HomeMy Public PortalAbout07897 O R D I N A N C E NO. 7897 AN ORDINANCE, vacating portions of sewer easements and all right, title or interest of the District in various roads in Lots 3, 4, 5, 6, 7, 8, 42 and 43 of Rock Road Industrial Center in part of Sections 22, 27 and 28 in Township 46 North, Range 6 East in St. Louis County, Missouri. WHEREAS, the owner of the subject property has requested this District to vacate the portions of subject easements, and all right, title or interest that it may have in various roads, and has granted to the District suitable alternate easements and a roadway easement, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The following described portions of sewer easements and all right, title or interest in various roads are hereby vacated, to wit: Twelve parcels of land located in Lots 3, 4, 5, 6, 7, 8, 42 and 43 of Rock Road Industrial Center in part of Sections 22, 27 and 28 in Township 46 North, Range 6 East in St. Louis County, Missouri. Parcel 1 being a portion of a ten (10) foot wide easement in Rock Road Industrial Center as recorded in Plat Book 142, Pages 2 and 3 of the St. Louis County Records. Parcel 2 being part of a five (5) foot wide easement in said Rock Road Industrial Center. Parcel 3 being part of a ten (10) foot wide easement in said Rock Road Industrial Center. Parcel 4 being part of a ten (10) foot wide easement in said Rock Road Industrial 2 Center. Parcel 5 being part of an irregular width easement in said Rock Road Industrial Center. Parcel 6 being part of a five (5) foot wide easement in said Rock Road Industrial Center. Parcel 7 being part of a twenty (20) foot wide easement in said rock Road Industrial Center. Parcel 8 being part of a triangle easement in said Rock Road Industrial Center. Parcel 9 being part of a five (5) foot wide easement in said Rock Road Industrial Center. Parcel 10 being part of a ten (10) foot wide easement in said Rock Road Industrial Center. Parcel 11 being part of a fifteen (15) foot wide easement in said Rock Road Industrial Center. Parcel 12 being a portion of Rockbridge Industrial Drive and Beltline Industrial Drive both sixty (60) feet wide in Rock Road Industrial Center. Parcel 1 (Lots 4 & 5) Part of a ten (10) foot easement originally recorded in the aforesaid Rock Road Industrial Center subdivision plat and being five (5) feet in width, adjacent to, parallel with and on either side of the following described centerline: Beginning at the Southeastern property corner of Lot 5 of the subject subdivision, said point also being the Northeastern property corner of Lot 4 of said subdivision; thence North 82 degrees, 54 minutes, 30 seconds West along the Southern property line of said Lot 5 of distance of 160 feet to a point; thence, departing from the southern property line of said Lot 5 along a line North 37 degrees 54 minutes 30 seconds West a distance of 99 feet to a point of ending of the aforedescribed easement centerline. Parcel 2 (Lots 3, 4, 5 and 6) Part of a five (5) foot wide easement originally recorded in the aforesaid Rock Road Industrial Center subdivision plat and being five (5) feet in width, adjacent to, parallel with and Westwardly/Southwardly of the following described Easterly/Northerly property lines 3 respectively: Beginning at a point of intersection of the Easterly property line of Lot 3 of the subject subdivision and the Westerly right of way line of Interstate Highway 170; thence along the Easterly property line of said Lot 3 North 07 degrees 05 minutes 30 seconds East a distance of 6.15 feet to the Northeasterly property corner of said Lot 3; thence, North 07 degrees 05 minutes 30 seconds East along the Easterly property line of Lot 4 of the subject subdivision a distance of 207 feet to the Northeasterly property corner of said Lot 4; thence, North 07 degrees 05 minutes 30 seconds East along the Easterly property line of Lot 5 of the subject subdivision a distance of 207 feet to the Northeasterly property corner of said Lot 5; thence, along the Easterly and Northerly property lines of Lot 6 of the subject subdivision the following courses and distances - North 07 degrees 05 minutes 30 seconds East a distance of 131.26 feet to a point; thence, Northwardly along a curve to the left, whose radius point bears North 82 degrees 54 minutes 30 seconds West a distance of 100 feet, an arc distance of 157.08 feet to a point; thence, along the Northern property line of said Lot 6 North 82 degrees 54 minutes 30 seconds West a distance of 130 feet to the point of ending of the aforedescribed easement. Parcel 3 (Lots 43 & 42) Part of a ten (10) foot wide easement originally recorded in the aforesaid Rock Road Industrial Center subdivision plat and being five (5) feet in width, adjacent to, parallel with and on either side of the following described easement centerline: Beginning at the Northwesterly property corner of Lot 43 of the subject subdivision, said point also being the Southwestern property corner of Lot 42; thence, South 82 degrees 54 minutes 30 seconds East along the Northern property line of Lot 43 to a point of intersection of said line with the Western right-of-way line of Interstate Highway 170, being the point of ending of the aforedescribed easement. Parcel 4 (Lots 43 & 42) Part of a ten (10) foot wide easement originally recorded in the aforesaid Rock Road Industrial Center