louis County, Missouri, and being more particularly described as: Commencing at the intersection of the West line of the aforesaid Lot "C" of the "BOUNDARY ADJUSTMENT PLAT OF SEVERAL PARCELS OF LAND COMPRISING BEAU JARDIN" with the South line of Corbeil Drive, a 50 foot wide private drive established by Plat Book 118, Page 71; thence along said West line of Lot "C" South 31Ε27'56" East 12.57 feet; thence leaving said West line of Lot "C" South 89Ε24'10" East 50.66 feet; thence South 00Ε13'40" West 80.13 feet; thence South 89Ε21'10" East 173.19 feet to a point in the West face of a 2 story brick attached townhome known as Unit 78 of the aforesaid "BEAU JARDIN TOWNHOMES, A CONDOMINIUM," which point is the actual point of beginning; thence South 89Ε21'10" East 29.52 feet to 3 a point in the East face of said Unit 78; thence along said East face of Unit 78 South 00Ε42'46" West 10.00 feet; thence North 89Ε21'10" West 29.52 feet to a point in the aforesaid West face of Unit 78; thence along said West face of Unit 78 North 00Ε42'14" East 10.00 feet to the actual point of beginning. Parcel 4 - A strip of ground being all of that part of a certain easement created by instrument recorded in Plat Book 119, Page 16, as amended by instrument recorded in Deed Book 8345, Page 714, which underlies any part of Unit 78 of "BEAU JARDIN TOWNHOMES, A CONDOMINIUM" (Plat Book 277, Pages 89 through 95), and being part of Lot "C" of the "BOUNDARY ADJUSTMENT PLAT OF SEVERAL PARCELS OF LAND COMPRISING BEAU JARDIN" (Plat Book 277, Pages 81 and 82), and being in Section 36, Township 46 North, Range 5 East, St. Louis County, Missouri, and being more particularly described as: Commencing at the intersection of the West line of the aforesaid Lot "C" of the "BOUNDARY ADJUSTMENT PLAT OF SEVERAL PARCELS OF LAND COMPRISING BEAU JARDIN" with the South line of Corbeil Drive, a 50 foot wide private drive established by Plat Book 188, Page 71; thence along said West line of Lot "C" South 31Ε27'56" East 12.57 feet; thence leaving said West line of Lot "C" South 8910" East 50.66 feet; thence South 00Ε13'40" West 80.13 feet; thence South 89Ε21'10" East 173.19 feet to a point in the West fact of a 2 story brick attached townhome known as Unit 78 of the aforesaid "BEAU JARDIN TOWNHOMES, A CONDOMINIUM," which point is the actual point of beginning; thence along said West face of Unit 78 North 00Ε42'14" East 7.50 feet; thence South 89Ε21'10" East 29.52 feet to a point in the East face of said Unit 78; thence along said East face of Unit 78 South 00Ε42'46" West 17.50 feet; thence North 89Ε21'10" West 29.52 feet to a point in the aforesaid West face of Unit 78; thence along said West face of Unit 78 North 00Ε42'14" East 10.00 feet to the actual point of beginning. 4 The foregoing Ordinance was adopted March 21, 1989.
