AN ORDINANCE, appropriating Twenty-eight Thousand Two
Hundred Dollars ($28,200.00) from the Operation, Maintenance and
Construction Improvement Fund of Black Creek to be used for
project costs for the construction of storm sewers in Ladue Road
#9373 (90101), in the City of Ladue, Missouri; and confirming a
contract with J.H. Berra Construction Company, Inc. for the
construction of the aforesaid storm sewers, in compliance with
Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said storm
sewers is Twenty-two Thousand Eight Hundred Eighty-two Dollars
($22,882.00), and the cost of engineering, inspection,
construction staking, advertisement costs, easement charges, and
allowance for construction change orders is Five Thousand Three
Hundred Eighteen Dollars ($5,318.00), and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Twenty-eight Thousand Two
Hundred Dollars ($28,200.00) is hereby appropriated from the
Operation, Maintenance and Construction Improvement Fund of Black
Creek to be used for project costs for the construction of storm
sewers in Ladue Road #9373 (90101), in the City of Ladue,
Missouri.

Section Two. The contract heretofore let by the
Executive Director to J.H. Berra Construction Company, Inc. as the
lowest responsible bidder for the construction of storm sewers in
Ladue Road #9373 (90101), in the City of Ladue, Missouri, with The
Metropolitan St. Louis Sewer District, pursuant to bids received
and opened on the 18th day of March, 1991 and formally executed on
the 9th day of April, 1991 by said contractor and by the Executive
Director and Secretary-Treasurer on behalf of the District is
hereby confirmed, in compliance with Section 9.040 of the Plan of
the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
