HomeMy Public PortalAbout08290 O R D I N A N C E NO. 8290 AN ORDINANCE, authorizing and directing the Executive Director to grant to Union Electric Company an easement for the operation and maintenance of two electric transmission lines along with service connections and appurtenances thereto over and across certain property of the District known as the River des Peres Drainage Channel, in the City of St. Louis, Missouri, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. WHEREAS, the Union Electric Company has asked the District for the right to construct, operate and maintain said electric transmission lines, over and across certain hereinafter described real property of the District known as the River des Peres Drainage Channel, and the District is desirous of granting such right for the good of the general public, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to the Union Electric Company an easement for the operation and maintenance of two electric transmission lines along with service connections and appurtenances thereto over and across certain real property of the District as hereinafter described in the City of St. Louis, Missouri, such property being described as follows: A trapezium shaped strip of land being part of City Block 3286 in the City of St. Louis, State of Missouri. Said strip is further described as starting at a point in the southwest line of a tract of land in City Block 3221, N/F owned by the City of St. Louis, described in Daily No. 76, dated June 13, 1936, in the Office of the Recorder of Deeds, in the City of St. Louis, Missouri, said point being a distance of one hundred (100) feet south of the southeast line of Alabama Avenue, as measured in a straight line along said southwest line; thence southwestward three hundred forty five (345) feet more or less to a point in the northeast line of 2 Weber Road (40' W), said point being one hundred forty (140) feet south/southeast of the said southeast line of Alabama Avenue, as measured along the east/northeast line of said Weber Road; thence south along said east line a distance of seventy (70) feet to a point; thence northeastward three hundred sixty (360) feet more or less to a point in the southwest line of a tract of land in City Block 3221, N/F owned by the Metropolitan St. Louis Sewer District, described in Daily No. 56, dated April 4, 1974 in the Office of the Recorder of Deeds in the City of St. Louis, Missouri, said point being a distance of forty three (43) feet south of the point of beginning; thence north along the northeast line of the River des Peres Drainage Works as established in Ordinances 32986, 35975 and 39950 of the City of St. Louis, Missouri, to the point of beginning. Section Two. The rights herein granted are limited to such rights as the District may have in the premises concerned and the Union Electric Company shall secure such permission as may be necessary on account of any other existing rights. Section Three. Grantor's right to the use of such property for sewer and drainage purposes is hereby reserved. Section Four. Grantee shall at its own sole cost and expense relocate, change or adjust such portion of its electric transmission system as is reasonably necessary in order to avoid interference with construction and operation of Grantor's facilities in aforesaid property. Section Five. Grantee shall agree to indemnify the Grantor against any claim or damage arriving out of the use of the rights hereby granted. Section Six. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Sections One, Two, Three, Four, and Five hereof. 3 The foregoing Ordinance was adopted February 13, 1991.
