HomeMy Public PortalAbout08278 O R D I N A N C E NO. 8278 AN ORDINANCE, appropriating Three Hundred Thousand Dollars ($300,000.00) from the Clean Water Capital Improvement Trust Fund to be used for project costs for the construction of a portion of the Bissell Point Watershed Overflow Regulation System Mill Creek Combined Sewer Rehabilitation (BP-02C, 91010A), in the City of St. Louis, Missouri; and authorizing a contract with Superior Oil Company, Inc. and Missouri Pacific Railroad Company for the construction of a portion of the aforesaid project, WHEREAS, the Mill Creek sewer runs under a contaminated site owned by Superior Oil Company ("Superior") and Missouri Pacific Railroad Company ("MOPAC") and hazardous substances, including dioxin, have been detected in the sewer, and WHEREAS, Superior and MOPAC have agreed to construct the sewer rehabilitation in the contaminated portion taking special precautions to protect the workers from potential health hazards, and WHEREAS, the District has agreed to pay its share of the rehabilitation cost based on the District's direct cost to do the rehabilitation work in the uncontaminated section of the sewer. WHEREAS, pursuant to Section 7.120 of the Plan of the District, the appropriation effected herein will not result in a deficit at the end of the current budget year, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST.LOUIS SEWER DISTRICT: Section One. The sum of Three Hundred Thousand Dollars ($300,000.00) is hereby appropriated from the Clean Water Capital Improvement Trust Fund to be used for project costs for the construction of a portion of 2 the Bissell Point Watershed Overflow Regulation System Mill Creek Combined Sewer Rehabilitation (BP-02C, 91010A), in the City of St. Louis, Missouri. Section Two. The Executive Director is hereby authorized to enter into a contract (in the form of Exhibit A attached hereto), with Superior Oil Company, Inc. and Missouri Pacific Railroad Company for the construction of a portion of the Bissell Point Watershed Overflow Regulation System Mill Creek Combined Sewer Rehabilitation (BP-02C, 91010A) in the City of St. Louis, Missouri. Section Three. This ordinance, being an appropriation ordinance, shall take effect immediately upon its enactment. The foregoing Ordinance was adopted January 9, 1991.
