AN ORDINANCE, authorizing the Executive Director and Secretary-
Treasurer on behalf of The Metropolitan St. Louis Sewer District to sell and
convey to the City of St. Louis, Missouri certain unimproved real property of
the District in the City of St. Louis, Missouri, and also to grant two
temporary construction easements, for the reconstruction of the Alabama Avenue
Bridge, and prescribing the terms of said transaction.
WHEREAS, the City of St. Louis, Missouri requires real property of
the District and also temporary construction easements for the reconstruction
of the Alabama Avenue Bridge, and is empowered to acquire same through the
exercise of eminent domain, and
WHEREAS, the District is willing to sell and convey said real
property and also to grant the two temporary construction easements to the City
of St. Louis, Missouri for such public use,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and Secretary-Treasurer on
behalf of The Metropolitan St. Louis Sewer District are hereby authorized to
sell and convey to the City of St. Louis, Missouri certain unimproved real
property of the District in the City of St. Louis, Missouri, and also to grant
two temporary construction easements for the reconstruction of the Alabama
Avenue Bridge for the total sale price of One Dollar ($1.00), said real
property and two temporary construction easements being described as follows:
Three parcels of land in the City of St. Louis. Parcel 1C being the real
property in City Block 3287 of the City of St. Louis. Parcel 1B
being a temporary easement in City Block 3287 of the City of St.
Louis. Parcel 1A being a temporary easement in City Block 3286 of
the City of St. Louis.

Parcel 1C:
All that part of Grantor's land located in part of the River des Peres
Drainage Works Right of Way in City Block 3287 of the City of St.
Louis, being more particularly set out pursuant to Ordinance No.
32986, approved April 16, 1924, pertaining to the creation and
establishment of the Right of Way of River des Peres Drainage
Works, under which property was taken by the City of St. Louis by
Condemnation proceedings being Cause No. 83788-B, filed in 1924 in
the Circuit Court of the City of St. Louis and further pursuant to
the "proposed plan of the Metropolitan St. Louis Sewer District,
adopted February 9, 1954 under special election submitted to the
voters of St. Louis County and City of St. Louis recorded in Book
7370 Page 537 and Book 7372 Page 182", and described as follows:
A triangular shaped parcel beginning at Grantor's Southwest
property corner, said point being also the Northeast corner of the
intersection of Alabama Avenue (100 feet wide) and Weber Road (70
feet wide); thence extending Northerly along Grantor's West
property line, said West property line being also the existing East
right of way line of Weber Road, a distance of 61 feet to a point;
thence Easterly after turning an angle of 112 degrees 33 minutes 22
seconds to the right for a distance of 63.24 feet to a point in
Grantor's Southeast property line, said Southeast property line
being also the existing Northwest right of way line of Alabama
Avenue (100 feet wide); thence Southwesterly along Grantor's
Southeast property line a distance of 69.00 feet to the point of
beginning, and containing 1,781 square feet, more or less, of new
right of way.
Parcel 1B:
A temporary easement for the construction and improvement of the Alabama
Avenue Bridge across 60,448 square feet, more or less, of Grantor's
land located in part of River des Peres Drainage Works Right of Way
in City Block 3287 of the City of St. Louis, as set out in the
above described parcel for right of way, described as follows:
Commencing at Grantor's Southwest property corner, said point being
also the Northeast corner of the intersection of Alabama Avenue
(100 feet wide) and Weber Road (70 feet wide); thence Northerly
along Grantor's West property line a distance of 61 feet to the
point of beginning; thence along Grantor's said West property line,
said West property line being also the existing East right of way
line of Weber Road, a distance of 149.00 feet to a point; thence
Easterly after turning an angle of 85 degrees 14 minutes 25 seconds
to the right a distance of 80.28 feet; thence Northerly after
turning an angle of 85 degrees 14 minutes 25 seconds to the left a
distance of 53.31 feet; thence Northerly after turning an angle of
4 degrees 54 minutes 05 seconds to the left a distance of 276.89
feet; thence Northwesterly after turning an angle of 3 degrees 52

minutes 45 seconds to the left a distance of 109.45 feet; thence
Northerly after turning an angle of 12 degrees 56 minutes 50
seconds to the right a distance of 115.51 feet; thence Northerly
after turning an angle of 8 degrees 02 minutes 30 seconds to the
right a distance of 94.08 feet; thence Northwesterly after turning
an angle of 57 degrees 59 minutes 41 seconds to the left a distance
of 94.34 feet; thence Northerly after turning an angle of 57
degrees 59 minutes 41 seconds to the right a distance of 50 feet;
thence Northerly after turning an angle of 4 degrees 46 minutes 30
seconds to the left a distance of 130 feet; thence Easterly after
turning an angle of 90 degrees to the right a distance of 20 feet;
thence Southeasterly after turning an angle of 73 degrees 18
minutes 54 seconds to the right a distance of 248.44 feet; thence
Southerly after turning an angle of 21 degrees 27 minutes 36
seconds to the right a distance of 92.67 feet; thence Southerly
after turning an angle of 8 degrees 02 minutes 30 seconds to the
left a distance of 111.83 feet; thence Southeasterly after turning
an angle of 12 degrees 56 minutes 50 seconds to the left a distance
of 107.86 feet; thence Southerly after turning an angle of 3
degrees 52 minutes 45 seconds to the right a distance of 278.43
feet; thence southerly after turning an angle of 4 degrees 54
minutes 05 seconds to the right a distance of 52.50 feet; thence
Easterly after turning an angle of 94 degrees 45 minutes 35 seconds
to the left a distance of 183.36 feet; thence Southeasterly after
turning an angle of 55 degrees 52 minutes 08 seconds to the right a
distance of 47.46 feet; thence Southwesterly after turning an angle
of 96 degrees 43 minutes 05 seconds to the right a distance of
300.22 feet; thence Westerly to the point of beginning; less and
excepting a 20' x 20' area (400 square feet) being a U.E. Tower
location, located 140 feet North of Grantor's Southwest property
corner, as measured along Grantor's West property line and
adjoining the East right of way line of Weber Road (70 feet wide).
Parcel 1A:
A temporary easement for the construction and improvement of the Alabama
Avenue Bridge across 3,074 square feet, more or less, located in
part of the River des Peres Drainage Works Right of Way in City
Block 3286 of the City of St. Louis, more particularly set out in
the above described parcel for right of way, described as follows:
A tract of land lying on the South side of and adjoining the
existing South right of way line of Alabama Avenue (100 feet wide),
having a uniform width of 10 feet, lying between the East and West
right of way lines of River des Peres Drainage Works.
Upon completion of the construction and improvement of the Alabama Avenue
Bridge, the easement rights in said last described tracts shall
cease and be no longer in effect.

Section Two. The Executive Director and Secretary-Treasurer are
hereby authorized on behalf of The Metropolitan St. Louis Sewer District to
execute and deliver a General Warranty Deed and any and all other documents as
approved by the office of the General Counsel of the District as may be
necessary to effect the sale and conveyance and easement grants as authorized
in Section One above.
The foregoing Ordinance was adopted March 13, 1991.
