AN ORDINANCE, appropriating Seventy-four Thousand Eight
Hundred Forty Dollars ($74,840.00) from the Operation, Maintenance
and Construction Improvement Fund of Fountain Creek to be used for
project costs for channel joint sealing in Maintenance Repair #90
(Fountain Creek) 89076, in the City of Florissant, Missouri; and
confirming a contract with Superior Waterproofing & Restoration
Company, Inc. for said channel joint sealing, in compliance with
Section 9.040 of the Plan of the District.
WHEREAS, the bid for said channel joint sealing is
Sixty-two Thousand One Hundred Fifty-eight Dollars ($62,158.00),
and the cost of engineering, inspection, advertisement costs, and
allowance for construction change orders is Twelve Thousand Six
Hundred Eighty-two Dollars ($12,682.00), and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Seventy-four Thousand Eight
Hundred Forty Dollars ($74,840.00) is hereby appropriated from the
Operation, Maintenance and Construction Improvement Fund of
Fountain Creek to be used for project costs for channel joint
sealing in Maintenance Repair #90 (Fountain Creek) 89076, in the
City of Florissant, Missouri.
Section Two. The contract heretofore let by the

Executive Director to Superior Waterproofing & Restoration
Company, Inc. as the lowest responsible bidder for channel joint
sealing in Maintenance Repair #90 (Fountain Creek) 89076, in the
City of Florissant, Missouri, with The Metropolitan St. Louis
Sewer District, pursuant to bids received and opened on the 14th
day of March, 1991 and formally executed on the 9th day of April,
1991 by said contractor and by the Executive Director and
Secretary-Treasurer on behalf of the District is hereby confirmed,
in compliance with Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
