HomeMy Public PortalAbout08121��������������*���_ R D I N A N C E NO. 81216r AN ORDINANCE, authorizing and directing the Executive Director and Secretaryi�Treasurer on behalf of The Metropolitan St. Louis Sewer District to sell and convey to the Missouri Highway and Transportation Department certain unimproved real property of the District in St. Louis County, Missouri and a permanent easement for the reconstruction of Route N (Florissant Road), and prescribing the terms of said transaction. WHEREAS, the Missouri Highway and Transportation Department requires said real property of the District and permanent easement for the reconstruction of Route N (Florissant Road), and is empowered to acquire same through the exercise of eminent domain, and WHEREAS, based upon the recommendation of the Executive Director, the Board of Trustees of The Metropolitan St. Louis Sewer District hereby finds that said real property is no longer necessary or useful in the District's operations, and accordingly, declares said real property as surplus, and WHEREAS, the Board further finds that the value of said surplus real property is not sufficient to meet the administrative costs of disposal, and that the sale of said surplus real property is in the best interests of the District, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: �|ection One.�0 The Executive Director and Secretaryj�Treasurer on behalf of The Metropolitan St. Louis Sewer District��h�� are hereby authorized and directed to sell and convey to the Missouri Highway and Transportation Department certain unimproved real property of the District in St. Louis County, Missouri and a permanent easement for the reconstruction of Route N (Florissant Road), said real property being described as follows: {carcel 5�0�oart of a tract of land in that part of Lot 3 in Block 3 of Patricia Park, according to plat recorded in Plat Book 33, Page 3 of the St. Louis County Records, deed description to govern.��E �� {carcel 7A�0�oart of a tract of land located partly in Lot 2, in part of Block 5 of Ferguson Heights, according to the plat thereof recorded in Plat Book 7, Page 91 and also located partly in Lot Four (4) in Block Three (3) in Patricia Park, a subdivision according to the plat thereof recorded in Plat Book 33, Page 3. The tract of land is set out by Deeds recorded in Book 1551, Page 496, Book 1820, Page 197, Book 1711, Page 588, Book 1710, Page 552, Book 1743, Page 146 and Book 1768, Page 23. Also, a permanent easement in a tract of land as set out in the aforementioned Deeds of Parcel 7A. The deed description shall govern for Parcel 7A.゙E ゙ 粘ection Two.・ The Executive Director and SecretaryワdワォTreasurer are hereby authorized and directed on behalf of The Metropolitan St. Louis Sewer District to execute and deliver a General Warranty Deed and any and all other documents as approved by the office of the General Counsel of the District as may be necessary to effect the sale and conveyance as authorized in Section One above. The foregoing Ordinance was adopted July 24, 1990.
