AN ORDINANCE to extend the boundaries of The
Metropolitan St. Louis Sewer District and the Fee Fee Trunk Sewer
Subdistrict of The Metropolitan St. Louis Sewer District to
include an area of St. Louis County which could be efficiently
served by the sewer or drainage facilities of the District and the
Fee Fee Trunk Sewer Subdistrict; and
WHEREAS, petitions signed by a majority of the owners
of the land in said area, who are also the owners of more than
one-half of the land area therein, praying for annexation of said
area by The Metropolitan St. Louis Sewer District and by the Fee
Fee Trunk Sewer Subdistrict and setting forth the boundaries of
the area to be annexed have been filed with and received by the
Board of Trustees of The Metropolitan St. Louis Sewer District;
and
WHEREAS, this area adjoins The Metropolitan St. Louis
Sewer District and the Fee Fee Trunk Sewer Subdistrict, and that
the interests of sanitation and public health of the District and
the Subdistrict will be promoted by including the area in their
respective territories;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. That the Board finds that the sewer or
drainage facilities of the District and the Fee Fee Trunk Sewer
Subdistrict can efficiently serve the area described in Exhibit A,
as attached hereto.
Section Two. That petitions signed by a majority of
the owners of the land in said area, who are also the owners of
more than one-half of the land area therein, praying for
annexation of said area by The Metropolitan St. Louis Sewer
District and by the Fee Fee Trunk Sewer Subdistrict and setting
forth the boundaries of the area to be annexed have been filed
with and received by the Board of Trustees of The Metropolitan St.
Louis Sewer District.
Section Three. That the interests of sanitation and
public health of the District and the Fee Fee Trunk Sewer
Subdistrict, as well as the area proposed to be annexed, will be
promoted by including said area in their respective territories.
Section Four. That the sewage flow from the area
proposed to be annexed has no other available adequate sewer
outlet or treatment facility.
Section Five. That the Board of Trustees, after
examination and consideration of the facts, hereby grants the
petition for annexation of said area, and hereby declares that the
corporate boundaries of The Metropolitan St. Louis Sewer District
and the Fee Fee Trunk Sewer Subdistrict are hereby respectively
extended so as to include the area described in Exhibit A, as
attached hereto.
Section Six. Certified copies of this Ordinance shall
be filed in the offices of the Recorder of Deeds of St. Louis
County, the Recorder of Deeds of the City of St. Louis and the
Secretary of State.
EXHIBIT A
A tract of land in the North Half of the Northwest
Quarter of Section 12, Township 44 North, Range 3 East, St. Louis
County, Missouri, being the same property conveyed to John Kramer
and Diane Dowling by Deed Book 7399 Page 1732, and being more
particularly described as:
Beginning at an old stone marking the Southeast corner
of Lot "A" of the "BOUNDARY ADJUSTMENT PLAT OF LOTS 1 THRU 6 OF
GROVER HEIGHTS" (Plat Book 283, Page 34); thence along the
Southerly projection of the East line of said Lot "A" South 00o
33' 36" West 200.00 feet to an iron pipe; thence South 89o 55' 03"
West 299.66 feet to an iron pipe in the East line of East Avenue,
30 feet wide; thence along said East line of East Avenue North 00o
29' 23" East 200.00 feet to the Southwest corner of the aforesaid
Lot "A", from which point an old stone bears South 61o 54' East
0.32 feet; thence leaving said Southwest corner of Lot "A" along
the South line of said Lot "A" North 89o 55' 03" East 299.90 feet
to the point of beginning and containing 1.3763 acres more or
less; all according to survey order number 89-06-1011 made by The
Sterling Engineering and Surveying Company, Inc. during June 1989.
The foregoing Ordinance was adopted August 9, 1989.
