AN ORDINANCE, appropriating Twenty-six Thousand Eight Hundred Fifty
Dollars ($26,850.00) from the Operation, Maintenance and Construction
Improvement Fund of Coldwater Creek to be used for project costs for the
construction of a concrete retaining wall and appurtenances in Emergency Repair
#007 Dix Avenue (91093), in the Village of Breckenridge Hills, Missouri; and
confirming a contract with R.V. Wagner, Inc. for the construction of the
aforesaid concrete retaining wall and appurtenances, in compliance with Section
9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said concrete retaining
wall and appurtenances is Twenty-one Thousand Nine Hundred Seventy-two Dollars
($21,972.00), and the cost of engineering, inspection, construction staking,
easement charges and allowance for construction change orders is Four Thousand
Eight Hundred Seventy-eight Dollars ($4,878.00), and
WHEREAS, the Director of Finance has certified that there is an
unencumbered balance in the above-named fund sufficient to pay the obligation
authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Twenty-six Thousand Eight Hundred Fifty
Dollars ($26,850.00) is hereby appropriated from the Operation, Maintenance and
Construction Improvement Fund of Coldwater Creek to be used for project costs
for the construction of a concrete retaining wall and appurtenances in
Emergency Repair #007 Dix Avenue (91093), in the Village of Breckenridge Hills,
Missouri.
Section Two. The contract heretofore let by the Executive Director

to R.V. Wagner, Inc. as the lowest responsible bidder for the construction of a
concrete retaining wall and appurtenances in Emergency Repair #007 Dix Avenue
(91093), in the Village of Breckenridge Hills, Missouri, with The Metropolitan
St. Louis Sewer District, pursuant to bids received and opened on the 2nd day
of April, 1991 and formally executed on the 9th day of April, 1991 by said
contractor and by the Executive Director and Secretary-Treasurer on behalf of
the District is hereby confirmed, in compliance with Section 9.040 of the Plan
of the District.
Section Three. This ordinance, being an appropriation ordinance,
shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted April 10, 1991.
