AN ORDINANCE, vacating portions of sewer easements in
Lots 1, 2, 3 and 4 and part of Kevon Drive (50 feet wide) of Kevon
Estates; part of the West 1/2 of the Southeast 1/4 of Section 15,
Township 45 North, Range 5 East; and also part of Lot 49 and Lot
62 of Radcliffe No. 3, in St. Louis County, Missouri, and
authorizing the Executive Director and Secretary-Treasurer on
behalf of The Metropolitan St. Louis Sewer District, to enter into
a Right-of-Way Agreement with the Missouri Highway and
Transportation Commission giving effect to the vacation of
easement rights as specified herein.
WHEREAS, the owner of the subject property has granted
to the District a suitable alternate easement,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The following described portions of sewer
easements are hereby vacated, to wit: Parcel 2: A parcel of land located in part of Lots 1, 2, 3 and 4 and part of Kevon Drive (50 feet wide) of Kevon Estates, as recorded in Plat Book 70, Page 45; part of the West 1/2 of the Southeast 1/4 of Section 15, Township 45 North, Range 5 East; and also part of Lot 49 and Lot 62 of Radcliffe No. 3, as recorded in Plat Book 110 at Page 4, all in St. Louis County, MO and being more particularly described as follows: Beginning at a point in the Existing East Right-of-Way line of State Route JJ (Ballas Road), said point being 40 feet perpendicular distance East of Station 123+00 on the hereinafter described centerline of State Route JJ (Ballas Road); thence Northerly and parallel with said centerline to a point opposite centerline Station 124+00; thence Northeasterly to a point 305 feet perpendicular distance South of Station 700+98.59 on the hereinafter described centerline of State Route 40-

61; thence Easterly and parallel with said centerline to a point opposite centerline Station 703+00; thence Northeasterly to a point 260 feet radial distance South of centerline Station 705+00; thence Northeasterly to a point 140 feet radial distance South of centerline Station 708+50; thence Northeasterly to a point 100 feet radial distance south of centerline Station 710+20; thence Southeasterly and radial with said centerline to a point opposite P.T. Station 714+98.71; thence continuing Southeasterly and parallel with said centerline to a point opposite centerline Station 720+56.12; thence Southwesterly to a point 140 feet perpendicular distance South of centerline Station 719+57.78; thence Northwesterly and parallel with said centerline to a point opposite P.T. Station 714+98.71; thence continuing Northwesterly and radial with said centerline to a point opposite centerline Station 710+00; thence Westerly to a point 195 feet radial distance South of centerline Station 708+00; thence Southwesterly to a point 243.99 feet radial distance South of centerline Station 707+00; thence southwesterly to a point 380 feet radial distance South of centerline Station 704+99.21 Bk; thence Westerly to a point 410.68 feet South of centerline Station 702+62; thence Northwesterly to a point 390 feet South of centerline Station 701+50; thence to a point 50 feet East of Route JJ (Ballas Road) centerline Station 123+00; thence to the point of beginning.
Section Two. The Executive Director and Secretary-
Treasurer are hereby authorized on behalf of The Metropolitan St.
Louis Sewer District to enter into a Right-of-Way Agreement with
the Missouri Highway and Transportation Commission giving effect
to the vacation of easement rights as specified in Section One
above, said Right-of-Way Agreement to be comprised of such terms
and conditions as are approved by the office of the General
Counsel of the District.
