AN ORDINANCE, appropriating Six Hundred Eighty Thousand Dollars
($680,000.00) from the Operation, Maintenance and Construction Improvement Fund
of the University City Branch of River des Peres to be used for project costs
for the construction of storm sewers in Dunleer-Pennsylvania Phases II & III
(89071), in the City of Pagedale, Missouri; and confirming a contract with
Bates Utility Company, Inc. for the construction of the aforesaid storm sewers,
in compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said storm sewers is Six
Hundred Thirty-three Thousand Seven Hundred Twenty-four Dollars ($633,724.00),
and the cost of engineering, inspection, construction staking, advertisement
costs, easement charges, and allowance for construction change orders is Forty-
six Thousand Two Hundred Seventy-six Dollars ($46,276.00), and
WHEREAS, the State of Missouri has agreed to contribute Two Hundred
Twenty-six Thousand Six Hundred Sixty-six Dollars ($226,666.00) toward the
total costs of said project; upon the receipt of such funds from said source,
said money will be returned to the Operation, Maintenance and Construction
Improvement Fund of the University City Branch of River des Peres,and
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Six Hundred Eighty Thousand Dollars
($680,000.00) is hereby appropriated from the Operation, Maintenance and
Construction Improvement Fund of the University City Branch of River des Peres

to be used for project costs for the construction of storm sewers in Dunleer-
Pennsylvania Phases II & III (89071), in the City of Pagedale, Missouri.
Section Two. The contract heretofore let by the Executive Director
to Bates Utility Company, Inc. as the lowest responsible bidder for the
construction of storm sewers in Dunleer-Pennsylvania Phases II & III (89071),
in the City of Pagedale, Missouri, with The Metropolitan St. Louis Sewer
District, pursuant to bids received and opened on the 15th day of November,
1990 and formally executed on the 11th day of December, 1990 by said contractor
and by the Executive Director and Secretary-Treasurer on behalf of the District
is hereby confirmed, in compliance with Section 9.040 of the Plan of the
District.
Section Three. This ordinance, being an appropriation ordinance,
shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted January 9, 1991.
