HomeMy Public PortalAbout08292 O R D I N A N C E NO. 8292 AN ORDINANCE, vacating any right, title or interest of the District in an easement and a private road and utility easement in Lots 1, 2, 3 and 5 of Westerly. WHEREAS, the owner of this land has requested that this District vacate any right, title, or interest that it may have in subject easement and a private road and utility easement, and this District has no further use for the easement and a private road and utility easement, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District hereby vacates any right, title or interest that it may have in the following described easement and a private road and utility easement: Three parcels of land located in Westerly as recorded in Plat Book 73, Page 44 of the St. Louis County Records. Parcel 1 being an easement for private roadway and public utility purposes recorded in Deed Book 3262, Page 275 of the St. Louis County Records. Parcel 2 being an easement for road and utility purposes recorded in Deed Book 4125, Page 34 of the St. Louis County Records. Parcel 3 being an easement for a private road and utility access recorded in Deed Book 5340, Page 178 (being the same easement in Deed Book 7654, Page 2159) of the St. Louis County Records. Parcel 1 An easement for private roadway and public utility purposes in and over the southern 25 feet of a tract of land in U.S. Survey 412, Township 45 North, Range 4 East and being part of Lot 1 of the subdivision of the estate of John Blank and described as beginning at a point in the center line of Schoettler Road (40 feet wide) which point is the southeast corner of property conveyed to Earl A. Rood and wife by deed recorded in Book 3205, Page 406 of the St. Louis County Records; thence along the center line of Schoettler Road south 37 degrees 42 minutes east 58.25 feet to a point; thence south 25 degrees 5 minutes east 74.57 feet to a point, thence south 57 degrees 45 minutes west 454.22 feet to a point, thence north 32 degrees 5 minutes west 132 feet to a point which is the southwest corner of said Rood property, thence east along the south line of Rood property 457.90 feet to the point of beginning. Parcel 2 An easement for road and utility purposes on the southern 25 feet tract of land being the northeast quarter of Lot 5 of Westerly, a subdivision recorded in Plat Book 73, Page 44 of the St. Louis County, Missouri records being described as follows: Beginning at an old iron pipe in the northeast corner of said Lot 5 of said subdivision; thence south 32 degrees 5 minutes east 244.55 feet to spike in the center line of a 50 foot wide private road and utility easement; thence south 57 degrees 45 minutes west 534.55 feet to an iron pipe; thence north 32 degrees 5 minutes west 244.55 feet to an iron pipe in the north line of said Lot 5; thence north 57 degrees 45 minutes east 534.55 feet along said north line to the point of beginning. Parcel 3 An easement 25 feet wide established for private road and utility access purposes across the southeastwardly 25 feet of the northeast quarter of Lot 5 of Westerly, according to plat thereof recorded in Plat Book 73, Page 44 of the St. Louis County Records being the same easement reserved by Grantor in deed to Leonard Megginson and wife in Book 4125, Page 34 of the St. Louis County Records. An easement 25 feet wide established for private road and utility access purposes across the northwesterly 25 feet of the southeast half of Lot 5 of Westerly, according to plat thereof recorded in Plat Book 73, Page 44 of the St. Louis County Records, the northwest line of which extending from the northeast line of said Lot 5 and connecting with the road and utility easement there established as shown on said Plat Book 73, Page 44, a distance of 834.55 feet southwesterly along the center line of said Lot 5. 2 An easement 10 feet wide established for utility access purposes only, the center line of which begins at a point in the southeast line of Lot 5 of Westerly, according to plat thereof recorded in Plat Book 73, Page 44 of the St. Louis County Records, 534.55 feet distant from northeast corner of said Lot 5 and runs thence north 32 degrees 5 minutes west 244.55 feet to the southeast corner of the northwest quarter of said Lot 5, being the same 10 foot wide strip of land covered by easement heretofore granted to Union Electric Company in Book 4243, Page 199 thereby connecting said northwest quarter with the 10 foot utility easement established along the southeast line of said Lot 5 as shown on the said Plat Book 73, Page 44. The foregoing Ordinance was adopted February 13, 1991. 3
