AN ORDINANCE, appropriating Sixty Thousand Dollars ($60,000.00)
from the Operation, Maintenance and Construction Improvement Fund of Sugar
Creek to be used for project costs for the construction of storm sewers in
Couch Avenue #363 (85221), in the City of Kirkwood, Missouri; and confirming a
contract with Truss Brothers Construction Inc. for the construction of the
aforesaid storm sewers, in compliance with Section 9.040 of the Plan of the
District.
WHEREAS, the bid for the construction of said storm sewers is
Forty-nine Thousand Nine Hundred Thirteen and 70/100 Dollars ($49,913.70), and
the cost of engineering, inspection, construction staking, advertisement costs,
easement charges, and allowance for construction change orders is Ten Thousand
Eighty-six and 30/100 Dollars ($10,086.30), and
WHEREAS, the State of Missouri has agreed to contribute Twenty
Thousand Dollars ($20,000.00) toward the total costs of said project; upon the
receipt of such funds from said source, said money will be returned to the
Operation, Maintenance and Construction Improvement Fund of Sugar Creek, and
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Sixty Thousand Dollars ($60,000.00) is
hereby appropriated from the Operation, Maintenance and Construction
Improvement Fund of Sugar Creek to be used for project costs for the
construction of storm sewers in Couch Avenue #363 (85221), in the City of

Kirkwood, Missouri.
Section Two. The contract heretofore let by the Executive Director
to Truss Brothers Construction, Inc. as the lowest responsible bidder for the
construction of storm sewers in Couch Avenue #363 (85221), in the City of
Kirkwood, Missouri, with The Metropolitan St. Louis Sewer District, pursuant to
bids received and opened on the 3rd day of December, 1990 and formally executed
on the 11th day of December, 1990 by said contractor and by the Executive
Director and Secretary-Treasurer on behalf of the District is hereby confirmed,
in compliance with Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation ordinance,
shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted January 9, 1991.
