HomeMy Public PortalAbout08173������*���_ R D I N A N C E NO. 81736r AN ORDINANCE, declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District for the purpose of permitting construction of sanitary sewers in the project known as Coldwater Creek Outfall Sewer Phase I 86065 to serve the needs of residents of the area, and authorizing the acquisition of such easements by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of St. Louis County within the Coldwater Creek Watershed wherein live and work numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by constructing sanitary sewers over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: �|ection One.�0 In order to protect the public health and relieve insanitary and dangerous conditions, it is necessary to��h�� appropriate and acquire by the exercise of eminent domain or otherwise permanent and temporary easements for the construction, reconstruction, maintenance or repair of sewer lines as hereinafter set forth, and the right of ingress and egress over the premises sought to be condemned for access to such easements, said permanent and temporary easements being more particularly described as follows: ������*��Coldwater Creek WWTP Outfall Phase I (86065)�0��*��George H. Musterman, Inc. Pension Plan Property�0��*&��06F330011�0��*&��Parcel #8�0 A permanent 20.00 foot wide sewer easement across a tract of land in U.S. Survey 1012, Township 47 North i� Range 7 East in St. Louis County, Missouri, said 20.00 foot wide permanent sewer easement being more particularly described as follows: Commencing at the northwest corner of property conveyed to George H. Musterman, Trustee for the George H. Musterman, Inc. Pension Plan by deed recorded in Book 8202 Page 552 of the St. Louis County, Missouri Recorder's Office, said commencing point also being the Northeast corner of Park Area IV of the Fox Manor Plat Ii�A Subdivision by plat recorded in Plat Book 140 Page 31 of the St. Louis County, Missouri Recorder's Office; thence along the North line of said Musterman property, North 86 degrees 49 minutes 03 seconds East a distance of 528.15 feet to a point; thence leaving said property line South 43 degrees 05 minutes 23 seconds West a distance of 400.81 feet to the ACTUAL POINT OF BEGINNING of said 20.00 foot wide permanent easement, said point also being the point of curvature of a curve to the right having a radius of 900.00 feet and a chord bearing South 55 degrees 20 minutes 40 seconds West; thence along said curve an arc distance of 384.99 feet, a chord distance of 382.06 feet to the point of tangency; thence South 67 degrees 35 minutes 58 seconds West a distance of 139.69 feet to the POINT OF ENDING of said 20.00 foot wide permanent easement, said point being distant South 51 degrees 58 minutes 53 seconds East a distance of 81.18 feet from a southwestern corner of said Musterman property; EXCEPTING THEREFROM that part of an existing 10.00 foot wide permanent sewer easement recorded in Book 8306 Page 2334 of the St. Louis County, Missouri Recorder's Office. Also a permanent working room easement for use during theワjワ construction, reconstruction, maintenance or repair of any sewer in the above described permanent 20.00 foot wide sewer easement and being located across said Musterman property as recorded in Book 8202, Page 552 of the St. Louis County Recorder's Office, said permanent working room easement being more particularly described as follows: Commencing at the northwest corner of said Musterman property; thence along the north line of said Musterman property, North 86 degrees 49 minutes 03 seconds East a distance of 582.15 feet to a point; thence South 43 degrees 05 minutes 23 seconds West a distance of 350.81 feet to the ACTUAL POINT OF BEGINNING of the centerline of a 100.00 foot wide permanent working room easement; thence along said centerline, South 43 degrees 05 minutes 23 seconds West a distance of 50.00 feet to a point of curvature of a curve to the right having a radius of 900.00 feet and a chord bearing South 44 degrees 38 minutes 53 seconds West; thence along said curve and along said centerline an arc distance of 50.00 feet, having a chord distance of 49.99 feet to the point of tangency being the POINT OF ENDING of the centerline of said 100.00 foot wide permanent working room easement, said point of ending being the POINT OF BEGINNING of the centerline of a 80.00 foot wide permanent working room easement said point of beginning being the point of curvature of a curve to the right having a radius of 900.00 feet and a chord bearing South 56 degrees 54 minutes and 10 seconds West; thence along said curve and along said centerline an arc distance of 334.99 feet having a chord distance of 333.04 feet to the point of tangency; thence continuing along said centerline, South 67 degrees 35 minutes 58 seconds West a distance of 139.69 feet to the POINT OF ENDING of the centerline of said 80.00 foot wide permanent working room easement; EXCEPTING THEREFROM the above described 20.00 foot wide permanent sewer easement and that part of an existing 10.00 foot wide permanent sewer easement recorded in Book 8306, Page 2334 of the St. Louis County, Missouri Recorder's Office. チチ 粘ection Two.・ Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase if possible, or to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property as hereinabove set out. The foregoing Ordinance was adopted September 12, 1990.
