AN ORDINANCE, authorizing the Executive Director and
Secretary-Treasurer to lease the riverfront rights upon certain
real property of The Metropolitan St. Louis Sewer District, lying
in St. Louis County, Missouri, to Eagle Marine Industries, Inc.
and to execute a Leasehold Agreement upon the conditions
hereinafter set out.
WHEREAS, the District owns certain improved real
property in St. Louis County incident to its public functions and
responsibilities, and
WHEREAS, Eagle Marine Industries, Inc. is desirous of
leasing the riverfront rights on said real property upon the terms
and conditions as hereafter generally set forth, and
WHEREAS, the District is willing to execute said lease,
and believes the terms to be advantageous and in the public
interest to do so.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer
District does hereby lease to the Eagle Marine Industries, Inc.,
upon the general terms and conditions hereinafter set forth,
riverfront rights upon the following described real property: A certain tract of land on the waterfront of the Mississippi River in U.S. Survey 904, Township 44 North, Range 7 East, St. Louis County, Missouri, conveyed to Lessor and more particularly described in an instrument recorded in Book 6350, Page 152 of the St. Louis County Records.
Section Two. The lease term shall commence on July 1,
1991, and continue for five (5) years to June 30, 1996, at the
rental of Twenty-five Thousand Two Hundred Dollars ($25,200.00)
per year, to be paid in monthly installments of Two Thousand One
Hundred Dollars ($2,100.00) each, and provide for five (5) one-
year options for renewal.
Section Three. The Executive Director and Secretary-
Treasurer are hereby authorized to execute in behalf of the
District a Leasehold Agreement giving effect to Sections One and
Two hereof, and embodying such other terms and conditions as
approved by the Office of the General Counsel of the District.
The foregoing Ordinance was adopted June 19, 1991. 2
