AN ORDINANCE, appropriating One Hundred Fifty-nine
Thousand Eight Hundred Thirty-five Dollars ($159,835.00) from the
Operation, Maintenance and Construction Improvement Fund of
Coldwater Creek to be used for project costs for the construction
of storm sewers in Lilac & Gardenia (S-1861, C-1342), in the City
of Florissant, Missouri; and confirming a contract with Fred M.
Luth & Sons, Inc. for the construction of the aforesaid storm
sewers, in compliance with Section 9.040 of the Plan of the
District.
WHEREAS, the bid for the construction of said storm
sewers is One Hundred Thirty-one Thousand Nine Hundred Ninety-five
and 75/100 Dollars ($131,995.75), and the cost of engineering,
inspection, construction staking, advertisement costs, easement
charges, and allowance for construction change orders is Twenty-
seven Thousand Eight Hundred Thirty-nine and 25/100 Dollars
($27,839.25), and
WHEREAS, the City of Florissant, Missouri has agreed to
contribute Seventy-nine Thousand Nine Hundred Seventeen and 50/100
Dollars ($79,917.50) toward the total costs of said project; upon
the receipt of such funds from said source, said money will be
returned to the Operation, Maintenance and Construction
Improvement Fund of Coldwater Creek, and
WHEREAS, the Director of Finance has certified that
there is an unencumbered balance in the above-named fund
sufficient to pay the obligation authorized herein,

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of One Hundred Fifty-nine
Thousand Eight Hundred Thirty-five Dollars ($159,835.00) is hereby
appropriated from the Operation, Maintenance and Construction
Improvement Fund of Coldwater Creek to be used for project costs
for the construction of storm sewers in Lilac & Gardenia (S-1861,
C-1342), in the City of Florissant, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Fred M. Luth & Sons, Inc. as the lowest
responsible bidder for the construction of storm sewers in Lilac &
Gardenia (S-1861, C-1342), in the City of Florissant, Missouri,
with The Metropolitan St. Louis Sewer District, pursuant to bids
received and opened on the 18th day of March, 1991 and formally
executed on the 9th day of April, 1991 by said contractor and by
the Executive Director and Secretary-Treasurer on behalf of the
District is hereby confirmed, in compliance with Section 9.040 of
the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
