PRESENT: Chairman Melanie Shirling, Member Roy Hobbs, Member Dee Johnson, Member John Lott, Member Jake Lindsay, Member Bette Lovinus and Clerk Shara Roberts. ABSENT: None. VISITORS: Council Member Rob Geray, Council President Dan Gubler, and Mayor Brad Andersen. Chairman Melanie Shirling welcomed everyone and Member Jake Lindsay led with the Pledge of Allegiance. Minutes Approved: Member Dee Johnson moved to approve the minutes as corrected. Member Roy Hobbs seconded the motion. All were in favor, motion carried. Chairman Melanie Shirling made a motion to add to the agenda the new ordinance passed by City Council on November 17th regarding the storage of recreational vehicles on patio homes. Member Jake Lindsay seconded the motion. All in favor, motion carried. Feedback on Amending Section 11-4A-11 Prohibiting Storage of Recreational Vehicles upon Patio Homes in the (R-T) Zone: Member Bette Lovinus provided a handout. In the interest of keeping consistency in the Iona City Codes as stated in Chapter 4A, Residential Townhouse (R-T) Zone 11-4A-4 (B) and Chapter 5, Residential (R-2) Zone 11-5-4 (A) regarding the prohibited use for storage of Recreational Vehicles she would like to recommend amending it to be replaced with the following: PROHIBITED USES: Storage of Recreational Vehicles: Recreational vehicles shall not be stored within the area located between the front face set back line and nearest edge of the public street upon which the lot fronts, provided however recreational vehicles may be parked up the front driveway for a cumulative period not to exceed twenty-four (24) hours within any period of seven (7) consecutive days. Council Member Rob Geray located at 3108 N. Ashwood acknowledged that Member Lovinus brought up a valid point. He explained that City Council wasn't aware of the existing prohibition in the RT Zone which includes patio homes as well. However, reading through the prohibited uses in the RT Zone it only refers to the front face setback line and nearest edge of the public street. He further explained the ordinance recently passed, expanded the prohibition to include the side of the house because of the narrow property lines. Council President Dan Gubler commented during the City Council meeting it was discussed the ordinance wasn't perfect, and would need to be revisited for possible language changes in the future. Chairman Melanie Shirling entertained a motion. Member Bette Lovinus made a motion to recommend revising the language regarding the time period from 2 hours to 24 hours. Member Lindsay seconded the motion to recommend. All in favor, motion carried. 1 Area of Impact Discussion: Member Roy Hobbs explained they were planning for County Commissioner Steve Serr and Roger Christensen to come to their regularly scheduled meeting on January 13th to discuss the Area of Impact Agreement. He provided a document from the City of Idaho Falls that outlines the timeframe and different phases they are currently working through in regards to their agreement with the County. The County looks for how the City is able to service the area with utilities, and identify what the zone rating is. Member Hobbs commented that the City will need to acquire a letter from Iona Bonneville Sewer District (IBSD) stating they will provide the sewer services for our Impact Area. In addition, the City will need to determine their ability to supply water services. Member Jake Lindsay inquired if a special meeting aside from the regularly scheduled meetings to cover the Impact Area Agreement was needed. After further discussion, it was determined a special work meeting would be necessary. Council President Gubler also suggested holding an additional meeting for awareness and education to allow the public to comment on the proposal they will be presenting to the County. Chairman Melanie Shirling requested Clerk Roberts to provide copies of the original zoning map, including the impact area and enlarge them to 11 x 17 for easier viewing. Clerk Roberts clarified the Commission would not be meeting with the County Commissioners during the meeting on January 13th. Chairman Melanie Shirling will do a follow up call with Steve Serr to let him know the City will get back with him at a later time. Member Jake Lindsay suggested recruiting a member of the Commission that represents the Impact Area Agreement. Chairman Melanie Shirling agreed, and would like to see the person recruited before Member Lovinus resigns in March. Chairman Melanie Shirling entertained a motion. Member Lindsay moved to make a motion for the special work meeting to be held on Thursday January 7th at 6:30 pm to discuss the Impact Area Agreement. Member Johnson seconded motion. (2) For the purposes of this section, the term "recreational vehicle" shall have the following meaning: A motor home, travel trailer, fifth wheel trailer, truck camper or camping trailer, with or without motive power, designed for human habitation for recreational or emergency occupancy. Such term shall include school buses or van -type vehicles which have been converted into temporary living quarters for recreational use. Council meets to become familiar with AOI process and law. Reviews existing agreement. Identities objectives and potential issues. Discusses relevant policies. • City Council and County Commission: (67-6526(e)) Governing bodies meet jointly to develop scope of work, work plan, and determine each jurisdiction's responsibilities. Scope should include at least: • Identification of issues to be addressed • Identify data needed for analysis • Establish a timeline and schedule, process (i.e. where will any joint meetings be held, who will chair, etc) • Define the process, timeframe for public involvement • Staff: Staff begins background work. Studies issues, reviews other agreements across state, compares City and County plans and ordinances and development standards, gathers data on growth patterns, utility service areas, etc. Provides reports as requested by governing body. PHASE II: • Planning Commissions: (67-6526(e)) Joint Planning Commission meetings to develop recommendations for: • Area of Impact map • Area of Impact land use plan • Codes to be used in Area of Impact • Public involvement period • Staff and Planning Commissions: Work with service providers to review plans and capacities for future service areas • Planning Commission: Planning Commissions make recommendations to respective governing bodies • City Council and County Commission: Governing bodies meeting jointly periodically (or regularly) during Phase II to discuss issues and keep informed about progress of Planning Commissions PHASE Ill: • City Council, County Commission, and Staff: (67-6526) Prepare separate ordinances for Area of Impact Map and which codes and plans will apply within the area • Planning Commissions: (67-6509) Public hearing with each jurisdiction's Planning Commission to make final recommendation to Council • City Council, County Commission, and Staff: Prepare agreement for implementation and enforcement of Area of Impact ordinances • City Council and County Commission: (67-6509) Public hearing by the governing body of each jurisdiction to approve and adopt the ordinances and agreement • Planning Commissions: Planning Commissions continue to meet jointly every quarter to stay informed of planning and land use issues in each jurisdiction.
