AN ORDINANCE, appropriating Forty-one Thousand Two Hundred Fifty
Dollars ($41,250.00) from the Operation, Maintenance and Construction
Improvement Fund of Maline Creek to be used for project costs for the
construction of storm sewers in Surrey Lane #9847 (85253), in the City of
Bellefontaine Neighbors, Missouri; and confirming a contract with Gershenson
Construction Company, Inc. for the construction of the aforesaid storm sewers,
in compliance with Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said storm sewers is
Thirty-four Thousand Four Hundred Fifty-five Dollars ($34,455.00), and the cost
of engineering, inspection, construction staking, advertisement costs, easement
charges, and allowance for construction change orders is Six Thousand Seven
Hundred Ninety-five Dollars ($6,795.00), and
WHEREAS, the State of Missouri has agreed to contribute Thirteen
Thousand Two Hundred Fifty Dollars ($13,250.00) toward the total costs of said
project; upon the receipt of such funds from said source, said money will be
returned to the Operation, Maintenance and Construction Improvement Fund of
Maline Creek, and
WHEREAS, the City of Bellefontaine Neighbors, Missouri has agreed
to contribute Fourteen Thousand Dollars ($14,000.00) toward the total costs of
said project; upon the receipt of such funds from said source, said money will
be returned to the Operation, Maintenance and Construction Improvement Fund of
Maline Creek, and
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Forty-one Thousand Two Hundred Fifty
Dollars ($41,250.00) is hereby appropriated from the Operation, Maintenance and
Construction Improvement Fund of Maline Creek to be used for project costs for
the construction of storm sewers in Surrey Lane #9847 (85253), in the City of
Bellefontaine Neighbors, Missouri.
Section Two. The contract heretofore let by the Executive Director
to Gershenson Construction Company, Inc. as the lowest responsible bidder for
the construction of storm sewers in Surrey Lane #9847 (85253), in the City of
Bellefontaine Neighbors, Missouri, with The Metropolitan St. Louis Sewer
District, pursuant to bids received and opened on the 6th day of February, 1991
and formally executed on the 12th day of March, 1991 by said contractor and by
the Executive Director and Secretary-Treasurer on behalf of the District is
hereby confirmed, in compliance with Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation ordinance,
shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted April 10, 1991.