subdivision plat and being ten (10) feet in width, adjacent to, parallel with and Eastwardly of the following described property lines: Beginning at the point of intersection of the Western property line of Lot 43 of the subject 4 subdivision and the Western right-of-way line of Interstate Highway 170; thence, North 07 degrees 05 minutes 30 seconds East along the Western property line of said Lot 43 a distance of 147.30 feet to the Northwestern property corner of said Lot 43; thence, North 07 degrees 05 minutes 30 seconds East along the Western property line of Lot 42 of the subject subdivision a distance of 200 feet to a point of ending of the aforedescribed easement. Parcel 5 (Lot 42) Part of an easement originally recorded in the aforesaid Rock Road Industrial Center subdivision plat and being described as follows: Commencing at the Southwesterly property corner of Lot 42 of the subject subdivision; thence, North 07 degrees 05 minutes 30 seconds East along the Westerly property line of said Lot 42 a distance of 200 feet to the point of beginning of the following described easement; thence, Eastwardly along a curve to the right whose radius point bears South 82 degrees 54 minutes 30 seconds East a distance of 30 feet, an arc length of 47.12 feet to a point on the Northern property line of said Lot 42; thence, South 07 degrees 05 minutes 30 seconds West a distance of 5 feet to a point; thence South 45 degrees 45 minutes 5 seconds West a distance of 32.02 feet to a point; thence, North 82 degrees 54 minutes 30 seconds West a distance of 10 feet back to the point of beginning and the point of ending of the aforedescribed easement. Parcel 6 (Lot 41 and 42) Part of a five (5) foot wide easement originally recorded in the aforesaid Rock Road Industrial Center subdivision plat and being five (5) feet in width, adjacent to, parallel with and southwardly of the following described property lines: Beginning at the point of intersection of the Northern property line of Lot 41 of the subject subdivision and the Western right-of-way line of Interstate Highway 170; thence, North 82 degrees 54 minutes 30 seconds West along the Southern line of Beltline Industrial Drive, being the Northern property lines of Lots 41 and 42 of the subject subdivision, a distance of 204.83 feet to the point of ending of the aforedescribed easement. Parcel 7 (Lots 42 & 41) Part of a twenty (20) foot wide easement originally recorded 5 in the aforesaid Rock Road Industrial Center subdivision plat and being ten (10) feet in width, adjacent to, parallel with and lying on either side of the following described centerline: Beginning at the Northeast property corner of Lot 42 of the subject subdivision; thence, South 07 degrees 05 minutes 30 seconds West along the Eastern property line of said Lot 42 a distance of 113.17 feet more to its point of intersection with the Western right-of-way line of Interstate Highway 170, being the point of ending of the aforedescribed easement. Said easement to extend from the Northern property lines of Lots 42 and 41 to the Western right-of-way line of said I-170. Parcel 8 (Lot 41) Part of an easement originally recorded in the aforesaid Rock Road Industrial Center subdivision plat and described as follows: Commencing at the Northwestern property corner of Lot 41 of the subject subdivision; thence, South 82 degrees 54 minutes 30 seconds East along the Northern property line of said Lot 41 a distance of ten (10) feet to the point of beginning of the following described easement; thence South 82 degrees 54 minutes 30 seconds West a distance of 10 feet to a point; thence, South 09 degrees 57 minutes 14 seconds West a distance of 80.26 feet to a point of intersection of said line with the Western right-of-way of Interstate 170 (I-170); thence, South 32 degrees 56 minutes 37 seconds West along said Western right-of-way of I-170 a distance of 13.74 feet to a point; thence, departing said Western right-of-way of I-170 North 07 degrees 05 minutes 30 seconds East a distance of 92.53 feet back to the point of beginning, being the ending point of the aforedescribed easement. Parcel 9 (Lot 8 & 7) Part of a five (5) foot wide easement originally recorded in the aforesaid Rock Road Industrial Center subdivision plat and being five (5) feet in width, adjacent to, parallel with and Northwardly of the following described property line: Beginning at the point of intersection of the Southern property line of Lot 8 of the subject subdivision and the Western right-of-way line of Interstate Highway 170 (I-170); thence, North 82 degrees 54 minutes 30 seconds West along the Southern property line of Lot 8 a distance of 67.45 feet to the Southwestern property corner of said Lot 8; thence, North 82 degrees 54 minutes 30 seconds West 6 along the Southern property line of Lot 7 of the subject subdivision a distance of 170 feet to a point; thence, along a curve to the right, whose radius point bears North 07 degrees 05 minutes 30 seconds East a distance of 30 feet, an arc distance of 47.12 feet to a point; thence, North 07 degrees 05 minutes 30 seconds East a distance of 20 feet to a point; thence, along a curve to the left, whose radius point bears North 82 degrees 54 minutes 30 seconds West a distance of 150 feet, an arc distance of 235.62 feet to a point of intersection of said curved line with the Northern property line of