AN ORDINANCE, appropriating Two Hundred Two Thousand Five Hundred
Dollars ($202,500.00) from the Operation, Maintenance and Construction
Improvement Fund of Deer Creek to be used for project costs for the
construction of storm sewers in Dickson Court (87190), in the City of Kirkwood,
Missouri; and confirming a contract with Gershenson Construction Company, Inc.
for the construction of the aforesaid storm sewers, in compliance with Section
9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said storm sewers is One
Hundred Seventy Thousand Seven Hundred Seven and 50/100 Dollars ($170,707.50),
and the cost of engineering, inspection, construction staking, advertisement
costs, easement charges, and allowance for construction change orders is
Thirty-one Thousand Seven Hundred Ninety-two and 50/100 Dollars ($31,792.50),
and
WHEREAS, the State of Missouri has agreed to contribute Sixty-seven
Thousand Five Hundred Dollars ($67,500.00) toward the total costs of said
project; upon the receipt of such funds from said source, said money will be
returned to the Operation, Maintenance and Construction Improvement Fund of
Deer Creek, and
WHEREAS, the City of Kirkwood, Missouri has agreed to contribute
Sixty-seven Thousand Five Hundred Dollars ($67,500.00) toward the total costs
of said project; upon the receipt of such funds from said source, said money
will be returned to the Operation, Maintenance and Construction Improvement
Fund of Deer Creek, and
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation

authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Two Hundred Two Thousand Five Hundred
Dollars ($202,500.00) is hereby appropriated from the Operation, Maintenance
and Construction Improvement Fund of Deer Creek to be used for project costs
for the construction of storm sewers in Dickson Court (87190), in the City of
Kirkwood, Missouri.
Section Two. The contract heretofore let by the Executive Director
to Gershenson Construction Company, Inc. as the lowest responsible bidder for
the construction of storm sewers in Dickson Court (87190), in the City of
Kirkwood, Missouri, with The Metropolitan St. Louis Sewer District, pursuant to
bids received and opened on the 6th day of February 1991 and formally executed
on the 12th day of March, 1991 by said contractor and by the Executive Director
and Secretary-Treasurer on behalf of the District is hereby confirmed, in
compliance with Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation ordinance,
shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted April 10, 1991.
