AN ORDINANCE, appropriating Two Million Four Hundred
Fifty Thousand Dollars ($2,450,000.00) from the Clean Water
Capital Improvement Trust Fund to be used for project costs for
the construction of sanitary sewers in Coldwater Creek WWTP
Outfall Phase IV (90217), in St. Louis County, Missouri; and
confirming a contract with Bangert Bros. Construction Co. for the
construction of the aforesaid sanitary sewers, in compliance with
Section 9.040 of the Plan of the District.
WHEREAS, the bid for the construction of said sanitary
sewers is Two Million Three Hundred Thirty-eight Thousand Six
Hundred Eighty Dollars ($2,338,680.00), and the allowance for
construction change orders is One Hundred Eleven Thousand Three
Hundred Twenty Dollars ($111,320.00), and
WHEREAS, pursuant to Section 7.120 of the Plan of the
District, the appropriation effected herein will not result in a
deficit at the end of the current budget year,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Two Million Four Hundred Fifty
Thousand Dollars ($2,450,000.00) is hereby appropriated from the
Clean Water Capital Improvement Trust Fund to be used for project
costs for the construction of sanitary sewers in Coldwater Creek
WWTP Outfall Phase IV (90217), in St. Louis County, Missouri.
Section Two. The contract heretofore let by the
Executive Director to Bangert Bros. Construction Co. as the lowest

responsible bidder for the construction of sanitary sewers in
Coldwater Creek WWTP Outfall Phase IV (90217), in St. Louis
County, Missouri, with The Metropolitan St. Louis Sewer District,
pursuant to bids received and opened on the 29th day of May, 1991
and formally executed on the 11th day of June, 1991 by said
contractor and by the Executive Director and Secretary-Treasurer
on behalf of the District is hereby confirmed, in compliance with
Section 9.040 of the Plan of the District.
Section Three. This ordinance, being an appropriation
ordinance, shall take effect immediately upon its enactment.
