HomeMy Public PortalAbout08172������*���_ R D I N A N C E NO. 81726r AN ORDINANCE, declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District for the purpose of permitting construction of sanitary sewers in the project known as Coldwater Creek Outfall Sewer Phase I 86065 to serve the needs of residents of the area, and authorizing the acquisition of such easements by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of St. Louis County within the Coldwater Creek Watershed wherein live and work numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by constructing sanitary sewers over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: �|ection One.�0 In order to protect the public health and relieve insanitary and dangerous conditions, it is necessary to��h�� appropriate and acquire by the exercise of eminent domain or otherwise permanent and temporary easements for the construction, reconstruction, maintenance or repair of sewer lines as hereinafter set forth, and the right of ingress and egress over the premises sought to be condemned for access to such easements, said permanent and temporary easements being more particularly described as follows: ������*����  ��Temporary Ingress and Egress Easement�0��*��George H. Musterman, Inc. Pension Plan Property�0��*&��06F330011�0��*&��Parcel #8�0 A 30.00 foot wide temporary ingress and egress easement across a tract of land in U.S. Survey 1012, Township 47 North i� Range 7 East in St. Louis County, Missouri, said centerline of 30.00 foot wide temporary ingress and egress easement being more particularly described as follows: Commencing at the northwest corner of property conveyed to George H. Musterman, Trustee for the George H. Musterman, Inc. Pension Plan by deed recorded in Book 8202 Page 552 of the St. Louis County, Missouri Recorder's Office, said commencing point being the Northeast corner of Park Area IV of the Fox Manor Plat IA Subdivision according to the plat recorded in Plat Book 140, Page 31 of the St. Louis County, Missouri Recorder's Office; thence along the North line of said Musterman property, North 86 degrees 49 minutes 03 seconds East a distance of 825.04 feet to the ACTUAL POINT OF BEGINNING of the centerline of said 30.00 foot wide temporary ingress and egress easement, said point of beginning being the point of curvature of a curve to the right having a radius of 45.00 feet and a chord bearing South 41 degrees 53 minutes 04 seconds West; thence along said curve an arc distance of 70.81 feet, having a chord distance of 63.55 feet, to the point of tangency; thence continuing along said centerline South 86 degrees 48 minutes 11 seconds West a distance of 67.47 feet to a point; thence South 87 degrees 56 minutes 37 seconds West a distance of 250.20 feet to a point; thence North 83 degrees 53 minutes 14 seconds West a distance of 155.11 feet to a point; thence South 86 degrees 46 minutes 52 seconds West a distance of 46.73 feet to a point, said point being a point curvature on a curve to the left having a radius of 45.00 feet and a chord bearing South 39 degrees 13 minutes 02 seconds West; thence along said curve an arc distance of 74.71 feet, having a chord distance of 66.42 feet, to the point of tangency; thence continuing along said centerline South 8 degrees 20 minutes 49 seconds East a distance of 214.03 feet to the POINT OF ENDING ofワjワ the centerline of said 30 foot wide temporary ingress and egress easement, said point of ending being distant South 43 degrees 56 minutes 43 seconds East a distance of 365.54 feet from the aforesaid Northeast corner of Park Area IV of the Fox Manor Plat IゥA Subdivision. This temporary ingress and egress easement shall become null and void one (1) year after the sewer construction is complete. チチ 粘ection Two.・ Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. The foregoing Ordinance was adopted September 12, 1990.
