AN ORDINANCE, appropriating One Hundred Twenty Thousand Dollars
($120,000.00) from the Operation, Maintenance and Construction Improvement Fund
of Maline Creek to be used for project costs for the construction of storm and
sanitary sewers in Kincaid Avenue #2920 (S-1919, C-1341), in the City of St.
John, Missouri; and confirming a contract with Fred M. Luth & Sons, Inc. for
the construction of the aforesaid storm and sanitary sewers, in compliance with
Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said storm and sanitary
sewers is One Hundred One Thousand Nine Hundred Eighty-nine and 60/100 Dollars
($101,989.60), and the cost of engineering, inspection, construction staking,
advertisement costs, easement charges, and allowance for construction change
orders is Eighteen Thousand Ten and 40/100 Dollars ($18,010.40), and
WHEREAS, the State of Missouri has agreed to contribute Thirty-one
Thousand Nine Hundred Sixty-one Dollars ($31,961.00) toward the total costs of
said project; upon the receipt of such funds from said source, said money will
be returned to the Operation, Maintenance and Construction Improvement Fund of
Maline Creek, and
WHEREAS, the City of St. John, Missouri, pursuant to the Housing
and Community Development Act of 1974, has agreed to contribute Thirty Thousand
Eight Hundred Fifteen Dollars ($30,815.00) toward the total costs of said
project; upon the receipt of such funds from said source, said money will be
returned to the Operation, Maintenance and Construction Improvement Fund of
Maline Creek, and

WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of One Hundred Twenty Thousand Dollars
($120,000.00) is hereby appropriated from the Operation, Maintenance and
Construction Improvement Fund of Maline Creek to be used for project costs for
the construction of storm and sanitary sewers in Kincaid Avenue #2920 (S-1919,
C-1341), in the City of St. John, Missouri.
Section Two. The contract heretofore let by the Executive Director
to Fred M. Luth & Sons, Inc. as the lowest responsible bidder for the
construction of storm and sanitary sewers in Kincaid Avenue #2920 (S-1919, C-
1341), in the City of St. John, Missouri, with The Metropolitan St. Louis Sewer
District, pursuant to bids received and opened on the 29th day of November,
1990 and formally executed on the 11th day of December, 1990 by said contractor
and by the Executive Director and Secretary-Treasurer on behalf of the District
is hereby confirmed, in compliance with Section 9.040 of the Plan of the
District.
Section Three. This ordinance, being an appropriation ordinance,
shall take effect immediately upon its enactment.
