AWARDING A COIVTRACT TO PIMA CORPORATION DBA ADVAhVCED
COiVSTRUCTIOIV AS THE LOUVEST RESPONSIBLE BIDDER, IN THE
AMOUNT OF $3,631,480 FOR THE NEVV JOHN HAtI~ PAR~C PROJECT
PHASE I, PROJECT BVU(iIiBER 4011.67.945; WAIVING A BID PROTEST AND
IV~INOR CALCULATION ERROR; AUTHORIZING THE IViAYOR TO EXECUTE
THE AGREEMENT; AND AUTHORIZING THE CITY IlIIANAGER OR
DESIGNEE TO fV1AKE THE PVECESSARY FUNDS APPROPRIATIOiVS AND
TRANSFERS
WHEREAS, the New John Ham Park Project Phase I, Project No.
4011.67.945, is scheduled for completion during Fiscal Year 2008-2009; and
WHEREAS, the City Council of the City of Lynwood adopted the plans,
contract documents (i.e., specifications), and working detaiis for said project on
March 18, 2008, and Public Works staff advertised the project on June 2; 2008;
and
WHEREAS, twelve (12) contractors received project plans and contract
documents; and
WHEREAS, a base bid, additive and deductive bids were incorporated
into the bid documents; and
WHEREAS, the bid opening took place in the office of the City Clerk on
June 25, 2008, and that the Director of Public Works / City Engineer has
ascertained that Pima Corporation dba Advanced Construction was the apparent
lowest responsible bidder for its base bid of $3,377,380; and
WHEREAS, staff is recommending the inclusion of additive and deductive
bid items to include certain necessary park amenities that results in a total
contract price of $3,631,480; and
WHEREAS, the protest letter from the apparent second lowest bidder was
found to be invalid; and
WHERE,4S, a reference check has revealed that this contractor has the
necessary experience for this type of project; and
WHEREAS, staff has identified funding sources that can be used ~o meet
this budget gap of approximately $430,000.
NOW THEREFORE, the City Council of the City of Lynwood does her~by
find, proclaim, order and resolve as follows:
Section 1. That the contract for the New John Ham Park Project,
Project No. 4011.67.945, be awarded to Pima Corporation dba Advanced
Construction for its total bid of $3,631,480, including all additive and deductive
bids. That the bid protest from Valley Crest Landscape and minor calculation
error of Pima Corporation's bid be waived.
Section 2. That the Mayor is hereby authorized to execute the
agreement between the City Council of the City of Lynwood and Pima
Corporation dba Advancetl Construction.
Section 3. That the City Manager or designee is authorized to make the
following funds appropriations and transfers:

Section 4. This resolution shall take effect immediately upon its
adoption.
Section 5. The City Clerk shall certify as to the adoption of this City
Council Resolution.
