AN ORDINANCE, authorizing the Executive Director and
Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer
District to enter into an agreement with J. H. Berra Construction
Company, Inc. ("Developer") whereby Developer will construct a
trunk line to serve Christopher Winds subdivision as well as other
developments within the Lower Meramec watershed, and whereby
Developer will be entitled to recoup a portion of the costs of the
trunk line for a period not to exceed twenty years.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-
Treasurer are hereby authorized on behalf of The Metropolitan St.
Louis Sewer District to enter into an agreement with J. H. Berra
Construction Company, Inc. ("Developer") whereby Developer will
construct a trunk line to serve Christopher Winds subdivision as
well as other developments within the Lower Meramec watershed, and
whereby Developer will be entitled to recoup a portion of the
costs of the trunk line for a period not to exceed twenty years.
Section Two. The agreement authorized in Section One
of this ordinance shall be comprised of such terms and conditions
as are approved by the Office of the General Counsel of the
District.
The foregoing Ordinance was adopted June 14, 1989.
