Wolfner, an individual, certain real property of the District located in St. Louis County, Missouri, and prescribing the terms of said transaction. WHEREAS, the real property hereinafter described has been declared as surplus pursuant to Resolution No. 1902 adopted the 9th day of August, 1989, and WHEREAS, pursuant to Resolution No. 1893, adopted the 10th day of May, 1989, said real property was appraised, publicly advertised for sale and will be sold to the highest bidder for same, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: �|ection One.�0 The Executive Director and Secretaryj�Treasurer on behalf of The Metropolitan St. Louis Sewer District are hereby authorized and directed to sell and convey to Mr. John W. Wolfner, an individual, certain real property of the District located in St. Louis County, Missouri for the total sale price of Ninety Thousand Two Dollars ($90,002.00), said real property being described as follows: �r��A tract of land in U.S. Survey 136, Township 44 North, Range 5 East, and described as: Beginning at a point in the South line of a tract of land heretofore conveyed to Riverside Sewer Company by deed recorded in Book 4576 page 99, said beginning point being distant North 86 degrees 58 minutes East 40 feet from the most��j�� Southwest corner of said tract, which corner is distant South 3 degrees 02 minutes East 1�x�060 feet from the North line of U.S. Survey 136, thence North 3 degrees 02 minutes West 845 feet to a point, thence North 86 degrees 58 minutes East 540.09 feet, more or less, to a point in the center line of Yarnell Road, 40 feet wide, thence South along the centerline of Yarnell Road, 1018.39 feet, more or less, to a point, thence South 86 degrees 58 minutes West 473.75 feet to a point, thence North 3 degrees 02 minutes West 171.94 feet to the point of beginning.��E �� �oogether with (1) all buildings, improvements and structures at any time, now or hereafter, erected, situated or placed thereon; (2) all rights, privileges, easements, hereidatements, appendages and appurtenances thereunto belonging or in anywise appertaining; (3) all right, title, interest and estate of Riverside Sewer Company in and to streets, roads, ways, sidewalks, curbs, alleys, and areas adjoining said real estate and portions thereof, and whether vacated by law or ordinance (conditionally or otherwise); (4) all rents, revenues, income, issues and profits, which are hereby specifically assigned, transferred and pledged primarily and on a parity with said real estate; and (5) all fixtures, equipment, and personalty now or at any time hereafter annexed, affixed or attached to said real estate and/or said buildings, improvements or structures thereon and all other personal property owned by Riverside Sewer Company and used or intended to be used in the possession, occupation or enjoyment thereof, and all replacements, additions and substitutions thereof or thereto.゙E ゙ チチ 粘ection Two.・ The Executive Director and SecretaryェTreasurer are hereby authorized and directed on behalf of The Metropolitan St. Louis Sewer District to execute and deliver a Special Warranty Deed and any and all other documents as approved by the office of the General Counsel of the District as may be necessary to effect the sale and conveyance as authorized in Section One above, and further to deposit the proceeds from said sale and conveyance in the reserve for Real Property Purchase, Improvement and Alterations Account. The foregoing Ordinance was adopted October 3, 1990.