said Lot 7, said point of intersection being the point of ending of the aforedescribed easement. Parcel 10 (Lot 8) Part of a ten (10) foot wide easement originally recorded in the aforesaid Rock Road Industrial Center subdivision plat and being five (5) feet in width, adjacent to, parallel with and on either side of the following described centerline: Commencing at the Southwestern property corner of Lot 8 of the subject subdivision; thence, North 07 degrees 05 minutes 30 seconds East along the Western property line of said Lot 8 a distance of 20 feet to the point of beginning of the following described easement centerline; thence, South 67 degrees 58 minutes 37 seconds East a distance of 67.45 feet to a point of intersection of said line with the Western right-of-way line of Interstate Highway 170, said point of intersection being the ending point of the aforedescribed easement centerline. Parcel 11 (Lot 8 & 7) Part of a fifteen (15) foot wide easement originally recorded in the aforementioned Rock Road Industrial Center subdivision plat and being fifteen (15) feet in width, adjacent to, parallel with and Southwardly of the following described property lines: Beginning at the point of intersection of the Northern property line of Lot 8 of the subject subdivision with the Western right-of-way line of Interstate Highway 170; thence, along the Northern property line of said Lot 8 the following courses and distances - North 77 degrees 03 minutes 08 seconds West a distance of 39.85 feet to a point; thence, North 82 degrees 54 minutes 30 seconds West a distance of 465.80 feet to the Northwestern property corner of Lot 7 of the subject subdivision, said property corner being the point of ending of the 7 aforedescribed easement. Parcel 12 - ROCKBRIDGE INDUSTRIAL DRIVE AND BELTLINE INDUSTRIAL DRIVE Part of an ingress-egress easement across Rockbridge Industrial Drive and Beltline Industrial Drive, private streets, originally recorded in the aforesaid Rock Road Industrial Center subdivision plat and described as follows: Beginning at the Southwestern corner of property conveyed to St. Louis County by Deed recorded in Book 4521, Page 561 of the St. Louis County Records; thence, along the Northern/Eastern right-of-way lines of Rockbridge Industrial Drive the following courses and distances: South 82 degrees 54 minutes 30 seconds East along the Southern line of said property conveyed to St. Louis County, also being the Northern right-of-way line of Rockbridge Industrial Drive, a distance of 310 feet to the Northwestern property corner of Lot 7 of the subject subdivision; thence, Southwardly along a curve to the right, whose radius point bears North 82 degrees 54 minutes 30 seconds West a distance of 150 feet, an arc distance of 235.62 feet to a point; thence South 07 degrees 05 minutes 30 seconds West along the Eastern line of Rockbridge Industrial Drive a distance of 20 feet to a point; thence, departing the Eastern right-of-way line of Rockbridge Industrial Drive, Eastwardly along the Northern right-of-way line of Beltline Industrial Drive the following courses and distances: thence, along a curve to the left, whose radius point bears South 82 degrees 54 minutes 30 seconds East a distance of 30 feet, an arc distance of 47.12 feet to a point; thence, South 82 degrees 54 minutes 30 seconds East a distance of 233.91 feet to a point of intersection with the Western right-of-way line of Interstate Highway 170 (I-170); thence South 32 degrees 56 minutes 37 seconds West along the Western right-of-way of I-170 a distance of 66.72 feet to a point; thence, departing the Western right-of-way line of I-170 along the Southern right-of-way line of Beltline Industrial Drive the following courses and distances: thence, North 82 degrees 54 minutes 30 seconds West a distance of 54.83 feet to the Northwestern property corner of Lot 41 the subject subdivision; thence, North 82 degrees 54 minutes 30 seconds West a distance of 150 feet to a point; thence, along a curve to the left, whose radius point bears South 07 degrees 05 minutes 30 seconds West a distance of 30 feet, an arc distance of 8 47.12 feet to a point; thence, departing the Southern right-of-way line of Beltline Industrial Drive, along the Eastern right-of-way line of Rockbridge Industrial Drive, South 07 degrees 05 minutes 30 seconds West a distance of 347.30 feet to a point of intersection with the Western right-of-way line of said I-170; thence, South 50 degrees 11 minutes 37 seconds West along the Western right-of-way line of said I-170 a distance of 87.81 to a point; thence, North 07 degrees 05 minutes 30 seconds East along the Western right-of-way line of Rockbridge Industrial Drive a distance of 551.41 feet to a point; thence, along a curve to the left, whose radius point bears North 82 degrees 54 minutes 30 seconds West a distance of 100 feet, an arc distance of 157.08 feet to a point; thence, North 82 degrees 54 minutes 30 seconds West along the Southern right-of-way line of Rockbridge Industrial Drive a distance of 300 feet to a point on the Eastern right-of-way line of Endicott Avenue 50 feet in width, thence, along said Eastern right-of-way line North 07 degrees 05 minutes 30 seconds East a distance of 50 feet back to the point of beginning, being the ending point of the aforedescribed easement. 9 The foregoing Ordinance was adopted October 11, 1989.
