AN ORDINANCE, confirming a contract with Bates Utility
Company, Inc. for the emergency construction of combined sewers in
Infrastructure Repair No. 1 (23rd & Palm) 89073, in the City of
St. Louis, Missouri, in compliance with Section 9.040 of the Plan
of the District, with an emergency clause.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The contract heretofore let by the
Executive Director to Bates Utility Company, Inc. as the lowest
responsible bidder for the emergency construction of combined
sewers in Infrastructure Repair No. 1 (23rd & Palm) 89073, in the
City of St. Louis, Missouri, with The Metropolitan St. Louis Sewer
District, pursuant to bids received and opened on the 31st day of
March, 1989 and formally executed on the 11th day of April, 1989
by said contractor and by the Executive Director and the
Secretary-Treasurer on behalf of the District is hereby confirmed,
in compliance with Section 9.040 of the Plan of the District.
Section Two. The construction as specified in said
contract is necessary for the preservation of public health, and
must be performed without delay. Accordingly, an emergency exists
within the meaning of the Plan, and this ordinance shall take
effect immediately upon its enactment.
The foregoing Ordinance was adopted April 12, 1989.
