AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN A R-2, ONE -FAMILY RESIDENTIAL
DISTRICT, OF ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE
OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968.
BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as
follows:
SECTION 1. As provided in Article 20, Section 20.122, and in Article 40 of
Ordinance No. 2325-1968, commonly known as the Zoning Ordinance of the City
of Richmond, Indiana, the following described use of the following described
real estate is allowed as a Special Use for a Children's Day -Care School
located at 1851 South West "A" Street in the City of Richmond, Indiana; more
particularly described; to -wit:
A part of the northeast quarter of section one (1), township thirteen
(13) north, range two (2) west in the City of Richmond, County of
Wayne, and State of Indiana; more particularly described as follows:
Beginning at a point three hundred and fifty feet (350) west of the
east line of said quarter section, which said east line is in the
center of Southwest 18th Street, and three hundred twenty five and
eighty eight hundreds feet (325.88) south of the north line of said
quarter section, at the southwest corner of the intersection of
Southwest 19th and Southwest "A" Street, running thence, from said
beginning point, south parallel to the west line of Southwest 18th,
two hundred sixteen feet (216), thence east parallel to the north
line of said section one hundred fifty feet (150), thence north
parallel to the west line two hundred sixteen (216) feet, thence west
one hundred fifty (150) feet to the place of beginning, said area
containing .7438 acre more or less.
SECTION 2. As a condition of the aforesaid Special Use and as an additional
restriction on said use, the following requirements shall hereafter and at
all times be met by owner, leasee or any person, firm or corporation using
such real estate.
1. The outdoor play area shall be enclosed by a fence.
2. The structure for such day-care center shall have
the approval of the following agencies:
a. Administrative Building Council
b. Fire Marshall of the City of Richmond
c. Richmond Bureau of Buildings
d. Wayne County Health Department
e. State Health Department
f. State Welfare Department
3. The parent shall provide a written statement at the
time of admission that his child has not to his know-
ledge been exposed to a communicable disease within
the previous three (3) weeks.
4. There shall be provided a minimum of one and one-half
(1-112) off-street parking spaces for each staff member.
SECTION 3. The Zoning Administrator of the City of Richmond, Indiana, is
hereby authorized and directed, upon enactment and publication of this
Ordinance, to record and approve the issuance of a permit for the establish-
ment of the use herein allowed.
SECTION 4. This Ordinance shall be in full force and effect from and after
its passage and approval by the Mayor, and publication as by law required.
